Europeanization of substantive criminal law

Europeanization of substantive criminal law Petra Meinlová This master thesis is focused on the development of police and judicial cooperation in criminal matters in the European Union and the Europeanization of particular crimes. The thesis is composed of four chapters. The introductory chapter defines basic terminology, the European Union with its powers, the European law and the main legal instruments with the effect on criminal law, and finally the part investigating the idea of Europeanization of criminal law. Chapter two focuses on the definitions of police and judicial cooperation in criminal matters. The cooperation in criminal matters is very problematic in relation to the state sovereignty, second part of the chapter outlines the main features of this relation. Chapter three describes the evolutionary process through which the European Union has acquired the competence over criminal law affairs. The cooperation in criminal matters is relatively new field of the European integration. The original purpose of the European integration was the economic cooperation with the target of creation the common market, the founding Treaties of European Community did not refer to the criminal law. Czech non-governmental organisations and EU climate change policy

The thesis aims to analyse the relations of non-governmental organisations towards the European integration process, which creates an additional platform for their interest representation. This case study focuses on how Czech non-profit organisations, which are dealing in long term with the topic of climate change, try to use the instruments and channels available at the EU level to promote their idea of the 2030 Climate and Energy Framework targets and how the EU climate action policy translates to their understanding of the topic. The thesis is based on the Europeanization theory that assumes that non-state actors are adjusting their behaviour to the existence of another platform of decision making and interest representation. I, therefore, assume, that the selected sample of Czech ecological NGOs tries to actively use the opportunity to participate in the EU decision making - especially because a climate policy is decided mostly at the EU level and therefore the outcomes, such as the 2030 Framework, present another tool to achieve change in the climate policy of the Czech Republic. The capacity of the European Union to form a common foreign policy: The approach towards Russia during the crisis in Ukraine

The thesis deals with the issues of framing and europeanization of the foreign policy of the European Union in the context of an actorness of the EU. These two theoretical concepts are applied on the case of an approach of the Czech Republic and European Union towards Russian Federation during the crisis in Ukraine. The aim of this thesis is to find out if the European Union is capabble of affecting the behaviour of a member state in order to create unified and operational foreign policy. The first chapter deals with teoretical definition of the two concepts and detailed description of the stances of Czech Republic and European Union follows in the second one. On the basis of these chapters the assessment is conducted. The last part firstly concludes if any attempt of influecing is present and secondly the success rate of the attempt is evaluated.
Performance of the mandate of a Social Democratic Party Member of the European Parliament

The Social Democratic MEP mandate performance has certain specific features which distinguish it from mandates of members of other EP fractions. The theoretical part of this thesis focuses on the historical context of European Social Democracy and challenges which it must currently face (euroscepticism, consequences of economic crisis etc.). Furthermore, it considers the role of the Party of European Socialists the whole process. The practical part of this thesis consists of guided interviews with EP Members for ČSSD and SMER - sociálna democracia. The aim of this thesis is to assess the degree of European Social Democracy's Europeanization and differences in national and European aspects of the character of Social Democratic MEP mandate.
National Coordination of Police Cooperation in the European Union - Case Study of the Czech Republic

Police cooperation is an important part of EU's internal security, but its pursuance differs in each member state. This master thesis focuses on the coordination of police cooperation from the Czech Republic's point of view. The objective is to interpret the coordination mechanism in the Czech Republic and to analyse its level of centralization and the method of management. For this purpose, theories of liberal intergovernmental approach and institutionalism are engaged. The partial objective is to examine the influence of Europeanization on the coordination mechanism. Analysis is carried out on a systemic level, connecting the national and European coordination levels. The coordination mechanism of European police cooperation in the Czech Republic proved to be quite centralized with some decentralized elements and hierarchical management structure. The Europeanization affects the police cooperation in all its dimensions, with downloading, uploading and crossloading.
France's asylum policy in relation to the European Union

This diploma thesis deals with the topic of the French and EU asylum policies and their reciprocal influence. The main goal of this thesis consists in demonstrating (if applicable) France's success in enforcing its legislation at the European level, or if it is rather the opposite phenomenon that prevails: the necessity of the implementation of asylum rules (that have been approved in the EU) to the French regulations. The whole thesis is grounded on the concept of Europeanization which determines a theoretical framework that serves as a basis for the empirical part, consisting of an analysis of the development of French and common European asylum legislation first. The crucial part of this thesis is the fourth chapter where the interconnection between the theoretical and empirical part takes place as well as the discovery of the link between the French and European asylum legislation and drawing of consequences that respond to initial propositions.
Great Britain's Attitude towards the political integration in Europe

Britain's attitude towards the European integration has been an uneasy one since its' inception and it thus represents one of the spheres of British politics that has attracted the most attention and that has been one of the most divisive issues of the domestic politics. The British attitude has however responded to the dynamical development of the political integration in Europe. The aim of the thesis is to assess Britain's attitude towards the political integration in Europe and to prove that, despite its dynamical development, the elements of Euroscepticism prevail over the elements of Europeanization. With respect to the aim, the thesis is divided into three chapters. The first one explains the political integration and charts its development and defines the modern concept of Euroscepticism and Europeanization. The second chapter deals with Britain's attitude towards the European integration, its historical background and its development immediately after the Second World War. Substantial part of the chapter is devoted to the analysis of the British attitude towards the milestones of the political integration. The final chapter looks at the stance of the governments of Tony Blair and the current Conservative-led coalition on the political integration and compares them so as to study its development.
Spanish immigration and asylum policy within the EU

The thesis analyses the evolution of the common European immigration and asylum policy and its similarities or dissimilarities in comparison with the Spanish national immigration and asylum policy. This comparison has been made by using the theoretical base of Europeanization. This concept means bringing the European dimension down to the level of national states. I have come to the conclusion that the EU has an influence mainly on the external part of immigration policy which means above all the protection of the borders of Schengen area. On the other hand, there are areas such as granting permanent residence to the immigrants varies significantly in the EU member states. The process of europeanization does not have a clear and unified influence on domestic immigration and asylum and other domestic policies.

From 1971 UK has committed herself to the new brand name of Europeanism. Since that time Britain is continuously forced to adjust itself to the EEC regulations. The questions brought up in this thesis are about an outcome from the EU membership as well as reflection on Britain's regional policies. The work is streamed towards better understanding of main roles and activities that Britain was, is and will consign to the European Union. Moreover, there are several issues which bringing up a point of having some disadvantages from EU member. But with a time people could be concerned of more benefits that EU membership brought as an effective economic strategy is proved.
Asylum policy of the Slovac Republik

The main objective of the thesis is to describe the process of europeanization of asylum policy in the Slovac Republic conditions. Considering the changes resulting from the European integration and applying the theoretical backround of the notion "europeanization", the thesis confronts the situation before and after joining the European union. The system comparation reflects also statistical figures and records the cardinal alterations in the legislative area. A space is provided also to the characteristics of the relevant legislative acts and the aspects encouraging the europeanization in Slovakia.
