Impact assessment of Act No. 254/2019 Coll., On Experts, Expert Offices and Expert Institutes

The final thesis deals with the issuance of Act No. 254/2020 Coll., On experts, expert offices and expert institutes. The aim is to analyze, describe and evaluate the impact of the law change on expert activities. The analysis took the form of a questionnaire survey addressing 1,002 experts. The evaluation of the results is processed using graphs, tables and free citations of experts. The thesis deals with the characteristics of individual provisions of the law, their negative effects and benefits. The output of the work is an analysis of the current situation. In the end, recommendations and proposals for measures are formulated.
Risk Analyse of the Expertising in the Czech Republic

This diploma thesis deals with risk mapping and investigation in the expert activity. To obtain further information, the questionnaire survey will be addressed to the experts from the Czech Republic as a supportive material of the diploma thesis. The part of the thesis will be focused on analysis and comparison of expert activity in neighbouring countries of the Czech Republic. The identified risks will evaluated based on the analysis of expert activity current state. The outcome of the thesis will be assessment of the situation in the Czech Republic and suggestions of measures leading to elimination of the risks as well as to reduction the occurrence probability or mitigating the impact of risks realization.
INSTITUTIONAL ASPECTS OF EXPERT ACTIVITY

The thesis analyzes an expert in social (institutional) relations that constitute the organizational and institutional background of Forensic Expertise as part of forensic engineering. The work explains the terminology and definitions used, with the greatest attention is paid to the analysis of the conditions for the exercise of expert activities from different perspectives (in particular legal and economic). Is discussed in detail in particular the status of expert institutes, and in all contexts: both in terms of expertise and its guarantee, as well as in terms of responsibility processors appraisal institute. Further describes the work of existing associations and experts estimated their future development. An important part of the work is a comparison of the conditions for the exercise of expert activities (advantages and disadvantages) in selected European countries: Slovak Republic, England and Austria. Based on the findings in the final section are designed and justified by changes in the conditions and rules for the performance of expert activities and other related aspects.
Comparative analysis of the use of methodologies for properties evaluation in Germany for expert practice in the Czech Republic

The subject of the dissertation is the analysis of conditions for the work of real estate appraisers in the Federal Republic of Germany in comparison with the conditions in the Czech Republic with the aim of finding suitable practices that could be used for the work of experts in the Czech Republic. The thesis also includes proposals for suitable measures that can contribute to the development of expert activities in the Czech Republic, focusing on solving problems related to the determination of the exchange value of immovable property. This analysis includes the analysis of real estate types that are subject to assessment in the given area, approaches to solving valuation problems, methods that are used in valuing immovable assets, entities that are authorized to submit expert opinions, as well as content requirements of expert opinions.

1 Administrative offenses in the field of expert activity Abstrakt v anglickém jazyce (summary) The subject of the diploma thesis is administrative offenses in the field of expert activity. Its main goal is to compare previous and subsequent legislation of expert activity and to define the issue of expert activity. In 2021, the new Act No. 254/2019 Coll., entered into force, which established new obligations for experts and increased sanctions for non-fulfillment. Administrative offenses in the field of expert activity are the result of a breach of duty by an expert, an expert office, or an expert institute. Therefore, this thesis first deals with the analysis of the basic concepts of expert activity and then analyzes the individual duties of an expert in the performance of expert activity. It also mentions the expert's responsibility for performing expert activity. The main output of expert activity is an expert opinion. Thesis describes the necessary requisites of an expert opinion and illustrates the procedure of the expert in processing. In the following part, the thesis deals with the definition of administrative offenses of experts. This paper discusses the consequences of the amendment to the Expropriation Act for expert activity and real estate evaluation. The amendment (Act No. 405/2012 Coll.) becomes effective on 1 February 2013 and brings several major changes. This paper analyzes the reasons for the changes and try to predict the consequences. Ralated issues such as changes of the Act No. 416/2009 Coll. are also discussed.
