Sanctioning of Legal Persons

The purpose of this Dissertation Thesis is to comprehensively set forth the issue of sanctioning of legal persons and also to critically evaluate it. The present Thesis is divided into five chapters. Firstly, the basic terms related to sanctioning of legal persons are defined and the institute of criminal liability of legal persons is expounded including evolution of the legislative in task as well as exposition of the legislation in force. The core of this Dissertation Thesis constitutes detailed analysis of sanctioning of legal persons. Attention is payed not only to stipulations on sanctioning of legal persons included primarily in the Czech Act on Criminal Liability of Legal Persons and Proceedings against Them, but above all the attention is drawn to suggestions on legislative changes de lege ferenda in relation to sanctioning of legal persons. The Author suggests incorporation of new sanctions such as pecuniary punishment against registered capital or supervision over legal entities executed by insolvency administrators or for example integration of a new provision covering mitigating and aggravating circumstances related specifically to legal persons. Criminal Liability of Legal Persons in the Czech Republic and in Selected Countries around the World

The purpose of the Rigorosum Thesis named Criminal Liability of Legal Persons in the Czech Republic and in Selected Countries around the World is to comprehensively set forth the issue of the criminal liability of legal persons. The Rigorosum Thesis is divided into five chapters. In the first place the basic terms related to this topic are defined and also the theories of attributing criminal liability to legal persons are set forth. Subsequently the thesis examines the criminal liability of legal persons in the Czech Republic including the evolution of the legislative process and current law in force, the Act n. 418/2011Coll., on Criminal Liability of Legal Entities and Proceedings Against Them. Following chapters are dedicated to the exposition of the foreign legal frameworks, namely legislations in the common law countries and in selected European, Asian and South American countries. The Rigorosum Thesis points out the shortcomings and weaknesses of the legislations concerned and at the same time the author attempts to propose rectifications and improvements. The issue of life imprisonment

ISSUE OF THE LIFE IMPRISONMENT SUMMARY The purpose of this diploma thesis is to analyse the issue of life incarceration and some of the matters, which are related to this kind of punishment. I have decided to choose this topic because I have always been interested in the question of how society should punish the most serious crimes. Moreover, this punishment was introduced into the Czech legal framework not that long time ago, so in my opinion, there is still much space for its improvement. The life incarceration, which is the severest punishment possible within the Czech legal frame-work can be imposed by court only in the cases of the most serious crimes such as aggravated murder, terrorist attack or high treason. It was implemented in 1990 by the Criminal Code Amendment Act, which abolished the death penalty and replaced it with the life sentence. This thesis is divided into seven main chapters. The first part defines the basic terms, also it explains the purpose of punishment and deals with the system of punishments available according to our Criminal Code. LEISURE TIME ACTIVITES OF CHILDREN IN THE SECOND STAGE OF BASIC SCHOOL IN RELATION TO OCCURRENCE OF SOCIOPATHOLOGICAL PHENOMENA (REGION VYSOČINA - MORAVSKÉ BUDĚJOVICE)

The thesis deals with the topic of relations between an offer of spare-time activities and an occurence of socially pathological phenomena in some sampled basic schools in Moravské Budějovice and the surroundíngs. One major aim and two subaims were determinated. It was the major aim to compare some basic schools in Moravské Budějovice and in the close surroundings with regard to spare-time activities and socially pathological phenomena. The first subaim was to elict an extent of spare-time activities offer for lower-secondary-school pupils in the sampled schools. The other subaim was to describe socially pathological phenomena with the lower-secondary-school pupils in the sampled schools. I think each of aims of my thesis was fulfilled. A predefined hypothesis should have been verified by the thesis. The hypothesis that the higher occurence of socially pathological phenomena is in the school with lower extend of spare-time activities offer was not affirmed. The technique of controlled dialogues was used for the query processing, the secondary data analysis of the concerned documents and data content analysis of documents. The research work was carried out quantitatively and qualitatively. It was found out that the occurence of socially pathological phenomena is not dependent on spare-time activities offer. It results from the research work that in the group of children where socially pathological behaviour was uncovered, there are more children who do not attend any spare-time activities offered by the basic schools. It leads to the result that spare-time activites offered by the basic schools affect positively children{\crq}s behaviour in the schools of microregion Moravskobudějovicko.
Senior Primary School Pupils{\crq} Awareness of Possibilities to Solve Their Problems with the Occurrence of Pathological Phenomena (Moravské Budějovice, Czechia)

The term ``social pathological phenomena{\crqq} is defined as most serious disorders in behaviour of children and youth. Society finds these disorders negative as they bring many personal problems to the perpetrators in their families, at school as well as in broader social environment. These behaviour disorders particularly result in breaking social standards and penal law. The main goal of the present thesis was to ascertain awareness of senior pupils at primary schools in the region of Moravské Budějovice, Czechia, of possibilities to solve their problems with the occurrence of pathological phenomena, that is, whether they know whom to turn to if they encounter problems with social pathological phenomena. Sub-goal No 1 was to ascertain who informs senior primary school pupils of possibilities to solve their problems with the occurrence of pathological phenomena. Sub-goal No 2 was to describe social pathological phenomena with senior pupils at primary school. In order to get an overview of the problem, the author used quantitative research, namely the method of questioning, the questionnaire technique and the documents analysis method, then also the technique of secondary analysis of data from related documents kept at a body of social protection of children. Questionnaires were distributed among senior pupils in selected classes of primary schools, among their class teachers and pedagogic instructors in the selected primary schools in the region of Moravské Budějovice. In relation to the presented sub-goals of the thesis, the following two hypotheses were formulated. Supposed Hypothesis No 1 ``I assume that basic information is given mainly by class teachers, prevention methodists and pedagogic instructors{\crqq} was confirmed. The questionnaire results show that the group of pupils researched were mostly instructed by teachers. Supposed Hypothesis No 2 ``Social pathological phenomena are taken as a social problem which is difficult to solve in the aforementioned region{\crqq} was not confirmed. The research shows that teachers and instructors in the selected primary schools are very successful in dealing with the problems of social pathological phenomena. Therefore, we may conclude that the endeavour of schools in the field of occurrence of those phenomena and their prevention is on a very good level in the period tested.
