The position of the consumer in the field of insurance distribution in the digital age: Valid regulation of the Czech Republic in the light of the basic rules of capital markets Abstract This work deals with the position of the consumer in the field of insurance distribution in the digital age. The main research question is the position of the consumer in insurance distribution. Specifically, the work describes what influences the consumer's position and whether this position is adequate for insurance distribution in the digital world. The pandemic did not initiate the transformation into the digital environment, but only accelerated it. Individual insurance companies have been trying to sell through digital channels even before the pandemic. However, this was not always successful. In the past, these shortcomings were naturally associated with the traditional "face-to-face" sales process. As the largest shortcomings in the past were associated with investment life insurance, this work also attempts to answer the secondary question of how the consumer fares compared to the regulation of business in capital markets. 1 Consumer protection in insurance sector Abstract This thesis deals with the issue of protection of consumers on the insurance market, who are interested in taking out non-life insurance. The level of protection of these customers is being analysed in the timeframe up until the conclusion of the insurance contract, i.e. the thesis deals with obligations of entities subject to distribution law during the process of negotiating with the customer for the purpose of conclusion of insurance, including the obligations set for insurance proposals and carrying out other preparatory work leading to the conclusion of an insurance contract. The above described is closely related to insurance distribution, especially to the obligations of entities subject to distribution law performing this activity. These obligations include requirements for the entities (professional requirements and requirements to ensure the proper exercise of the activity) and at the same time there are legal regulations that regulate the manner of the interaction of the entities with their customers. The thesis primarily focuses on these obligations that are included among the so-called rules of conduct. 4 Legal Aspects of the Creation of the Insurance Product Abstract This dissertation deals with the legal aspects of creation of insurance products, including the rules of their distribution and fulfilment of information duties. The author's aim was to interconnect the public and private law regulation of insurance and its distribution, with a focus on the creation of valid contractual documentation and the proper fulfilment of information duties, for the purpose of a practical understanding. Specific attention is focused on the area of personal insurance, both in the scope of life and non-life insurance sectors. Special emphasis is placed on the explanation of insurance-based investment products, whose nature and fragmented regulation pose the most significant practical and theoretical problems. Apart from the theoretical introduction, the thesis is divided into six parts. The first part is devoted to the essence of individual insurance products and their specifics. The second part deals with the theoretical definitions in the field of insurance law. In the third part, the author analyses the rules of creation of insurance products not only regarding the POG regulation, but also in the light of the Insurance Act and the Solvency II Directive.
