Legal regulation of whistleblowing and the protection of whistleblowers in selected countries: Study 5.332

Informační podklad vychází z pojmu „whistleblowing“, který je využíván v odborné literatuře i Evropskou unii za účelem popisu situace, kdy jednotlivec poskytne nebo zveřejní informaci o tom, že dochází protiprávní či jiné (např. neetické) činnosti. Právní úprava whistleblowingu pak označuje soubor právních norem, které dopadají na takto popsanou situaci – od právní úpravy, která předepisuje způsob oznamování takových informací, až po ochranu oznamovatele (ochrana oznamovatele jako svědka, ochrana v pracovněprávních vztazích) nebo případnou odměnu pro oznamovatele. Informační podklad poskytuje přehled právní úpravy ve vybraných zemích (ČR, Irsko, Maďarsko, Nový Zéland, Slovinsko, Spojené Království, USA, SRN, Rumunsko) a dále přehled vybraných relevantních mezinárodněprávních dokumentů přijatých na půdě OSN a Rady Evropy.

Empirický test parametru Beckerova modelu rozhodování zločince za nejistoty pro pěstitele konopí v ČR

This bachelor thesis empirically tests Becker's assumption of offenders' knowledge of the probability of their apprehension. This assumption is tested by standardised interview with an unrepresentative sample of thirty hemp growers in the Czech Republic. Growers' subjective estimations of the probability of their apprehension are compared with approximation of the real probability of apprehension. The conclusion of the analysis is that the growers do correctly estimate the probability of apprehension. So Becker's assumption is (at the risk) confirmed. The hypotheses that high-cost growers estimate the probability better than low-cost growers and that growers with less than five plants estimate the probability of apprehension worse than growers with more than five plants were not confirmed.
A Victim of a Crime and His/Her Right to a Standard Life in our Present-Day Society

The presented Bachelor?s thesis pays particular attention to the victim of a crime and his/her status in the Czech Republic system of law. The thesis deals with approaches and attitudes of bodies responsible for penal proceedings and other subjects concerned. The thesis goes into details about the value of human life from the victim?s point of view, the assessment of a particular financial damage caused by the victim?s death or permanent health injury in confrontation with the value of human life as stipulated by law, the inner feelings of the victim of a crime (both from the point of view of the perception of the direct act of the crime and the post-traumatic state, as well as the possibility of becoming involved in an ordinary way of life), the changes in family relations resulting from the lingering consequences of the crime and the pathological changes in the victim?s psyche related to the change of his/her state of health. The thesis also contains a coherent view of the procedures of bodies responsible for penal proceedings starting from the primary notice of a commission of a crime up to the legal proceedings and a compensation of the damage caused by the perpetration of the crime.
