Legal limits of the cross-border movement of military materials

Legal limits of the cross-border movement of military materials The global trade with military materials is an important, however often under- researched, area of academic enquiry. Such attitude is not correct, because in fact it is a massive global industry in which also Czech companies play a significant role. Given the newspaper headlines and statements of arms dealer, it is obvious there have long been unsolved problems burdening arms dealers caused especially by an inappropriate legal framework. This theses aims to provide an analysis of legal framework in respect to cross-border movement of military materials covering especially European and Czech legislation focusing on its potential limits arising and important for arms dealers. On a global international level the Arms Trade Treaty and other relevant treaties regulating international trade with military materials are identified and described. Attention is also paid to limitations of arms trade such as embargoes or restrictive measures imposed by the UN and the EU respectively as well as to limitations resulting from domestic and European legislation or from its different interpretation. Thesis describes the latest legislation of integrated pollution prevention and control effective in the Czech Republic after 19 March 2013 including relevant European Union law especially Directive 2010/75/EU of the European Parliament and of the Council of 24 November 2010 on industrial emissions (integrated pollution prevention and control). First two chapters deal with the sources and principles of integrated pollution prevention and control (hereinafter only "IPPC"), focusing on the principle of a comprehensive approach to the environment and its integrated protection, the principle of prevention and on public involvement in the IPPC permit procedure. The fourth chapter explains selected basic terms of IPPC, such as installation, permit and Best Available Techniques (BAT). In the field of BAT thesis deals with the new status of the Reference Document on Best Available Techniques (BREF) in the IPPC permit procedure, with the procedure for the drawing up and reviewing of BREFs, with their structure and with the exchange of information on BAT. The fifth chapter classifies the IPPC permit procedure into the overall process of implementation of the plan and defines its relationship to the environmental medium Acts. Objections in planning permission proceeding and building permit proceeding Abstract The thesis focuses on objections as a key institute by which participants can defend their rights in the planning permission proceedings and building permit proceedings - the objections. The aim of the thesis is to map this institute both in terms of its procedural use and in terms of the facts that the participants in the proceedings apply in these objections. The author of the thesis does so due to the fact that no professional literature deals directly with this topic. The thesis is divided into several parts. The first part briefly describes the basic principles and mechanisms of planning permission proceeding and building permit proceeding, which are key for a proper understanding of the meaning of objections. The second part briefly describes the history of objections in the legislation from the second half of the nineteenth century to the present and the third part explains the concept of objections from the perspective of administrative law and construction law. The main content of the thesis is then in the fourth and fifth part. Binding opinions as an instrument of the natural and landscape protection

This thesis focuses on the binding opinion and defines its key role in nature and landscape protection. From the author's viewpoint construction activity is an activity with the greatest impact on nature and landscape and the submitted work focuses, among other things, on the evidence that the purpose of issuing binding opinions is the regulation of construction. The thesis consists of introduction, conclusion and five chapters divided into subchapters according to logical and well-arranged structure. The first chapter discusses the role of the body concerned in the protection of the public interest, which is the protection of nature and landscape. The second chapter is structured into several subchapters and is devoted to the description of the binding opinion. The author analyzed its definition features, its legal nature and its content requirements. The last part of this chapter is devoted to the process of issuing binding opinions. Furthermore, the author focused on the review mechanism of binding opinions, namely its legislation in the Code of Administrative Procedure, the Code of Administrative Justice, including a deviation from the general regime laid down by the Building Act. Trade in military material: the Czech and Slovak law perspective

This thesis focuses on the mutual comparison of the Czech and Slovak legislation in field of international trade in military material and its purposes is to identify which one of the legislations is more arms businessmen friendly in terms of legally-administrative costingness. The paper consists of three main parts. The first part is dedicated to the theoretic frame of the legal regulations in question with emphasis on the private international law. It contains the definitions of the well-known terms such as arms, trade in arms or military material. The second part focuses on international legal basics of the issue in question with respect to the most noted international treaties or key European regulation forming core of the trade in military material. The third part of the thesis compares the acts on international trade with military material in the Czech and Slovak Republic.
