Local referendum

Resumé The thesis examines local referendums, a form of direct democracy that is used the most in the Czech Republic. Nowadays, it is a standard part of municipal politics. The goal of the paper is to provide a complex analysis of the legislation, based primarily on relevant case- law, including the newest rendered in fall 2014. The thesis is composed of an introduction, nine chapters and a conclusion. The order of the paper largely follows the composition of the Act on Local Referendum. Chapter One examines the relevant constitutional and international legislation. Chapter Two describes the scope of topics that may be subjects of local referendums in general and also looks at the most frequent ones. Chapter Three concerns itself with the preparative committee - a body that puts forward the proposal to hold a local referendum - and examines its assembling and operation. Chapters Four and Five explores the review procedure of the committee's proposal conducted by municipal authorities and by municipal councils that render the final decision to hold a local referendum. Chapter Six focuses on the conditions that need to be fulfilled in order to achieve a valid and legally binding decision in a local referendum. Direct democracy at the municipal level in the Czech Republic

The objective of the submitted diploma thesis is to analyze the subject of a direct democracy system in the Czech Republic focusing on the local level of governance. The possibility of being able to participate imminently in the municipal government and thus amending the current representative model became the subject of not only political discussions over the last few years. The thesis is composed of a foreword and five chapters, which are hereafter divided to subchapters for better transparency. Findings and author suggestions concerning the possible future forms of the local democracy are summarized in the conclusion. The introductory chapter presents the direct democracy in a theoretical way and shows how it differs from the representative democracy model. It also contains the definition of the five most respected forms of a direct democracy, which are: referendum, plebiscite, citizen initiative, petition and recall. Following two chapters are focused on the situation in Czech Republic, first in general, then with an emphasis on the municipal scene. Efforts to establish an individual form of a direct democracy can be observed already from the year 1918 with various results, new possibilities appeared later as Czech Republic had entered supranational communities. The diploma thesis Local Referendum in the European Area offers a comprehensive overview of the legal regulation of the institute of local referendum in individual European countries. In four parts devoted to Central, Southern, Western and Northern Europe, it introduces the regulation of this institute in the local legal systems and compares individual solutions not only with the Czech regulation, but across all European states. It deals in detail with individual aspects of the local referendum, including its announcement, binding force and the possibility of a popular initiative.
Political Aspects of Jointly Held Local Referenda and Local Elections: Case Study of the City of Prague

This thesis deals with political aspects of jointly held local referenda and municipal elections, focusing on the possibility of utilizing this concurrence in order to achieve political goals - influencing the progress of referendum, mobilizing voters, using the referendum as part of election campaign - the main aim is to systematize and classify these political aspects, the other aim is to identify strategies adopted by political participants in order to achieve holding both events in conjunction. The first part of the thesis the issue of jointly held local referenda and elections is placed in the context of EU member states and the conditions of local referenda in Czech Republic are analysed. In the second part individual political aspects of local referenda are identified and based on that the key categories are defined in order to systematize and classify political aspects of local referenda. The latter systematization is then used in the multi-case study of Prague, specifically its districts where the initiators of the referendum intended to hold it jointly with municipal elections in October 2014, and strategies of achieving conjunction are identified based on discovered findings.
Local referendum - Institute of local referendum in the Czech Republic and Slovenia

This thesis deals with the essential aspects of the local referendum as a widely used complement of representative democracy and with the particular forms it appears in the Czech and Slovenian legal orders. The main objectives of this thesis are following: describing Czech and Slovenian legal regulations concerning the local referendum in detail, exploring certain areas of its practical use and finally concluding whether there is any significant difference in the way these two countries, that share similar experience historically and of the recent years too, approach direct democracy and the institute of the local referendum in particular. The body of the thesis is made up of nine chapters. In the first chapter Introduction I clarify what led me to focus on the respective issues. The second chapter Idea of Direct Democracy tackles the origins and the essence of direct democracy, its potential to be used in the modern world and also briefly describes those institutes of direct democracy that are used in the Czech and Slovenian practice. Resume The aim of this thesis is to examine local referendums, mainly focusing on the Local Referendums Act which regulates this issue. This thesis consists of an introduction, six chapters which follow the systematics of the Act, conclusion and an appendix. In the introduction this thesis gives the definition of local referendums and deals with the history of this institution of direct democracy in the Czech Republic. The first chapter is devoted to the right of participation in a local referendum. The second chapter deals with the admissibility of a local referendum, it defines the conditions under which a local referendum should be held, matters in which the local referendum may be held and limitations of a local referendum. The third chapter describes the process of calling of the local referendum, which can be called in two ways - by the own decision of the municipal authorities or by the municipal authorities after the proposal of the preparatory committee. Particular attention is devoted to a local referendum called on the proposal of the preparatory committee, conditions that must be met by the preparatory committee, including the rules of collecting the signatures and the number of required signatures on the signature sheets. Local referendum in the Czech Republic

The diploma paper represents a contribution to the research of direct democracy in the Czech Republic, specifically it deals with the most used form of direct citizen participation in governance, local referendum. The paper is mainly empirical - it shows an experience of ten European countries with local referendum as well as the legislative framework and the definition of this instrument in the Czech Republic. The centre point of the whole thesis lies in the real practice and the experience of Czech municipalities with local direct democracy. The data used in this paper come up from research which aimed to collect information on all local referendums in the Czech Republic since 1990. Although this aim has not been fully accomplished, the data allow to study the practice of Czech local referendums. Local referendums are divided into several groups (categories of territorial changes, the environment, issues of internal governance of the municipality and others) within which are further analysed. The aim of the paper is to verify the hypothesis that seeks a relationship among the size of the municipality, subject of voting, quorum and voter turnout. The paper also focuses on the factors that have got fundamental impact on the final result of referendum.
