The Possibilities of the Use of Facial Recognition Technology in the Context of Personal Data Protection in the EU Abstract This thesis focuses on the data protection connected to the use of facial recognition technology in the EU. In particular, the purpose of the thesis is to assess under which circumstances and conditions the use of this technology complies with the GDPR. Marginally, the thesis addresses the risks and benefits of facial recognition technology. The thesis is divided into three parts. The first part examines the general data protection framework in the EU, with an emphasis on the protection of biometric data. The aim of this part is to outline the main legal background regarding the protection of biometric data and the general principles of data processing. In particular, the author criticizes the legal definition of biometric data, which does not correspond to the technological reality, and which may be problematic in the case of the application of Article 9 of the GDPR. The second part of the thesis is devoted to facial recognition technology itself, its different types, and applications. PERSONAL DATA PROTECTION UNDER THE GDPR WITH FOCUS ON EMPLOYMENT RELATIONSHIP AND BIOMETRICS ABSTRACT This thesis focuses on the very complex and legally complicated issue of personal data protection in the period since the GDPR Directive came into force, i.e. from May 2018 onwards. The adoption of this data protection regulation can certainly be described as one of the most pivotal moments in the history of European legislation, as there has never before been a unifying regulation so extensive that it forced all Member States to regulate such a peculiar area in exactly the same way. For this reason alone, both before and after the GDPR came into force, the topic of data protection has been the subject of numerous debates, as the regulation in question has brought about many significant changes that were previously unprecedented in the field of data protection. The issue of the use of biometric data in labour relations Abstract This diploma thesis deals with the current topic of the legal framework for the protection of biometric data in the context of labour relations. With the development of information technology, interest in the use of biometric data is growing. It is becoming common in the workplace that the biometric data are used, among others, for recording attendance, gaining access either to the workplace itself or to the individual work equipment. Their use is simple and convenient, as employees can use for verification their fingerprints, iris scans, etc. However, biometric data are inherently unchangeable, which is an advantage as well as the Achilles heel of their processing. Therefore, due to their nature, they fall into the category of sensitive personal data and as such enjoy enhanced protection. Development in the field of information technology suggests that biometric data are highly likely to become part of everyday life. Issues of Biometric Data Processing in Employment Abstract The topic of the thesis is the Issues of Biometric Data Processing in Employment. In the context of the adoption of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) and development of modern technologies, it has become an increasingly pressing problem which has to be faced by a growing number of employers, but also the European legislators. The first part of this thesis deals with the concept of biometric data and its definition. Subsequently, this thesis describes individual problems that may occur in the context of biometric data processing. These problems are embedded into the labor-law context. Further, the specific part of this thesis describes particular technologies for processing of biometric identifiers in the workplace and the means how these technologies solve or fail to solve the outlined problems of personal data protection. Data protection in the EU - Biometric data The main aim of this thesis is to deal with the data protection in connection with the biometric data. In the first chapter, the author of this work deals with the historical context. The right to privacy even nowadays represents the solid ground of the data protection. Therefore, its de- limitation and subsequent connection with the data privacy is of an upmost importance for a proper understanding of this problematics. The author also deals with the data protection not only in the european context, but also with the disunited legislation in the US, where a legisla- tion in the context of general data protection regulation is absent. The second chapter mainly dealt with stating the general legal principles and their rel- evance to the legal order as well as with the special principles laid down in the regulation, which are mandatory to be upheld. Processing of personal data in the EU within police and judicial cooperation

The thesis deals with the approach level, meaning, purpose and benefit of personal data protection in their processing within police and judicial cooperation in the EU. In the introduction the fundamental issues of personal data protection in the context of the EU and the Czech republic are defined, focusing on terminology and explanations of current issues, particularly the area of biometric data and data retention. Extra attention is also given to the conflict of the right to privacy, and the related right to personal data protection and protection of public interests and safety. After that the thesis deals with a performing of police and judicial cooperation in the EU through specific subjects, in particular Europol and Eurojust. The final part of the thesis focuses on the practical implementation of personal data protection in police and judicial cooperation in the EU, and secondly the importance of personal data protection in police and judicial cooperation, as a deduced basic human right, and the difficulties with which the personal data protection in police and judicial cooperation in the EU are joined. The final part of this thesis consider the main sections in which we can find area for adjustment towards more effective police and judicial cooperation in the EU, with full respect for the right to personal data protection.
