This Bachelor's thesis follows up the conditions of participation in procurement procedure for public construction work contracts. The first part characterizes the procedure in the public procurement regime. The particular conditions of participation are described in theory. The second part describes the influence of the conditions of participation on the course of the procurement procedure and the selection of a supplier using practical examples.

This Diploma thesis follows up the award of public contracts using the Design-Build method. The first part focuses on the description of individual procurement methods and their advantages and disadvantages. In addition, the basic types of FIDIC terms and connditions are compared here. The second part describes and evaluates the terms of reference for specific projects commissioned by Design-Build in the Czech Republic. There is also a questionnaire survey that examines the viewpoints, knowledge and experience of contracting authorities with this method.

Three issues of consideration of consumer contract penalty clauses in judgments rendered between 2020 and 2022 Abstract This diploma thesis deals with the issue of penalty clauses in consumer contracts. The goal of this diploma thesis was to determine, based on the analysis of the decisions of court rendered between 2020 and 2022, whether there is a differing legal assessment in cases with similar factual circumstances (penalty clauses) in the judicial practice of courts, and if so, for what reasons. The diploma thesis reveals that in some aspects, the legal assessment by courts in factually similar cases is entirely different. Based on the analysis conducted, three main problems arising in the consideration of penalty clauses in consumer contracts are formulated. Namely the issue of assessing the adequacy of the amount of the contractual penalty and the related discretionary power of a court to reduce an excessive contractual penalty, whether the penalty clause is formulated in plain and intelligible language, and the (im)possibility of including penalty clauses in the terms and conditions or other documents different from the main consumer contract. Selected E-shops and their Websites

The diploma thesis deals with e-shops and their websites. The aim of this thesis is to evaluate the selected e-shops and their websites, activities of supervisory authorities in this area and creating suggestions for an improvement. The theoretical part explains basic terms connected to e-shops, history, legislation and supervisory authorities related to this area. In the practical part is conducted controlled in-depth interview with the employee of the Czech Trade Inspection. Moreover a questionnaire survey was carried out in order to examine the consumer's experiences with e-shops and their legal awareness. The thesis also contains evaluation of the selected e-shops and their websites and case study containing purchase from one selected e-shop. Based on the obtained information are suggested recommendation for the improvement.

Travel agreement

A primary aim of this thesis is to analyse travel agreements of tour operators and travel agencies, in respect of their general terms and also the forms themselves. Besides this main purpose there are two additional ones - to research how the customers are successful in clearing their complaints about services provided to them (in case of the justified complaints) and to find out how the customers pay attention to control their personal data contained in the travel agreements and also how carefully they read general terms and conditions. All the mentioned aims have been achieved. The thesis includes two working hypotheses that were disproved after having got the respondents'answers.
