Babybox as a part of our society: Opinions of parents in Pelhřimov region on a postponing of a nearly two-year-old child to a babybox in Pelhřimov Hospital.

This thesis is divided into theoretical and practical part. In the theoretical part, I focused on the basic theory of babyboxes, their history, location, usability and the rationale behind putting unwanted children into babyboxes. Foster care and adoption are also looked at. In the conclusion of the theoretical part I discuss possible preventive measures and some ethical issues related to this topic. For the practical part I have used qualitative research. I asked questions of five pre-selected interviewees from the Pelhřimov region concerning their opinion on babyboxes and babyboxes located in Pelhřimov Hospital. I held a semi-structured interview with Mr. Ludwig Hess. He is the founder of babyboxes in the Czech Republic. He provided an opinion of one that was used on a boy of nearly two years of age at Pelhřimov Hospital. The aim of this thesis is to find out the opinions of selected interviewees about babyboxes and the motivation behind their use on a two-year-old child. I compare the obtained data with my opinion and with the opinion of Mr. Ludwig Hess.

Determination of Parenthood (Abstract) The determination of parenthood is undoubtedly a very topical issue. There are significant changes which are consequences of modern society approach to the family life as well as of massive progress in the field of medical science and genetics. The development in these areas has brought new concepts such as baby-boxes, assisted reproduction and surrogacy. Now it is up to the legislation to provide rules within the legal framework for these new institutions to steady parental relationships and to secure their protection as well. The aim of this thesis is to familiarize the reader with Czech legal regulation of determination of parenthood by means of its description and analysis. Another aim of the work is to compare this legal regulation with regulation in other countries, in particular in Germany and to find similarities and differences between them. Finally the thesis highlights new institutions within determination of parenthood. This thesis consists of nine chapters which deal with particular parts of its subject-matter. Reflection of the right to know one's own origin in the Czech legal order (critical study)

Abstract, Keywords The thesis concerns itself with the analysis of Czech legislation currently in effect with respect to the right to know one's origin. Discussed are the contents of this right, the legislation's addressees, Article 7 of the Convention on the Rights of the Child including the reservations to it made by the Czech Republic. The affected Czech regulations and their reforms are also talked about. Attention is also given to the issue of determining one's parentage. The bulk of the thesis is made up of analyzing the issues of assisted reproduction, surrogacy, adoption, anonymized and confidential childbirths, and baby boxes in regard to protecting the right to know one's origin. The thesis aims to critically evaluate current legislation, point out its shortcomings and suggest possible future development as the right to know one's origin isn't currently being given enough attention. Some of the aforementioned institutes aren't set out in law at all, others give preference to the anonymity of the child's biological parents. Adoption has recently seen some positive development with the recodification of the civil law, however even this is an area that leaves a lot to be desired as there still are certain faults and deficiencies of the legislation. This rigorous thesis deals with the issue of determining parenthood in connection with the child's right to know their origin. The basic question addressed by the present work is whether the old Roman principle of mater semper cert est, pater semper incertus es is still valid at present whether the child is guaranteed the right to know his / her origin. The main idea of the whole work is that the child should always be guaranteed the opportunity to learn about his / her background. The first chapter of this paper presents a brief introduction to Roman law. On the principles and foundations of Roman law stands the continental system of law, which is still based on its principles by the legislator. One of the basic postulates of Roman law is the principle of mater semper in iure certa est, the meaning of which is defined in this chapter. The second chapter deals with the issue of children's rights, especially about the child's right to know their origin. The third chapter already provides a detailed analysis of the current legal regulation of parental determination. Anonymous childbirth, concealing the birth of a child and placing a child in the baby-box under Czech law and under the law of selected European countries

This thesis is concerned with the legislature of the Czech Republic, Bundesrepublik Deutschland and the Republic of France, as regards the anonymous abandonment of children in babyboxes, anonymous births and births with the identity of the mo- ther classified. It presents a complex overview of the legal framework in which the above mentioned institutions are functioning, from the point of view of the current legislation and factual state of affairs, set in the background of historical evolution of the individual institutes in individual states. The first chapter of the thesis de- als with the terminology, which in these questions is often somewhat confused and confusing, due to laymen influences and translations between languages. The se- cond chapter presents the current legal framework of the individual states, together with the umbrella framework of the international Agreements which are binding to all three of the countries. The third chapter deals with babyboxes, describing their functioning in Germany and in the Czech Republic. (Abstract) The diploma thesis deals with the reflection of the right to know one's own origin in the Czech legal order. Knowledge of one's own origin and the right to know one's own origin constitute not only a legal but also a moral and ethical question. The right to know one's own origin (i.e. the right to know one's parents, one's biological family and one's ancestors) is one of the subjective human rights, which belongs to every natural person. This right is more or less reflected in majority of institutes of family law. The thesis analyses the most important of them and indicates how the right to know one's own origin is reflected in these institutes or it is not, although it should be. The work seeks to highlight possible shortcomings of the legislation and tries to propose possible solutions de lege ferenda. There are also stated (for the purposes of comparison) some examples of foreign legislation in cases of some legal institutes. The diploma thesis is based on the legislation effective on the 26th March 2016. It is composed of an introduction, five chapters and a conclusion. The diploma thesis related to problematic of babyboxes and unknown identity of children becouse of why baby hatches are critised. I provide a comprehensive view of babyboxes and their critised and pozitive aspects. The diploma thesis widely deals with unknown identity of children, question of unknown origin and alternative posibilities before abandonment of children. The diploma thesis included knowledge from professionally literature as well as expiriences of professionals from this sphere and pepople who grew up with unknown of their origin, whose expiriences are used in empiric research.
