Trade union plurality at an employer Abstract In this thesis I deal with the issue of trade union plurality at an employer. In the thesis I describe the role of trade unions and the development of the legal regulation of their plurality. In doing so, I analyse the conclusions of the Constitutional Court expressed in the ruling Pl. ÚS 83/06 and its implications for current and possible future legislation. I also describe the problematic aspects of the current legislation in this area. These problems concern both the representation of non-unionised employees in individual matters and, in particular, collective bargaining. The aim of the thesis was to try to suggest possible options for solving the current unsatisfactory state of the legislation. The thesis analyses three basic options for dealing with trade union plurality in the context of collective bargaining. These are the introduction of the majority principle in some form, the involvement of employees by way of voting, and allowing for the existence of multiple collective agreements at a single employer. Changing the conditions for starting of functioning of a trade union at an employer is mentioned as an additional option. The aim of this bachelor thesis is a comparison of the Czech and French law on collective bargaining with an emphasis on the right to strike and analysis of the relevant French legal terminology with a glossary. The content of this bachelor thesis consists of an introduction to labour law, basic sources about the topic and overall structure of both rules of law. Thereafter the thesis is dealing with the legislation of collective bargaining in more detail. Last but not least it is covering the right to strike. The conclusion is made of comparison of legislation of collective bargaining with an emphasis on strike in both rules of law and evaluation of the range of their differences. In the very end of this bachelor thesis, a French-Czech glossary is present.
The Role of Trade Unions in Protecting Employees' Interests

The main goal of this thesis is the description of the activities executed by trade unions. Trade unions represent an important aspect of labor relations and can have a crucial influence on working conditions. The legislation of the Czech Republic lacks a comprehensive legal regulation regarding trade unions, which leads to general confusion. One of the points of focus of this work is the exploration of the general opinion of employees on trade unions and its comparison with their actual scope. Questionnaires together with controlled interviews with employers and unionists are used as the main source of information. The results of this thesis show that the majority of employees perceive trade unions positively, even though they cannot characterize their activities. The outcomes also point to the importance of work safety as one of the main interests of the unionists as well as the impact of economic trends on collective bargaining.

Collective bargaining The subject of this thesis is collective bargaining. Alongside individual labour law, it is a traditional branch of labour law with roots going back to the 19th century. In the Czech Republic, the foundations of modern collective law were laid as early as 1870, when the so- called Coalition Act was adopted. The great flowering of collective labour law then occurred during the period of the First Czechoslovak Republic. Today, collective bargaining has an irreplaceable place in Czech society. The aim of the thesis is to describe collective bargaining and to reflect on the shortcomings of the Czech legal framework, or to contribute to the general discourse with de lege ferenda considerations. The thesis consists of the introduction, three chapters and the conclusion. The first chapter is devoted to the sources and legal regulation of collective bargaining. In addition to being enshrined in the Czech legal system, including at the constitutional level, the documents of international organisations, in particular the conventions of the International Labour Organisation, have a major influence on collective bargaining. Resumé Das Ziel dieser Diplomarbeit war die Zusammenfassung der bestehenden Rechtsregelung von dem Tarifvertrag und zugleich die Entwicklung der Rechtsregelung von den Tarifverträgen. Ich habe gleichzeitig auf die bestehende Rechtsregelung des Tarifvertrags hingewiesen, wie diese Regelung in der Bundesrepublik Deutschland geregelt ist. In den ersten Teil meiner Arbeit habe ich mich mit der historischen Entwicklung von dem Kollektivarbeitsrecht zu der Analyse der bestehenden Rechtsregelung befasst. Der nächste Punkt war die Verankerung des Kollektivarbeitsrechts in der tschechischen Rechtsordnung, die von dem europäischen Recht und von den internationalen Verträgen, durch die die Tschechische Republik in diesem Gebiet gebunden ist, beeinflusst wird. Ich habe mich weiter mit dem einsamen Begriff von dem Tarifvertrag und mit den Begriffen befasst, die mit den Tarifvertrag zusammenhängen. This dissertation is presented within the doctoral study on the Charles University in Prague, Faculty of Law. The presented dissertation addresses the issue of the status and activity of trade unions in labour relations. The dissertation deals with the conditions for legal foundation and creation of trade unions, the conditions for their operation at an employer, their organisational structure, the conditions for the dissolution and disbanding of trade unions. The dissertation is also devoted on the questions of plurality of trade unions, as well as the questions of jurisdiction and powers of trade unions in labour relations, focusing on the right of collective bargaining and the right to conclude collective agreements. The dissertation also deals with the collective labour disputes and the various methods of their resolving, focusing on the right to strike as an extreme means for resolving a collective dispute. Trade unions organizations in employment relations The thesis deals with trade union organization as the most important representative of employees in collective employment relations. The purpose of this thesis is to describe a task of trade union organization as a legal subject from the view of legal theory, as well as from the view of contemporary legal regulation which has recently been substantially changed due to the recodification of private law. These contemporary amendments change a status of trade union organization as a legal person. These amendments have been followed by many interpretative difficulties. The thesis further describes activities and rights of trade unions as a subject with regard to first, the last amendments in legislation and second, the current jurisprudence. Vedoucí práce doc., JUDr. Jan Pichrt, Ph.D. The aim of the thesis is mainly to highlight the level of coverage by collective agreements in the CR and to analyze the impact of collective bargaining for employees and employers using available statistical data. By the evaluation of the processes of collective bargaining and focusing on its individual institutes I am looking for the perfect method of handling the collective bargaining so as to be beneficial for both parties involved, and try to present the method how the modern trade union should work in its interaction with the employer, different from the common practice of today's trade unions. I also point out the need for proper analysis of the situation prior to collective bargaining and the method of selecting strategy for negotiations. I chose the topic based on my personal experience with the representation of employees and involvement in the collective bargaining and also on the experience of participation in the EWC.

Role of trade unions as representatives of working citizens in Czech Republic and Germany

My thesis studies the role of trade unions as representatives of workers in Czech Republic and Germany. The aim of this thesis is presentation of representation of collective and individual interests of workers on various levels - from national to corporate level. My thesis presents position of trade unions towards state and employers too. In the last chapter the thesis deals with social issues and challenges, that trade unions deal with as well. In conclusion the thesis offers a comparison of the role of trade unions at mentioned levels of representation in Czech Republic and Germany.
