Legal protection of exclusive deposit

Topic of this diploma thesis is "The legal protection of the exclusive deposit". Attention in the opening chapters is paid to general issues of mining law. Those general issues include history of mining law, sources of legal regulation and basic concepts. Protection tools of exclusive deposit are also included as a general issue. Those tools are divided in groups as conceptual, administrative and legal and economic tools. The thesis then introduces the most important special protection tools of exclusive deposit used at the various stages of its exploitation. Institute called Exploration area ensures protection of exclusive deposit in stage of searching and exploring. Next special protection tool is Protected deposit area, which is an important instrument of territorial protection of the exclusive deposit. This institute prevents complications with mining caused by construction activities. The following chapter presents the institute of Mining area. Function of Mining area is to protect an exclusive deposit, but it also represents authorization to carry out mining activities. Accidents within environmental protection from the legal point of view

This thesis deals with the major accidents in terms of legal regulation in the area of prevention, control and liquidation of consequences of major accidents. The first part defines the term "accident", and gives examples of the most serious accidents in the world. In the second part the thesis states sources of regulation of serious accidents in the international, European Union law and the Czech law. The focus of the work is in the third part, which defines basic elements of legislation in area of prevention of major accidents caused by chemicals in accordance with Act No. 56/2009 Coll., On the prevention of serious accidents caused by chemicals or chemical products and other related legislation from environmental protection. In the fourth part are summarized legal aspects of the control and disposal of major accidents in the Czech law, by mentioning the responsibilities of operatores of buildings and facilities in the event that disaster can not be averted, or that an accident has already occurred, further indicating the essential elements of the emergency legislation and commissioning of liability relations in issues dealing with the consequences of major accidents.
International Climate Change Law

The thesis International Climate Change Law presents international legislation in the area of climate protection. Specifically, it focuses on the United Nations Framework Convention on Climate Change, the Kyoto Protocol and proposed legal aspects of the new agreement, which is to arise from the 21st yearly session of the Conference of the Parties in Paris. In its introduction the thesis outlines the scientific background of the climate change and political and technical approaches to its solution. Then, it gives an overview of the development of the international law in this area, including its political context. The following chapters analyse key legal documents highlighting their objective, principles, commitments, and tools. The last chapter sums ups and briefly analyses the most important aspects of the proposed legislation.
Legal aspects of hierarchy of waste management focusing on the issues of electrical waste

The diploma thesis concerns with the waste hierarchy in respect to the waste electrical and electronic equipment (WEEE). The subject-matter of this thesis is to analyze the legal regulations set forth in both EU and Czech law. The main acts are Directive 2012/19/EU on waste electrical and electronic equipment and the Waste Act No. 185/2001 Coll. The crucial parts of this thesis are the part 3 and 4 focusing on the legal regulation of persons and entities which shall procure the management of WEEE and on life-cycle of the electrical and electronic equipment.
Legal regulation of the environmental impact assessment

Environmental Impact Assessment is one of internationally recognised tools providing environmental protection. Purpose of the assessment is to identify and comprehensively evaluate environmental impact of a project with participation of the public, professionals and administrative bodies, prior to the realisation of the project. Information gained through this process is then used as a basis for decision making in procedures granting development or other consents. The thesis aims to analyse in particular the Czech environmental impact assessment law with emphasis on its recent amendment and reasons of its implementation.
Legal regulation of protection against pollution from mobile sources

Miroslav Ottomansky Legal regulation of protection against air pollution from mobile sources The goal of this thesis is to map tools used for legal regulations of mobile pollution sources. Thesis focuses on problematic regulation of motor vehicles' pollution in Czech Republic, however it also outlines basic legal adjustements related to other mobile pollution sources. Thesis starts with basic introduction to this problematic followed by overview of international legal regulations and main conceptional tools used for legal regulations in European Union. In the chapter dedicated to the principles of european law in terms of regulation of mobile sources' pollution thesis tries to research how are those regulations already being applied to specific legal norms. One chapter is dedicated to protection of rights for convenient environment and their prosecution. In the next part of the thesis the normative regulations within emission standarts, approval of types, requirements for fuel quality and control of emissions of motor vehicles are examined. Legal regulation of the protection of woodspecies

This diploma thesis deals with legislation concerning the protection of wood plants. The six chapters contained within attempt to provide a cohesive overview of this topic as a whole. Legislation in this field has undergone major changes in the recent past. The core of the thesis is an overview of the current state of legislation as it concerns wood plants growing outside the forest as enshrined in the Act on Nature and Landscape Protection. The first chapter deals with an introductory definition of what constitutes a wood plant growing outside the forest, as well as its functions. The following chapter outlines the relationship between public and private law aspects of wood plant legislation. The issue of ownership and neighbour s rights is focused on in particular. The next chapter lays out the basics of public law legislation in this field. The fourth chapter is the crux of the thesis as it deals with the protection of wood plants growing outside the forest as enshrined in the Act on Nature and Landscape Protection, especially when it comes to the possibility of felling of wood plants. Tato diplomová práce si klade za cíl představení České inspekce životního prostředí jako orgánu státní správy provádějící dozor v oblasti ochrany životního prostředí. Česká inspekce životního prostředí byla založena zákonem č. 282/1991 Sb., o České inspekci životního prostředí a její působnosti v ochraně lesa. Postupně byla její působnost rozšířena i do dalších oblastí ochrany životního prostředí. Česká inspekce životní prostředí plní ve společnosti nezastupitelnou funkci a snahou této práce je specifikovat činnost České inspekce životního prostředí, její právní úpravu, ale také srovnání s jinými inspekčními orgány.
Environmental protection through integrated permitting

The introduction of an IPPC proceedings into Czech law has been executed through implementation of requirements of Directives enacted at the level of European Communities and subsequently at the level of European Union and Czech republic was obliged to implement the content of the Directives by being a member state of those international organizations. During the IPPC proceedings of application for an integrated permit the participants and other subjects who can express their statement on the application a chance to influence the final content of an integrated permit. This influence subsequently might change the conditions of operation of large industrial and agricultural compounds and the emission limits binding for the operator of such compounds. This thesis focuses on an evaluation of possibilities to protect the environment through IPPC during the proceedings of application for an integrated permit, through managing the way of establishing the emission limits within the obligatory conditions of operation and through an influence of preceding proceeding and subsequent proceedings, which are part of allowing the intended activity of the operator.
The legal adjustment of the conditions of the recultivation of the surface mines

Thesis describes the region of Karlovy Vary region and mining history in it. Further described the legislation governing the processes of rehabilitation of controls both at the level of the statutory regulations and the regulations of the secondary. Next to them were discussed and the resolution of the Government which affect the financing of the landscape caused by damage in the time before the privatization of the coal companies. Brown coal mining in the region, Sokolovská pans after World War II, was carried out by opening the large surface mines, and stifle mining underground mines. Mining and quarrying of surface mine means a significant intervention in the entire countryside. Excavation occurs in the mining pit, the material itself bearing raw materials (overburden) is extracted and is stored in the vicinity of the pit. In place of the originally flat landscape appears the pit and near the artificial Hill. Surface mines not just speciality Sokolovská coal basin. Much better known and more are mines on Chomutov region, and in particular the Most region. There was the most devastating effect of such mining on landscape and the environment at all.
