Pochman, Petr ; Boháč, Radim (advisor) ; Martiník, Pavel (referee)
Bank identity and electronic identification under the AML Act Author: Petr Petr Pochman The aim of the thesis is to describe in detail the whole process, the legal basis and the reason for the existence of the procedure of using the bank identity, which is a form of electronic identification under the AML Act, but also to assess whether this procedure does not offer various risks or shortcomings, taking into account the existing other identification options. Identification in general has been gaining importance in the last few years, with the need for accurate identification of persons appearing in various situations, from the opening of a bank account, to the buying and selling of securities by securities dealers and nowadays also in the activities of real estate agents. The frequency of uses in which identification is carried out is increasing year by year for the average person (one of the most recent cases of the widespread use of identification is the real estate activity already mentioned). At the same time, the identification process is becoming more digital and user-friendly, especially with the use of the aforementioned bank identity. The increase in the frequency and, in some respects, simplification of the identification process may lead to an increase in certain security risks, both on the part...

Kočí, Jan ; Čech, Petr (advisor) ; Hurychová, Klára (referee)
The law of business corporations riding on the wave of digitalisation The topic of this diploma thesis is the law of business corporations riding on the wave of digitalisation. Due to the spread of the topic, the author decided to narrow it down. Therefore, the thesis focuses solely on online establishment of a limited liability company in the Czech Republic and attempts to answer the question if any limited liability company in the Czech Republic can be established online within several minutes. The thesis is divided into three main chapters. In the first chapter the reader is provided with an insight into the legal regulation of electronic identification by the virtue of electronic identification being the key for digitalisation of this part of the company law. Its near future is also partly explained in this thesis due to the fact that the legal regulation of electronic identification and thus its technical side will most likely undergo major changes in the next few months. The second chapter is dedicated to the amendment of the notary code, which introduced the possibility of writing a notary record in an electronic form. This option for notaries is the second key innovation that enables the establishment of a limited liability company in the Czech Republic online. However, in this chapter the...
Electronic signature in administrative procedure
Jandora, Tomáš ; Handrlica, Jakub (advisor) ; Rajchl, Jiří (referee)
1 Abstract As a topic of the diploma thesis I have chosen the issue of electronic signature in relation to administrative proceedings. The field of electronic communication is incredibly diverse and it is growing very dynamically. For this reason, I found the topic interesting and usable in the future. There have not been many theses on this topic yet, so I did not have to solve the problem that it was not original. I have always had a positive attitude towards digital technology. At the same time, I was fortunate that I could have always been informed about information technologies by someone who was interested in the issue much earlier. No matter whether it was more experienced family member, high school teacher who by far exceeded the capacities of the educational institution, or patient colleague at work. As stated at the beginning, this work could not have been finished without the contribution of my father, who has been involved in the issue of electronic signatures for a long time, and who brought me to the idea of choosing this topic. The aim of this work was to describe possibilities of application of electronic signing in administrative proceedings, or in communication with public authorities. However, a simple description of the legislation, which is presently in practice, would not be...

Electronic identification of persons in private law relationships Abstract This diploma thesis deals with the topic of electronic identification of persons in private law relationships. It defines all types of electronic identifiers, which can be used in private law relationships by both legal entities and so natural persons. This paper summarizes the young and not for long used legislations. This legislation is not often used in practice and for that reason it has the only commentary. The case law for this problematics is also lacking and that is why it could not be used as one of the sources, despite that it is in many cases one of the most used and valuable sources. This thesis analyses not only the legal aspects of the electronic identification, but also the technological aspects, which it tries to explain even to the readers, who can be absolutely untouched by the world of information technology. At the same time this diploma thesis provides instructions for potential users of instruments of electronic identification, who can be distrustful and insecure of its first time user experience. The minor part of this thesis deals with the history of electronic identification. This section is not extremely extensive due to the fact, that history of his phenomenon goes only about hundred years to the past. The...
