Internal Regulations, Organizational Rules and Instructions of the Employer, their Meaning and Enforceability

The thesis deals with the significance and obligations of organizational rules, conditions of employment, internal regulations and directives as a mandatory and required part of the employment relationship and additional employment contracts, contracts of work and work arrangements. The first theoretical part describes sources of labor law, defines subjects of the employment relationship, internal regulations and there is also described possible enforcement of contions of employment. It deals with a workflow of creation of control acts. In the second part there are explained new conditions of employment of an existing company. There are also analyzed conditions of employment of another company and afterwards both conditions of employment are compared. The following methods are used -- descriptive method, legal interpretation, analytical and comparative method. The aim of this thesis is to give the reader an overview about employer's internal regulations and their usefulness.
Patient's Informed Consent, Medicine Doctors' Responsibility, Patient's Protection

ABSTRACT Patient's Informed Consent, Medicine Doctors' Responsibility, Patient's Protection This diploma thesis analysis the informed consent of patient, which is manifestation of the patient's right to decide about his own health freely. The main aim is to describe what laws is the informed consent based on, what it should contain, in which situations the doctor is allowed to act without the consent and what the consequences of acting without consent, in cases, in which the informed consent is required by law, are. Further problems, which are not adequately treated by the law, are also mentioned, and the obtaining of the informed consent in children and the informed consent in practice were described. It was found out, that registration of complaints should be kept by each medical facility separately in the Czech Republic. Except that, the complaints department is established at each regional office. Czech laws do not impose to register complaints or claims in national unified register. Number of complaints between 2008-2010 were obtained from the Czech Medical Chamber, Control Department of the Ministry of Health, Medical Department of Regional Office and from Prague City Hall. It can be stated, based on the study of all related resources and after comparing of the recquired information with the reality, that even if all regulations are abided, it is impossible for the doctor to inform patient about all risks and possible complications to avoid the complaints completely. The questionnaire survey shows, that the legal awareness of doctors in the issue of informed consent is inadequate and it is important to improve it.
Problematics of misusing company computers by employees

This diploma thesis deals with problems of misusing of company computers by employees. Specifically describes the factors affecting computers misuse, various forms of its misuse and protections against its misuse, the impact on employers and related regulations. The thesis also outlines possible ways how to control employees and penalties for computer misuse. Thesis tries to provide some recommendations for regulation of using of company computers and also an estimation of future development.
Analysis of the graphical user interface of specific websites

The aim of this thesis is to develop a methodology for comparison of the graphical user interface of web sites, its application in a segment of sites and in consequence obtaining feedback on the appropriateness of this methodology. The introductory chapter discusses the importance of web services and outlines the development of the Internet. A selection of the segment describing its specifics follows. The methodology itself is described in the following section and is used on selected websites. In conclusion, this comparison is described and evaluated. The analysis concludes with an assessment of selected methodology.
The Vexation at the workplace

The border between common and vexation matter of person behaviour we are accustomed to is very slight. The topic of my diploma paper "Vexation at the workplace" becomes very actual and constantly the bigger problem in the contemporary modern society. Everyday mentally terror at the workplace, vexation among the colleagues, systematically made malignancies through which the superiors attack their inferiors (or vice-versa) is a problem that belongs serious incoveniences both to its victims and the company. My diploma paper is above all focused on the sophisticated and malicious area of work-vexation that is called the mobbing. Marginally I mention other forms of vexation and the bossing. I made my exploration at the public service environment as the work-vexation is usually put together with it. Primarily I point the legal and moral side of the mobbing and its psychological and social aspects. Secondarily I mark the mobbing as a job-psychological phenomenon, its influence to the company itself and consequences between it and some modern society trends (teamwork, power, burn-out syndrome, internet technologies). Supposing to become the managers we should make effort to eliminate the mobbing. As only the workplace without the vexation brings the satisfaction that can results in higher level of the work productivity, economic profit and the the incapacity of work decreasement. Thereby the mobbing affects the whole life of its victim and also that anyone of us can become the victim it is necessary to solve this problem urgently and constantly.

Diploma thesis defines the elements of legal protection of copyright and intellectual property rights, which plays an important role in nowadays software development. It contains a general evaluation of the legal protection of copyright and its dynamics in the near future, which depends on the situation on the IT market, changes in the structure of customers, including their requirements. Maps the feedback between copyright law and the problems of business processes accompanying technical side of software development and modifications. Maps software links with third party products, development tools and its relationship to copyright issues. It describes distribution models and promotion to promote protection of computer programs.
Intellectual Property and its Protection

My bachelor thesis deals with intellectual property. Work is more focused on issues of trade marks, for what reason are trademarks rise, how are the methods of appreciation trademarks, and how tjey have a significant share in the intellectual property in our country and the world. Then explain function of the Industrial Property Office, which has a very important role in intellectual property. They also described some of the disputes relating to the protection of marks.

Competences and Obligations of Territorial Self-Government Bodies

The thesis is focused on territorial self-government and its competences. The first part of my thesis describes territorial self-government and its position in the system of public administration of the Czech Republic. Here the thesis delimitates competences and duties of bodies and clerks of self-governing territorial units in the way they are stipulated by legal regulations. In the second part of my thesis is given an example and this example is used for a comparison between theory and practice. Great attention is also paid to differences that occur in the Czech Republic between theory and practice. The main objective of the thesis is to evaluate the possibilities of a defence of a citizen in case a clerk or an administration body does not meet their obligations and duties; the thesis also tries to suggest possible solutions to such situations.
Ban on Smoking, its Modification and Development

My Bachelor work is focused on describtion of acts connected with smoking ban. I analyse imperfections in the main legal acts -- No. 379/2005 and No. 262/2005 -- and I propose solutions for their removal. I deal with amendment of act concerning absolut smoking ban in restaurants in the Czech Republic and I describe present situation in those European countries, where this act is already valid. I also analyse public meaning by questionnaire, which was intent on legal knowledge, satisfaction with anti-smoking act and its abidance.
