Civil liability for the harm to health caused during medical treatment under Czech and German law (a comparison)

This diploma thesis compares the Czech legal regulation of civil liability for bodily harm caused during medical treatment to the German legislation on the matter. In this case, the German legal regulation can serve as a source of inspiration due to its stable development. Both legal regulations can be assessed with respect to the rules being preferable either for the harmer or the sufferer. Concerning the provisions within the German law that are preferable for the patient, they cover e.g. the origin of liability for bodily harm caused by all participating persons providing the medical treatment while doing a tortious act, including the direct liability of persons who are "used by the activity". Due to the broader concept of harm in the German civic law the patient has a right for damages based on a generally defined nonmaterial harm, where the conrete amount of damage is determined by the court. The German legal regulation is preferable and more equitable especially for young injured, in which case the assessment of damages for the salary lost is not based only on the average salary of the sufferer before the harm was caused, but it also reflects the lifetime salary, which the injured could have achieved, had the bodily harm not been caused. Employee Liability for damage

This bachelor thesis adresses the liability of an employee for damage and is primarily focused on liability for the deficit on fiduciary values that the employee is obliged to bill. The thesis comprises of 5 chapters. The first chapter introduces the general term of responsibility and legal liability. Second chapter focuses on liability in labor law and third chapter is already adressing liability for damage. Liability of the employee will be discussed in fourth chapter with a focus on the deficit on fiduciary values that the employee is required to bill. Based on the jurisprudence and professional articles, I will will study to which extent is right to require a liability after an employee and how and under which circumstances can be an employee released from it. In order to fulfill my aims I also analysed the chosen court judgment of the High Court of the Czech republic.

The bachelor thesis deals with the issue of employer's liability for damage in the area of Labour law. Its purpose is to describe this issue and to clarify the most important terms. First part of the thesis analyses characteristic features of liability in Labour law area, especially employer's liability. It also explains particular types of liability for damage. Statistics from 2010, connected with occupational diseases and work accidents are mentioned in this part too. Chapter five is practical part of this thesis. Specific legal cases prove the compensation for damage connected with work accidents.

The thesis also deals with characteristic features, functions and prevention of liability for damage in Labour law as well. The main part is devoted to liability for damage of employer with regards to judicial decision. It explains general and special types of liability for damage of employer and explicates compensation for damage. Furthermore this thesis gives an attention to legal insurance of an employer's liability for damage incurred by work accident and occupational disease and accident insurance.

The main aim of this thesis is to provide well-arranged and consistent information about the liability for damage in the Czech commercial law. At the beginning there is the definition of the liability and in the following part there is the explanation of the liability for damage according to the Civil Code and Commercial Code. This part of the thesis includes both the general and the special legal regulations.The practical part of the thesis includes three judical decisions. These decisions help to understand how courts work and adjudicate in practice.

This part of the thesis includes the general and special legal regulations and also the noncontractual liability. The conclusion of the thesis is devoted to the examination of the causality and the example of the liability insurance of the private limited liability company.
