Procedural position of a person whose domicile is unknown in light of "Brussels I Regulation" One of the results of the removal of obstacles that previously used to prevent EU citizens from moving into another member state is, among others, an increase in the number of contracts entered into with nationals from other member states. Connected therewith there has been an increase in the number of cases involving a foreign element taken before courts of the member states. Many of those cases are in fact brought against persons whose domiciles are unknown. To be precise, in practice it is defendants on whom it is not possible to serve the process and at the same time the court has no information regarding their domiciles. Not only is it impossible to find out whether they are in the Czech Republic, but the question is whether they are in the EU at all. In such a case it is necessary to consider whether it is possible to apply the rules of Brussels I Regulation, whose operation is based on the principle of domicile of the sued party, for the determination of jurisdiction in proceedings against such defendants. 1 RESUME This Honours Project has a character of comaparing theory. It is devided into six chapters. In the first chapter is specified The Office of the Public Guardian. The second chapter is focused on historical development and is devided into four sub- chapters. The special guardianship regulations from the times of Roman law all the way to the latest history are discussed in these four sub-chapters. The third chapter is comparing The special guardianship regulations of The family law number 94/1963 of Civil Code which was subsituted by new law 89/2012 of Civil Code valid from 1st January 2014. It is comparing the special The fourth chapter called The guardian ad litem and other forms of guardianship is describing the these forms by the valid Special guardianship regulations and comparing with The guardian ad litem. The fifth chapter is focusing on the guardian's allowance for the personal use of the minor. The last sixth chapter gives us the characteristics of current social and legal children protection system in Czech Republic.
