Protection of personal data at selected elementary schools

Kristýna Ježilová Školský management Ochrana osobních údajů ve vybraných základních školách ABSTRACT The bachelor thesis focuses on how personal data protection works in education and how selected primary school principals in the Czech Republic view this issue. The bachelor thesis is divided into two parts. The theoretical part explains and describes with the help of expert sources the important concepts of the so-called GDPR - General Data Protection Regulation, such as personal data, data protection, data fiduciary, data protection principles, subject, controller and processor in the context of the GDPR legislation, introduces us to the history of the GDPR, the legislation and the principles of personal data protection Furthermore, it describes the GDPR in education itself, what obligations schools and educational institutions have and what is the consent to the processing of personal data. In the practical part, a qualitative survey through interviews with school principals was conducted to find out how primary schools in the Czech Republic comply with the legislation on personal data protection. Problematic Aspects of Personal Data Protection

The thesis consists of five chapters, introduction and conclusion. The author of the thesis deals with introduction to the problematics of personal data protection and its relevance in the contemporary world in the introduction of the diploma thesis as well as with demarcation of the aims of the work. In the first chapter, the basic sources of legislation in the area of personal data protection are demarcated, both in Czech and in European and international level. In the second chapter, the attention is paid to the basics of the legislation in the area of personal data protection, whereas the author deals with demarcation of basic concepts, in the second subchapter she gives an overview of basic principles of personal data processing and in the third subchapter she summarizes legal titles for personal data processing. The institute of Data Protection Officer within the meaning of General Regulation is analysed in the third chapter. The first subchapter deals with demarcation of cases where the processor is obliged to designate the Data Protection Officer. Personal information protection in high school conditions of the Karlovy Vary region

The final bachelor thesis deals with the problematics of protection personal information protection at highschools in the Carlsbad region. The thesis involves theoretical definition of the problematics in context of the new European legislation (GDPR) firstly in general and then in highschool enviroment. The next part of the thesis is research, which involves three domains - establishing function of data protection officer, the way in which schools deal with consent to the processing of personal data in processing which can not be resolved on basis of other reason, for example sharing of photographs and video recordings of students in school presentation, publishing of pupils projects, passing of personal information to other subjects (for example for purposes of competitions) and the relationship of the leadership of school to the problematics of protection of personal information in school The aim of this thesis is to define legal framework of protection of personal information a find out in which way this problematics is resolved at an individual highschool in the Carlsbad region. The position of the data protection officer in the light of labour law Abstract The data protection officer is a specialist in law and practices in the area of data protection. His task is to help to controller and processor to fulfil their obligations associated with data processing. He can perform his function as an employee of a controller or a processor or on the basis of a service contract. His status has certain specifications that the character of some labour law provisions doesn't count with. Although uncertainty about the possibility to give him a dismissal or ask him for damages does not cause problems due to only recent changes of legal regulation yet, disputes that may arise in the future will be expected not only before the Czech courts. The main problem of the issue is, whether the labour law regulation can be extended without further delay to the employed data protection officer in the light of his specific independent position, which is guaranteed him by data protection law. The thesis "Selected issues of the current legal regulation of protection of personal data in the European Union" is focused on describing the development of personal data in the European Union and on current changes in this field of European law. The first chapter is focused on the historical development of the personal data protection on the European continent with the specific aim of looking at the development in the European Union. This chapter describes the progressive development of the right to the protection of personal data which was formed within the right to privacy because of technological developments. The first chapter also talks about personal data protection in primary and secondary legislation which became the foundation for the further development. The second chapter is devoted to the comparison of the former EU regulation of the personal data protection in the directive 95/46/ES with the new regulation in GDPR. The most important changes were chosen for the comparison together with the ones which were often discussed prior to GDPR coming into effect.
