Tématem této práce je České atomové právo. Atomové právo je tvořeno soustavou právních norem, které regulují činnosti právnických a fyzických osob související s mírovým využíváním atomové energie a ionizujícího záření. Atomové právo je velmi úzce spojeno s přírodovědnými vědními obory, a proto je pro jeho pochopení důležitá alespoň základní věcná znalost této materie. Stručný souhrn nejdůležitějších vědně-historických milníků uvádím v první kapitole této práce. Následují kapitoly věnované historickému vývoji právní úpravy atomového práva a současné právní úpravě atomového práva. Vývoj atomového práva je nahlížen jak z hlediska mezinárodního a evropského tak národního. Českou právní úpravu atomového práva porovnávám s právní úpravou finskou a zamýšlím se nad jejich odlišnostmi a možnostmi, jak by jedna mohla obohatit druhou. U obou úprav porovnávám kromě formální stránky také nástroje ochrany životního prostředí a zásady, které jsou pro ně stěžejní. Vzhledem k možnému zneužití jaderných materiálů k válečným účelům a rovněž s ohledem na potenciální přeshraniční dopady případné jaderné havárie se právní regulací mírového využívání jaderné energie a ionizujícího záření zabývají mnohé mezinárodní organizace, kterým v této práci pro jejich důležitost a autoritu věnuji samostatnou kapitolu. This thesis goes into the czech nuclear law, i.e. the set of legal norms adjusting the terms of use of ionizing radiation and nuclear energy in order to ensure the protection of citizens, workers, property and environment against ill-effects of irradiation. The thesis has two main objectives. The first one is to provide a systematic insight into the corresponding existing czech legislation and its structure. To that end, the object and the subject matter of the nuclear law including the legal and real substance of its basic terms are analyzed. Furthermore, the text concerns itself with the international and european enactment, i.e. international treaties effective in the Czech Republic, organizations, in which the Czech Republic participates, Euratom and its secondary law. The role, recent importance and also original intent of organizations and treaties are emphasized. It is followed by the analysis of the existing municipal law of the Czech Republic, which is mainly inherent in the nuclear act and subsequent implementing legislation. The principles of nuclear law, framework of administration and competence of state agencies or other public institutions, character of activities within the use of ionizing radiation and nuclear energy and liability for nuclear damage are discussed. 89 Abstract The topic of the thesis concerns Czech nuclear law. Nuclear law can be defined as a set of special legal norms adjusting the terms of the nuclear energy and ionizing radiation usage, protection of population and environment against ionizing radiation, radiation accidents solving and treatment of radioactive waste. As such, nuclear law fully adjust the behaviour of all the natural and legal persons who are concerned with activities connected to the nuclear materials, ionizing radiation and natural resources of ionizing radiation. The field of nuclear law is closely connected to the branches of science dealing with the nuclear energy and ionizing radiation usage; therefore, the factual issues of which at least the fundamental knowledge is necessary for the understanding of nuclear law are given space at the beginning of the thesis. In its provisions, Czech nuclear law adjustment also reflect a number of international treaties and European Union regulations. On account of this, the next part of the thesis deals briefly with the international and European nuclear law adjustment. Important international organizations of the field are mentioned as well. The topic of this diploma thesis is Czech Nuclear Law. The nuclear law is a set of legal norms concerned with the ways and conditions of usage of nuclear energy and ionising radiation, the systems used to protect people and the environment against the damaging effects of ionising radiation, protocols to be followed in the case of accidents, radioactive waste disposal as well as the role of the state administration in supervising usage of nuclear energy and ionising radiation. A short historical review of the usage of nuclear energy and ionising radiation is followed by 2 chapters dedicated to international and EU nuclear law. The aims and content of international and EU collaboration concerning non-military usage of nuclear energy and ionising radiation are defined in these chapters. The other chapters of this thesis are concerned with Czech Nuclear Law. The constitutional foundation of this Law is described as well as nuclear law as a legal subject and the rules forming the base of Czech Nuclear Law. The following section deals with the power characteristics of the individual state authorities in the field of non-military usage of nuclear energy. European and Czech Atomic Law in the Context of Energetic Law and Enviornmental Law (Rennaissance or Declaine) Abstract This dissertation thesis deals with recent developments in atomic law in the Czech Republic, the European Union and in international field. In the Czech Republic, the new Act No. 263/2016 Coll., The Atomic Act, which became a public codex of atomic law, is a legislation that encompasses nuclear safety, radiation protection, radioactive waste management, shipments of nuclear materials and other radioactive sources, security of nuclear materials and nuclear facilities, radiation emergency management, radiation monitoring and non- proliferation of nuclear weapons. Atomic Act replaced the old Act No. 18/1997 Coll. in which only civil liability for nuclear damage remained in force. At European Union level, a serious development can be observed lately, when new directives have been adopted to regulate radioactive waste management, nuclear safety and radiation protection. Recently, the Convention on Supplementary Compensation for Nuclear Damage and the Annex to the Convention on the Physical Protection of Nuclear Material has entered into force internationally. The topic of this thesis is Czech nuclear law. The purpose of the nuclear law is to regulate the conditions of use of nuclear energy and ionizing radiation in order to ensure protection of people and environment from the adverse effects of ionizing radiation. Because of highly technical nature of nuclear law, the first chapter is devoted to possibilities of use of ionizing radiation, and to outline few of relevant technical terms. The second chapter of this thesis deals with international cooperation in the area of use of nuclear energy and ionizing radiation. The third and fourth chapters are devoted to Czech nuclear law with main focus on environmental aspects. While the third chapter defines the principles and tools of environmental protection in the field of nuclear law and introduces the structure of legal norms in this area, the fourth chapter analyzes the regulation of specific activities related to the use of ionizing radiation. Included are chapters concerning construction of nuclear facilities, transport of radioactive substances, decommissioning of nuclear facilities and radioactive waste management. IN ENGLISH Atomic Law deals with the modern phenomenon of atomic energy and is constantly evolving. This thesis deals with the Czech atomic law. Given the seriousness of the issues in nuclear safety and radiation treatment is Czech law very consistent with the international and European level, as this work takes into account and includes. Due to a number of technical terms , which are necessary to work with, some of the terms are defined in the introduction of this thesis. These are the most common and very basic concepts, such as: "nuclear energy", "ionizing and non-ionizing - radiation"and also "atomic law". The thesis also covers some aspects of atomic energy in terms of the potential benefits and risks that come with its use entails. Furthermore, it pays attention to the legislation itself. Firstly from the perspective of international law and European Union law, which have a major influence on national legislation .
