The concept of "Responsibility to Protect" and the international community. The case of Sudan

The thesis "Concept Responsibility to Protect Within International Community: Sudan Case Study" focuses on the R2P concept and its implications since its approval at the World Summit in 2005. The theoretical part of the thesis explains the R2P concept, its constitution, the three pillars and their main principles, and categories of crimes on which the concept can be applied. This section includes an analysis of attitudes, which the key international actors adopted towards the R2P. The last chapter of the theoretical part examines the main problems, challenges and difficulties of the concept which could the international community face when implementing the concept. The practical part of this thesis relates to the conflict in Darfur. Its first chapter deals with the evolution of tensions in Sudan, which had affected the current conflict. The second chapter focuses on the present conflict since its beginning in 2003, including the debate about the possibility of potential genocide committed by the Sudanese government. The involvement of the key international actors (the UNSC and AU) in the conflict is discussed in this part as well. Collective Actions of the UN Security Council for Protection of Human Rights

This thesis Collective Actions of the UN Security Council for the Protection of Human Rights deals with, as the title suggests, collective actions for the protection of human rights with the mandate of the UN Security Council. The thesis is divided into an introduction, conclusion, and four chapters. In the first chapter, the system of human rights protection is described, as it was set up within the newly-formed United Nations after World War II. This chapter also deals with collective actions of the UN Security Council, with or without the use of force, on a theoretical level, e.g. their authorization and possibility of measures that can be taken within the UN system against the perpetrator. Second chapter deals with examples of collective actions of the UN Security Council during the Cold War period. In this era, collective actions of the UN Security Council were authorized only twice, in case of South Africa as a reaction to their policy of apartheid, and in case of South Rhodesia as a reaction to the unilateral declaration of independence by the white minority government. Responsibility for protection as a concept of contemporary international law

The thesis focuses on the responsibility to protect as a new concept of the international law designed to help the members of the international community in dealing with humanitarian crisis. Although it is quite new, it has undertaken dynamic evolution and changed its nature to a certain extent. The main aim of responsibility to protect is to ensure that when massive violations of human rights occur, the effective and proportionate response will come and will stop the violations and prevent them from appearing again in the future. First, the debate about state sovereignty and human rights protection was presented and the relevant fields of research were defined. This was followed by the examination of the humanitarian intervention as this concept focuses on issues that are common also to the concept of the responsibility to protect. However, whereas the issues are in common, the perspective is different. While the humanitarian intervention focuses mainly on states, the responsibility to protect focuses on populations striving from human rights violations. While humanitarian intervention deals with the reaction on humanitarian crisis, the responsibility to protect deals mainly with the prevention of the crisis. Maintaining the peace and security by regional arrangements in Africa (focusing on peace-keeping operations) Abstract The present thesis focuses on the issue of peace-keeping operations maintained by the regional and sub-regional organizations in Africa, namely African Union and ECOWAS. The main statement of the thesis is the following: The United Nations is unable to react effectively to threats to international peace and security, especially in cases of mass violations of human rights in intrastate conflicts, that have severe impact on particular region including refugee crisis or spreading the conflict to other states of the region. In the thesis, particular instruments of the above-mentioned international organizations, that create the framework for operations for maintaining peace and security in the region, are described. Attention is also paid to the relevant bodies of the African union and ECOWAS such as Peace and security council of the AU or African standby force. The thesis elaborates on problematic or controversial issues from international law perspective. The future of the Responsibility to Protect after experience in Libya and Syria

This thesis deals with the future of the concept of Responsibility to Protect (R2P) and focuses on prospects of the concept after the conflicts in Libya and Syria. Concept of R2P was developed in 2001 as a reaction to the genocide in Rwanda and Srebrenica and attempts to bring an answer to the question, how to react in the situation when a sovereign state fails to protect its population against crimes under international law. In this thesis I examine the application of the concept in Libya and reasons why it was not applied to a similar situation in Syria. I also deal with the subsequent debate which was held on the international stage after experience with these conflicts and I analyse proposals, which were brought into this debate focusing on how to move the concept forward or modify it. I therefore examine the Brazilian concept of the Responsibility while Protecting (RwP), the question of adoption of guidelines for the intervention according to the R2P, the topic of monitoring and accountability of the intervening state, the Responsibility not to veto and the issue of limiting the use of veto in UN Security Council, the possibility of involvement of UN General Assembly in the R2P, the question of prevention and the topic of unilateral non-forcible measures. Military intervention in Libya 2011 and its impacts

The subject of this thesis is the military intervention in Libya in 2011 with particular emphasis on its execution and its impact. The aim is to assess the intervention both in terms of the application of selected theoretical concepts of international relations, and in terms of real change in the sociopolitical and security situation within the country and the consequences for international security. In the thesis, the concepts of liberal peace and Responsibility to Protect are mentioned. The thesis examines to what extent the two concepts were applied and what impact the intervention had on them. In terms of the analysis of the country's transformation, a special focus is placed on the political stability and the security threats that emerged from the former Gaddafi regime, and the threats posed by present-day Libya.

Responsibility to Protect and Regime Change: Case of Libya

The aim of this work is to analyze the relationship between R2P and violent regime change. The work gives an overview of the establishment of R2P on the international scene, and then deals with its problem of selectivity in its application in practice. Despite the formal adoption of R2P in 2005 by all UN member states, R2P has been since then applied to similar cases of humanitarian crises in different ways. The problem of selectivity of R2P is fuelling the criticism of its legitimacy, because it is according to many a mean for achieving regime change. The most important reason for R2P's criticism is the connection between R2P and violent regime change, and that is the central theme of this work. Based on an analysis of the documents which form R2P, the work concludes that military intervention under R2P must not be deliberately used for regime change. However, there may be situations, when regime change is necessary for the protection of civilians; which means that regime change can be regarded as legitimate only if it is as an indirect result of the intervention. Therefore regime change is an integral part of R2P.
