Foster care in private and public law

FOSTER CARE IN PUBLIC AND IN PRIVATE LAW Abstract The diploma paper deals with the present legal regulations of foster care in private law as well as in public law. The institute of foster care is placed on the frontier of public and private law and the purpose of my diploma paper is to assess, after a complete analysis, which of these two law branches is the foster care closer to. The diploma paper is divided into nine chapters. The first chapter is dedicated to the institute of foster care in general. This chapter has to introduce the reader into the problems and to acquaint him with the basic way-outs. The second chapter defines the notion of foster care and its purpose. Also the historical way-outs are described there. We can see the progression of this institute, as we understand it these days, since 19th century. The essential modification came during the period of communism and the reinsertion of the institute of foster care came at the end of 90's in 20th century. The third chapter is about the present legal regulations of foster care in the legal order of Czech Republic. The sources of legal regulations of foster care, including international sources that govern family law, are characterized there. The aim of the thesis was to have informations about a contemporary system of foster care of children, who can't live in their biological families, and find defects of the contemporary and a upcoming system. The theoretical part of the thesis was focused on a biological and foster families, the history of the institutional care and it's also about all the kinds of the foster care. The thesis gave a list of child care options, but also a historical evolution of the care and the failings of the contemporary system. There are a lot of the failings, very important is a financial deficiency, an inflexibility of the system, no good care of a biological family and a deficiency of foster parents.
A journey of a child from own family to a foster family - Substitute family care in the Czech republic

The diploma thesis "A journey of a child from own family to a foster family - Substitute family care in the Czech republic" deals with the problematics of substitute family care focusing on foster family care. Institutional education is being taken into account as well, since it represents one of the possibilities of a child's placement out of own family. Because it is a priority and for the good of a child to grow up in a family environment, institutional education should be used only as the last possible solution. The Czech republic has been often criticised for having too high amount of children growing up in institutions and for infringing the rights arising from the Convention on the Rights of the Child. In this context foster family care and possible establishment of professional foster family care has currently been discussed in the Czech republic. Even the nowaday's system of foster family care is not spared from criticism. The solution for this system of care for children without family background inheres in establishment of professional foster family care which allows children, who cannot grow up in their bilogical families and who are not (for legal or actual reasons) suitable for adoption, to grow up in family environment. Long term foster-care and the temporary one - psychological aspects of the foster-parent view and child's view.

This thesis primarily deals with foster care. The readers are acquainted with the basic informations from the topic. Further on it deals with the issue of creating connections with foster parents. It points out differences and permanency of the realionship between the long term foster care and the temporary foster care. It outlines the specifics of psychological aspects in both forms of foster care on the side of the child and the foster parent himself. In the second part the qualitative proposal of research is submitted which is focused on children's experience with the foster care. It is trying to point out subjective view of children in their positive and negative form, due to the foster care, emotional anchoring in foster family and last but not least the children's view of transitions between families and problems connected to it. One of the outcomes of this research is to create hypotheses which will be used as a support for next research projects.
