Involuntary public auctions of real estate

In this thesis I pay attention to law regulation of involuntary auctions under the Public auctions law No. 26/2000 Coll. Based on statistics, legislative determination and expert opinions I analyze factors which influence the amount and course of involuntary auctions and examine the importance of these auctions for the mortgage market.
The use of arbitration in consumer disputes

The bachelor's thesis deals with the possibility of consumer dispute resolution via arbitration. First, the mechanism of arbitration in the Czech Republic is described, then the way how consumers can be protected in case they conclude an arbitration contract. Finally, it is explained how the arbitration is used in some of the European countries and what approach to consumer protection they apply in this field.
The use of legal form of "limited company" for business in Germany

This thesis is aimed at the description of the development of the European business law, with regard to the blending of two different legal systems under the European integration, and certain modest assessment of the results. It brings at the same time description of two foreign forms of companies with limited liability, private company limited by shares and Gesellschaft mit beschränkter Haftung, comparison and evaluation of these forms for conducting business in German market and subsequent outline of suitable application and use of private company limited by shares, that can be applied not just in Germany, but in the other member states including Czech republic as well.
Consumer protection and e-commerce

The aim of this bachelor's thesis is to provide an overview of the rights of a Czech consumer emerging from business relations between a consumer and a seller. Initially there is a closer identification of a consumer according to the Czech low. Second part of this thesis concentrates on Czech organizations protecting consumers and e-commerce certifications. The third charter focuses on the consumers disputes. There are a lot of possibilities how to solve the disputes, some of them are outlined in this part, for example the alternative disputes resolutions and on-line dispute resolutions. Another objective would be the e-commerce and an evaluation of its positives, negatives and especially possibilities, which it offers. As a practical example there are mentioned the coupon portals which are very popular in Czech republic these days. An interview with a representative of one of the Czech coupon portals was used as a source of relevant information about their running a business. Finally, there is an analysis of two famous Czech coupon portals and their attitude to Czech customers.
Consumer protection within the case law of the Court of Justice of the European Union

The term "average consumer" is relatively new and unknown. The aim of this thesis is to introduce the development of the concept and its usage within the case law of the Court of Justice of the European Union. I deal with definition of basic Czech terms as well as European terms in the first part of the thesis. Then I explain work and tasks of European courts. In the second part of the thesis I outline the most important cases which have changed the view of consumer and his behavior and perception during almost 40 years. This development through the case law has led to the creation of a new special term "average consumer". It is shown how this term is used in the area of consumer protection or protection of competition in the thesis.
Dual citizenship in EU Court of Justice cases

The object of this thesis is citizenship, especially dual citizenship. The thesis is divided into three chapters. The first one deals with an introduction to citizenship. It aims to the ways of acquiring and losing the citizenship in general as well as the Czech citizenship and to the question, whether the Czech Republic allows dual citizenship or not. The second chapter explains the citizenship of the European Union and its developing legal form. The final chapter contains cases of the EU Court of Justice that are related to the dual citizenship. Thanks to the cases we can picture the position of the dual citizens within the member states of the European Union. That is the main aim of the thesis.
The comparative analysis of consumer protection law

The main purpose of this thesis is the comparison of consumer protection legislation in the Czech republic, United States of America and Croatia and the comparison of selected legal questions. After the introduction to the general issues related to consumer protection, namely the basic concepts, the development of consumer protection law in the world and the reasons of protection of consumer, the work deals with legal sources of current czech, american and croatian consumer protection law. Actual comparisons of personally selected legal questions is creating the core of the thesis. We are comparing legal definitions of basic subjects of consumer protection law, warranty and products liability as described in laws of each country.
Consumer Protection in New Czech Civil Codex

As a member of the European Union, the Czech Republc is obliged to implement European directives and regulations, also in consumer protection policy. The revision of European consumer acquis has begun in the same time as the long awaited recodification of Czech civil law -- new Civil Codex. The thesis focuses on how the new Civil Codex reflect the most important recent European regulations and directives. A few were chosen to be analysed more thoroughly -- directive 2011/83/EU, Draft Common Frame of Reference, draft of common European purchase contract, draft of directive 2011/793 and regulation 2011/794. Moreover, it focuses on a few selected issues included in the new Civil Codex, notable from the view of European legislation transposition -- e. g. the definition of consumer, distance and off-premises contracts, unordered supplies and unfair contract terms
The legal policy on genetically modified organisms

This thesis deals with the current legal policy of the European Union on genetically modified organisms in the framework of consumer protection.The European Union created a complex set of strict rules for dealing with genetically modified organisms.The first part outlines the problems of modern biotechnology,the second part describes the development and the current EU policy and judgement analysis of the European Court of Justice related to the GMOs. The aim of the last part is a description of the current position of the Czech Republic to the genetic modification.
Auction sales in legislation of the Czech Republic

My bachelor thesis analyses the Act No. 26/2000 Coll. about the public action sales, escpecially the second part of the Act - voluntary public auctions of movable property. It focuses on the market of artictic works and examines the application of this legislation in the environment of action houses and halls in the Czech Republic.
