The theme of this thesis is draft of measures body related with changes in sick benefit system. The goal of this thesis is the analysis of impact of changes in sick benefit system on employer and the draft of measures for the subject. There is a description of sick benefit system used in CR and in other countries EU in this thesis. There is a describtion of the changes and the impacts on employer are analysed. The last part of the thesis is composed by draft of measures related with these changes.

Within last twenty years is has been changed significantly several times. The changes have been intended to contribute mainly to the reduction in the number of exploited sickness leaves, to the strengthening of responsibility of employees, employers and physicians. After 1989 the system faced many legal modifications. This thesis is focused on analysis of the health insurance system in the Czech Republic after year 1989. The theoretical resources of the thesis are human and social rights, social security and its principles. The main segment of the theoretical part of the thesis is a function of the right for social security and a description of health insurance. Employer's obligations in health/social and pension insurance Abstract This master thesis is diving in the problematics of obligations of employer with focus at obligations in health and retirement/social insurance. As it is important and wide topic, frequently discussed lately as for obligations of employer during pandemic times, when more and more obligations and requirements are imposed on employer's shoulders. In the first and second part thesis is more focused on background of those obligations and historical development. Third part is designated to health insurance and differentiation of particular obligations of employer, start and end of those, and splitting them according to scheme of Ministry of Social security to groups of obligations: related to registering of employees to all necessary registers, cooperation with local authorities on field of social security, recording all necessary information, archiving reports for legal period, obligations in connection to application for benefits. Sickness insurace benefits provided during pregnancy and maternity The diploma thesis analyses the sickness insurance benefits provided during pregnancy and maternity. The period of pregnancy and maternity is very demanding for a woman both economically, psychologically and physically. Social security law regulates material security to help mitigate in particular the economic impact of these social events. It is an important tool for encouraging an increase in the birth rate and thus has positive effects not only for the individuals directly concerned but for society as a whole. The thesis is composed of an introduction, a core, which consists of five parts, and a conclusion. The first part deals with the basics of social security and the most important moments of its history in relation to the topic of the thesis. The second part focuses on labour protection of women during pregnancy and maternity, which complements the material security regulated by social security law. The third part focuses on general issues of sickness insurance, including participation in sickness insurance, entitlement to benefits, its organisation, management and financing. Social legislation in Czech lands in the years 1918 - 1948 Abstract The dissertation deals with the theme of social legislation in the period of 1918-1948. i.e. during the so called First, Second and Third Czechoslovak republic. However, the foundations of the Czechoslovak laws in this area lays in the period of Austrian laws, especially from the second half of the 19.th century. Development of social legislation was directly conected with the existence of a legal regulation of modern municipal self-government and higher levels of self-government. Two very important acts were adopted in this respect: Act No. 18/1862 The empire's code implemented on 5th March 1862 "The Act on Municipal matters" and on 3rd December 1863 Act. No. 105/1863 The empire's code "The act about Domestic rights". For poor relief the "The Poverty act" (Act No. 59/1868 The provincial code) was enacted on 3rd December 1868. Based on the social policies of "stick and carrot" of Otto von Bismarck in Germany, the Austrian Government enacted series of Acts on health and other types of social insurance systems, which were not universal, but had differences for different types of workers and employees, for example for miners, factory workers or white collars. The sickness insurance benefits system Abstract This diploma thesis deals with sickness insurance benefits, which create a comprehensive system, whose main goal is to provide social security to economically active people, especially in the case of short term loss of income, due to social incidents, such as sickness, sickness attendance, pregnancy or maternity. This thesis analyses conditions of entitlement of the particular benefits, as well as the calculation of their sum. Due to significant complexity of certain calculations related to sickness insurance benefits, this thesis also contains practical examples. Attention is also paid to some specific areas of sickness insurance, because of their relatively new legislation. The text of the thesis, except for the introduction and conclusion, is divided into four chapters. The first chapter does not deal with the sickness insurance benefits, but rather introduces the concerns of the sickness insurance; outline its development and basic principles. Jana Krutská Analysis of Incapacity for Work Due to Disease or Injury and Presenteeism in the Czech Republic Abstract The aim of this doctoral thesis is to provide the readers with as comprehensive view of the issue of sickness and accident rate of workers in relation to work attendance as possible. The dissertation deals with both absenteeism of sick individuals, i.e. the incapacity for work due to disease or injury, and presenteeism, that is the performance of gainful employment despite acutely impaired health condition. Due to the different nature and level of knowledge of the examined phenomena, each of them is devoted a different level of attention. The issue of the incapacity for work due to disease or injury is analyzed in more detail. Development of the parametric values is set in the context of administration and legal changes, which have occurred in the Czech Republic since the early 1990s, and conditionality of the occurrence of the incapacity for work due to disease or injury are further investigated based on individual anonymized data. Obligations of the employer in sickness and pension insurance Abstract This thesis deals with the individual obligations of the employer in sickness and pension insurance. Sickness and pension insurance are two of the social insurance subsystems. The state does part of its responsibilities in this area through employers, as they have the easiest access to some information. Of course, the state could obtain information from the employees themselves, but this would represent a huge administrative burden on the state and a great logistical problem in how to actually obtain information from the employees. Obligations that an employer must fulfil may be difficult for a small employer who does not want to hire external companies to fulfil its obligations to the state and it can be almost impossible to fulfil all obligations properly. The most well-known obligations of employers, of which (perhaps) all citizen-employees know, are payments into the sickness and pension insurance system in the form of social security contributions. The employer pays the social security contributions for himself and his employees. However, this is certainly not the only obligation of employers. Faktory ovlivňující výdaje na dávky nemocenské v ČR

This thesis is dedicated to an analysis of factors influencing the amount of paid sickness benefits in the Czech Republic. In the literature review, potential factors influencing the above mentioned dependent variable are outlined based on scientific articles and publications. Using a regression analysis, all these explanatory variables are verified and factors really influencing the amount of paid sickness benefits in the Czech Republic are identified. These variables are quantified using a method of least squares. In the practical part of the thesis, time series of Expenditures on sickness insurance benefits and Income from insurance and associated payments for the sickness insurance are examined by a qualitative decomposition method. For both these time series, predictions for four upcoming quarters (whole 2017) are created. Based on an analysis of these two time series, a balance of income and expenditures is created and recommendations for the Ministry of Social Affairs are defined. From the results gathered in the practical part, consequences are drawn in the discussion. These serve as a basis for solutions and measures for employers to save labor costs and to achieve an efficient human resource management. All analyses in this thesis are conducted from quarterly data from 2004 till 2016.
