Health insurance companies in the system of health insurance

This thesis analyses the health insurance companies in the public health insurance. First chapters consist the theoretical background of health insurance and subsequently the historical development of health insurance in the Czech Republic (Czechoslovakia). The focus of this thesis is laid on the development of health insurance in the last two decades. The work compares the legislation of the General Health Insurance Company of the Czech Republic and the so- called employment insurance companies. Attention is paid to the legislation of the organizational structure of health insurance companies and their economy, particularly the regulation of their funds. Some of the economic indicators of the General Health Insurance Company of the Czech Republic and the Health Insurance Company of the Ministry of Home Affairs for the years 2010 - 2012 are listed for a comparison.

Basic principles and the coordination of old-age and survivor's pensions according to Regulation (EC) No 883/2004 of the Council, on the coordination of social security systems

130 Abstrakt v anglickém jazyce We comprehend the coordination of social security systems as an interconnection of social security systems of Member States therefore the free movement of persons can be carried out. The aim of Coordinating Regulations is to ensure that a migrant does not loose his/her claims on social rights due to his/her enjoyment of free movement. Concerning the large extent of this topic the thesis is focusing only on old-age and survivors' pensions according to valid Regulations (EC) No 883/2004 and No 987/2009 of the European Parliament and of the Council which entered into force on 1 May 2010. The preliminary chapter out of five at total generally presents the nature of the Coordinating Regulations. It clears up their development and aims. It further introduces other sources of coordination law and explains their relations with other sources of EU law and international law. The determination of personal and material scope of Coordinating Regulations is the indispensable part of this chapter as well. Deciding of the Czech Social Security Administration upon benefits from pension insurance

This thesis deals with the application of the law on pension insurance. Thus its subject is not only the legislation itself, but this thesis is much rather devoted to the interpretation of law on pension insurance and to the limits given by the nature of the legislation, to the application practices and to the analysis of decision-making mechanism. Within the framework of this thesis the emphasis is put on the question of evidence. In this context, the work underlines the time frame of facts required to be proven and the requirement for aplication of already void legislation. Special attention is paid to the use of a special decision-making procedure which allows to forgive requiremets for meeting legal conditions in particular cases. In this thesis I formulate arguments in favor of using the methodological pluralism rather than strict clinging to a grammatical method of interpretation, arguments for prefering principle of procedural efficiency to investigative principle in some justifiable cases and for precisely expressed binding legal opinions made by courts as outcomes of judicial review. Welfare of women during pregnancy and maternity

In this thesis I processed the options of support for women during pregnancy and maternity which could be offered by the legislation of the Czech Republic and also the possibilities which were connected with their accession to the European Union. I also mentioned planned law changes which the new government of the Czech Republic wants to get through in their election period of 2013-2017. The thesis is divided into two parts. The first part, "The Social Security of Women During Pregnancy and Maternity According to Czech Legislation" consists of four chapters: 'The Evolution of Social Security', 'The Social Security and Its Systems', 'The Social Security Within the Sickness Insurance' and 'The Social Security of Women Within the National Social Support'. In these individual chapters there are processed historical context of social security law evolution and then individual institutes serving for securing woman during pregnancy and maternity. The institutes consist of benefits in maternity and equalized contribution within the sickness insurance and also of child benefit, maternity grant and parental allowance within the national social support. Legislation of disability and disability pension in the Czech Republic

1 Resume Legislation of disability and disability pension in the Czech Republic The purpose of my thesis is to analyse the Czech legislation of disability pension and its conditions of entitlement, and then to compare them with the situation in selected states in the European Union. I have chosen this particular topic, because a material security of disabled persons is an essential part of legislation in every developed country. This thesis is composed of seven chapters; each of them is divided into several subchapters. The first chapter characterises the pension scheme and its principles. There are explained the basic features of pension insurance, such as personal scope, period of insurance and financing. This chapter also lists benefits paid of pension insurance in the Czech Republic. The second chapter outlines the development of material security of disabled persons during previous centuries. It focuses on responsibility for persons unable to work, which has transferred from church to villages and later to state. Next chapter defines the term invalidity and points out several different looks at the concept of it. This chapter also includes the international definition formed by the World health organization. Welfare of families with children

Welfare of families with children In my thesis I dealt with welfare of families with children, because it is a topic that is relevant to everyday part of human life, and has been since its conception. The aim was to give an overview of the basic institutes of ensuring welfare of these families with respect to the near future. But the focus was not put only at social welfare as such, but I tried to give an overview of the most important institutes as well as other branches of the law, where I find elements of social welfare either in the form of material welfare, or any other form of protection of people with dependent children, as e.g. their advantage over people who do not care of dependent children. The first chapter deals with the security of families who are expecting a child and with the period after his/her birth. Family Safety in this period is mainly based on the legislation sickness, from which was one of my sources when examining this topic. The second chapter describes the circuit of social welfare benefits to which a family, during the period following the birth of a child, is entitled. Porovnanie právnej úpravy zabezpečenia v oblasti tehotenstva a materstva v ČR a SR Diplomová práca rozoberá zabezpečenie v tehotenstve a v materstve v dvoch štátoch a to v ČR a SR a následne ho porovnáva. Cieľom tejto diplomovej práce je analyzovať a porovnať súčasnú právnu úpravu zabezpečenia v tehotenstve a materstve z pohľadu práva sociálneho zabezpečenia a s pohľadu pracovného práva v ČR a SR Práca je členená do piatich kapitol. Prvá kapitola popisuje historický vývoj sociálneho zabezpečenia na území ČR a SR so zameraním na zabezpečenie v tehotenstve a materstve. Druhá kapitola nás uvádza do systému sociálneho zabezpečenia stručne definuje jednotlivé systémy, prvky právnych vzťahov a charakterizuje jednotlivé sociálne udalosti ako tehotenstvo, pôrod, materstvo, nezaopatrenosť dieťaťa. Tretia kapitola rozoberá oblasť nemocenského poistenia postupne v ČR a SR. V prvej časti kapitoly popisuje systém nemocenského poistenia v daných krajinách a následne ho porovnáva. Druhá časť kapitoly je venovaná jednotlivým dávkam nemocenského poistenia a ich vzájomnej komparácií. Selected issues of the third phase of pension reform in the Czech Republic

Ausgewählte Fragen der dritten Phase der Rentenreform in der Tschechische Republik Das Ziel meiner Diplomarbeit ist die Beschreibung, die Analyse und die Auswertung der dritten Phase der Rentenreform mit dem Hinweis an die Probleme, mit dennen auch die letzte Entscheidung der Regierung über die Aufhebung des zweiten Pfeilers des Rentensparens verbunden wurde. Die Arbeit wird systematisch an die 5 Kapitel geteilt. In der ersten Kapitel werden die universale Prinzipen und Möglichkeiten der Konstruktion der Rentensysteme zusammen mit der Aufnahme des tschechischen Rentensystems in dem System der Sozialversicherung detailisiert. Die zweite Kapitel detailisiert die Gültigrechtsausgestaltung des tschechischen Rentensystems.In der dritten Kapiltel wird auf die Probleme verbundene mit der Einführung der Groβrentenreform hingewiesen und auf diese Problematik knüpft die letzte Kapitel an, die genau das nächste Prozess der Aufhebung des zweiten Pfeilers der Rentensparung analysiert. Am Ende meiner Arbeit werden die gewonnene Kentnisse allgemein gemacht und die Überlegung über die Erfolgsamkeit der Einführung einer Fondfinanzierung in das tschechische Rentensystem. Legislation for assessing medical conditions in social security

The aim of this work is primarily to provide a clear and systematic description of various social security benefits granted on the basis of medical conditions assessed by an examining physician for the medical review service in terms of substantive and procedural law. The introductory chapters deal with the legal basis for social security and medical reviews at international and national levels, as well as the historical development of health assessments, which has an impact on the shape of existing legislation. The division of the entire social security system into its three basic subsystems is described in a chapter laced with discussions about individual benefits, which this thesis takes up. They include care allowance, mobility allowance, special aid allowance, and disability pensions. Also analyzed here is the entitlement to the certificate of disability, which is also provided on the basis of an evaluation of the applicant's medical condition by the examining doctor. The second part puts primary emphasis on the medical review service and the person of the examining physician. Legal framework of healthcare and its financing

The issue of legal framework and healthcare affect each of us; we're all elements of health care system. Health care and its financing are discussed more and more intensively. Increasing pressure on economical spending of funds selected for the purposes of the general health insurance. Acceleration of the development of science and technology should improve the responsibility of each of us. I tried to point out some important issues from the perspective of the on-going changes in the health-care legislation. It is also one of the main reasons why I chose the topic "LEGAL FRAMEWORK OF HEALTH CARE AND ITS FINANCING. The aim of thesis is especially to highlight the legal ground and other relevant documents, which provide health care in the Czech Republic, and to carry out their analysis in the light of the on-going legislative changes. In separate chapters then in more details I describe the financing of health care and financial participation of patients, public health insurance schemes and providing of health care. I tried to make a comparative analysis of the legislation on health care and health systems of the European Union members as well. In conclusion, I propose that we must insist on completing the current reform of health care in the light of the domestic and foreign developments.
