Pre-action disclosure of information and evidence Information asymmetry or information deficit is a phenomenon where a party to civil litigation is objectively unable to carry its burden of allegation or proof because the relevant information and evidence is completely beyond its reach and there is no way the party could have obtained it through its own activity. In such cases, there is a risk that, due to the party's information deficit, the party will not be able to seek effective judicial protection and will not be able to effectively enforce its subjective rights. Such a situation has negative consequences both for the affected party and for society as a whole, since the consistent exercise of subjective rights also provides protection to objective rights. For this reason, it is essential to address the problem of the information deficit, preferably even before litigation is initiated. The topic of overcoming the information deficit is becoming increasingly relevant, as increasingly complex legal relations between private law subjects entail more complex disputes over the law, which are often accompanied by information asymmetry between the parties to the dispute. Civil disputes between doctor and patient in medical healthcare The issue of civil disputes between doctor and patient in medical healthcare is characterized by a high degree of interdependence of substantive and procedural questions. The main issue here is inequality between doctor and patient in their relationship, which is based more on factual inequality than inequality in rights. The patient as consumer and therefore the weaker party has limited access to relevant information concerning the subject of the relationship between doctor and patient. On the other hand, a doctor is a subject which has in its power almost all the relevant information. As can be seen, for a given relationship is characteristic a high degree of inequality of information. This inequality, which arises in the relationship always, is not sufficiently addressed by the substantive regulation and its effects are present in subsequent court proceedings in the form of an information deficit. The first introduction to electronic assistive devices for children with visual impairments in the instructional course.

This First Degree (Bachelor) Thesis deals with the course in Operation of electronic compensatory aids. The course was attended by two clients with severe visual impairment for whom methodological guidelines in the form of codes of practice were created. The thesis is divided into a theoretical and a practical part. Further, the theoretical part is divided into six chapters the first of which is focused on visual impairment. The second chapter deals with the development of individuals suffering from visual impairment. The next chapter seeks to define the education of persons suffering from visual impairment and the related specialized pedagogical counselling. The fourth chapter bears on specialized pedagogical counselling for persons suffering from visual impairment. The fifth chapter applies to social rehabilitation and brings a presentation of consultancy facilities dealing with social rehabilitation as well. The last chapter describes compensatory aids for persons suffering from visual impairment. The goal of this thesis is to optimize a part of the existing course in Operation of electronic compensatory aids by adapting the codes of practice for the use by clients suffering from visual impairment. A partial aim consists in gaining knowledge about the course in Operation of electronic compensatory aids through a debate with the instructor of course and, based on the instructor?s recommendation, to specify a theme that will be worked out in the codes of practice subsequently. Another aim of the thesis consists also in creating a guidance document that will contribute to a higher level of the course in Operation of electronic compensatory aids and in subsequent verification thereof in practice. In accordance with the objectives set relevant research questions have been defined. For the achievement of the objectives set qualitative research was assigned and the following methods were used for the data collection. The first method applied is structured interview. The interview was conducted with the instructor of the course in Operation of electronic compensatory aids. Based on the interview outcomes, the theme was designed that was developed into four codes of practice later on. The second method adopted in the research survey was observation through participation. There were defined observation categories corresponding to the partial aims of the thesis which were entered into the record sheet covering the observations to be realized. The last method employed was the method of secondary analysis of the clients? personal documentation. The research itself was carried out in the course of the period from February to mid- April in the premises of Tyflokabinet České Budějovice, o.p.s., the institution that is realizing the course in Operation of electronic compensatory aids. The group subject to research consisted of a sightless pupil and a partially sighted pupil. The result of my work represents an original methodological document. Thanks to the evaluation of the subject matter presented at the end of each lesson, it was found that the codes of practice were, on the other hand, beneficial to the course in Operation of electronic compensatory aids and, on the other hand, contributed to the understanding of the subject matter treated. Based on observations, I found that the teaching lesson of the course is influenced by the time of one hour allotted to the course and by the attention of attending clients, too. Based on the observations realized we can say that various games and activities can be made up that are intended for the practicing of the subjects discussed, however, the time allotted to the course teaching, viz. 60 minutes, must be taken into consideration. It has been proven that the 60 minutes were often not sufficient for discussing all the subjects prepared, still the time of 60 minutes is too long for maintaining the attention of the clients.
The Importance of Information Communications Technology for Pupils and Students with a Visual Disability in the Educational Process

My dissertation thesis deals with information and communication technologies in the context of education and their impact on the subsequent quality of life of individuals with sight impairment. The work shows that it appears essential to provide pupils and students with impaired sight not only with the standard volume of knowledge, but also with specific and social skills and competences which will become a tool compensating their impaired sight handicap. The objective of the practical section of my thesis consists in determining the specifics of the process of instruction of pupils and students with sight impairment focussed on information technologies and in comparing the acquired data with research results aimed at the majority population of pupils and students. The said issues were analysed using the quantitative procedure of questionnaire research and evaluated under the application of frequency statistics. The testing of hypotheses was based on the Chi-square independence test. The research also incorporated the target group of parents of pupils with sight impairment and their teachers. Significant factors affecting the optimisation of the education and instruction process as a whole in the above mentioned target groups were determined and compared. Based on the acquired data and their statistic evaluation I succeeded to prove a significant correlation between the level of acquired competences in the field of information and communication technologies and the level of sight impairment. The results of the empiric section also suggest that the education of students with impaired sight within the mainstream educational process shows considerable reserves as compared with the educational process applied in special schools for pupils with a health handicap. The theoretical section of my thesis is divided into three chapters focussed on the conceptual and material specification and definition of the problem. The introductory chapter deals with the theoretical issues of sight impairment and the individuals with this type of handicap. The second chapter presents the system of the education of pupils and students with impaired sight and the concluding chapter deals with information and communication technologies as the tools compensating the information deficit in individuals with sight impairment. In co-operation with the Special Educational Centre based in České Budějovice, the results of my dissertation thesis will present the basis of recommendations targeted at an optimised formation of specific skills and competences in pupils with impaired sight educated within the mainstream educational process. The theoretical output of my thesis will result in study materials for the branch of specific educational studies in the Faculty of Health Care and Social Studies of the University of South Bohemia.
Computer Technology as Means for Compensation of the Information Deficit of People with Visual Handicaps

This thesis engages in computer and communication technologies as means for compensation of the information deficit of people with visual handicaps. There is an outline of the visual-handicap problems and its specification in the theoretical part. Then the historic context and development of approaches ideas in this field is sketched. Reader is also acquainted with the compass of visual handicaps and with the specification of inborn and obtained visual handicaps. This part is concluded by clarifying of the visual-handicap compensatory mechanisms.Next there is characterized and determined the complex rehabilitation of people with visual handicaps and more detailed attention is paid to the social and working rehabilitation. The following part of this thesis tries to introduce the field of computer and information technologies in context with the problems of the visual-handicaps. Text acquaints with the historic development in this sphere, with the problems of compensatory tools and integration computer technology into tyflotechnology. More detailed is decribed an area of the electronic compensatory tools on the basis of PC - first of all digital and camera magnifying glasses, the digital readable equipment with the vocal and touch outlet and Braille,s peripheries. Not even omitted the legislation of this problems. Author acquaints readers with the specification of internet use by the visual-handicaps and with the digital library services.This part is concluded by a topic of the navigation GPS and mobile phones use. The practical part presents the organized pieces of information that in concrete terms substantiate the theoretical part. There is a complete guide of the firms distributing the above mentioned compensatory tools and summaries of the electronic compensatory tools on the basis of PC in the practical part. European public sphere - analysis of the media discourse

The bachelor thesis is based on the assumption that the formation of a European public sphere is desirable. In order to successfully tackle problems that transcend the boundaries of nation states, a majority of votes at the transnational level is necessary . If EU decision-making is to be considered legitimate, it is necessary to create a European public sphere, that would control the policy of the EU. In the first part of the work, the thesis deals with the assumptions, forms, and conditions of the creation of a European public sphere. The work justified the view that the formation of a European public sphere is possible and the conditions of its creation are determined. In the second part of this thesis, the political news of Czech public television CT and German public television ZDF are reviewed. CT currently broadcasts more programs concerning the EU and European issues are expressed with better quality. Both CT and ZDF inform the public about what is happening in the EU from a national perspective and in their programs, they do not discuss the specifics of EU policy.
