Suicidium in Penitentiary Practice

This rigorous work deals with important phenomenon which is known by humankind from time out of mind. It is the phenomenon of suicide, intensified in this case by the fact that it happens behind bars among convicted people who are imprisoned or held in custody. These people find themselves in completely different living conditions than they were used to. Hardly anybody can put up with it completely and that is the reason why frustration occurs which leads to aggression, apathy and others. In critical situations it can lead to self-harming, attempted suicide or even successful suicide. The aim of this rigorous work is thus explanation of causes of suicidal acting of accused and imprisoned people. The work deals with complex view of suicide rate among Czech convicts in the Czech prison system. It is focused on basic terms of suicide, its solutions, theory of aggression and own issues of suicide in penitentiary practice. Basic fundaments of this rigorous work are epistemological solutions arranged as follows: terminological, philosophical, religious, historical and psychological. It continues in theory of aggression finished by automutilation. Criminal law practice of the district prosecutor in Humpolec 1949 - 1960

After a short reference to the historical evolution of the profession, the thesis focuses on the examination, description and evaluation of selected activities of the rather negative character of the district public prosecutor of the District Public Prosecutor's office in Humpolec, which served in compliance with the administrative division only from 1949 to 1960. It was a rural district with a prevalence of farming and the activity of the district public prosecutor's office thus concentrated mainly in this field. The author focuses on the practical steps of the public prosecutor in criminal proceedings following opinions of the contemporary legal theory, collectivization of agricultural production enforced by the state and persecution of particular farmers declared wealthy men or kulaks. The prosecution of former local textile industrialists and the suppression of any disagreement with the promoted communist policy were also ascertained and documented.
Right to a Defense of Socially Disadvantaged Groups in the Criminal Proceedings

The Right to Counsel is one of a fundamental principle of criminal proceedings. This right is enshrined and governed in § 2, paragraph 13, § 33 and following of Act No. 141/1961 Coll. On Criminal Proceeding (Criminal Procedure). The Right to Counsel is guaranteed, in addition to the Constitutional laws, by the Criminal Procedure Code and the Charter of fundamental rights and freedoms in Article 40, paragraph 3 and also by International Conventions such as the European Convention on Human Rights and Fundamental Freedoms. The target of my Thesis is to clarify the issue of availability of the Right to free Counsel or Counsel for reduced fee for socially disadvantaged groups in criminal proceeding. For the purposes of my Thesis, young, unemployed, handicapped people and people serving in Prison in České Budějovice, are considered to be socially disadvantaged. The Thesis surveys the availability of the rights to counsel for disadvantaged groups in criminal proceedings in the light of valid and effective legislation of the Czech Republic.
