State responsibility to prevent and control a pandemic
Mazánková, Zuzana ; Bílková, Veronika (advisor) ; Šturma, Pavel (referee)
1 Abstract State responsibility to prevent and control a pandemic The submitted thesis explores state responsibility under public international law and how it relates to the obligation to prevent, protect against, control and provide a public health response to international spread of disease. Epidemics are hardly a new or unprecedented phenomenon, and the increased incidence of seasonal influenza strains and other viral respiratory infections are a recurring theme every year. However, the issue of state responsibility for international spread of infectious diseases came to the forefront lately due to the events at the beginning of 2020 when a global pandemic of the new coronavirus COVID- 19 appeared, causing over seven million deaths by October 2023 and significant economic losses. The virus was first identified in China, which reported the outbreak to the World Health Organization (WHO) at the end of 2019. Shortly after that, despite public health measures being implemented, the infection began to spread worldwide via international travel, and multiple reports emerged that China had had information about this infectious disease a month before reporting it and deliberately concealed it, which would constitute a violation of International Health Regulations. Given the damage incurred by states, businesses...
The legal regime of the Arctic (international legal aspects of the Arctic Ocean), compared to the legal regime of Antarctica
Huk Kloučková, Eliška ; Ondřej, Jan (advisor) ; Šturma, Pavel (referee)
The main objective of this thesis is to analyse the legal regimes of the Arctic and Antarctica and to compare them. The research question is whether and in what specific ways the legal regimes of these polar regions differ. The thesis mainly uses the descriptive method, which describes the basic background and the applicable legal framework, and then the comparative method when comparing the two regimes. In addition to the introduction and conclusion, the thesis is divided into a total of seven chapters. The thesis thus first defines the Arctic and Antarctic, introduces their history and outlines their geopolitical significance. The main parts of the thesis are devoted to the legal regime. In the case of the Arctic, which is mainly a frozen sea around the North Pole, the law of the sea relevant to this territory is discussed. Attention is given to the 1982 UN Convention on the Law of the Sea and its application to the Arctic Ocean. The thesis also describes the pending disputes in this area and the challenges that this legal regime poses not only for Arctic states. In the case of Antarctica, which is a continent, the complex treaty regime that was treaty-anchored in 1954 is discussed. Attention is also paid to the European Union's interest in these areas, as well as the Czech Republic's...

Dolejšová Kabelová, Kristýna ; Šturma, Pavel (advisor) ; Hubálková, Eva (referee) ; Hýbnerová, Stanislava (referee)
The Prohibition of Discrimination as a Legal Problem in the Case Law of the European Court of Human Rights JUDr. Kristýna Dolejšová Kabelová This dissertation thesis is focused on the examination of the prohibition of discrimination in the European system of the protection of human rights as based on the Convention for the Protection of Human Rights and Fundamentals Freedoms (hereinafter referred to it as the "European Convention"). The European Court of Human Rights (hereinafter referred to as the "European Court"), in its role as a component of this system of protection, acts as an international judicial organ that reviews individual applications concerning an alleged breach of the European Convention by a Member State. In the area of the protection of human rights such prohibition of discrimination is based on the fundamental principle of equality, and constitutes an integral part of all important international instruments for the protection of such rights, and of the modern national legal orders of states. Inevitably, however, the legal systems of modern-day states are built upon distinctions, categorizations and classifications inherent to their societies, creating unintentional opportunities for discrimination. The problem of the prohibition of discrimination consists in delimiting the...
Dispute settlement in the international economic law - selected aspects
Cibulková, Barbora ; Balaš, Vladimír (advisor) ; Šturma, Pavel (referee)
This thesis deals with the dispute settlement in international economic law. Specifically, it focuses on dispute settlement mechanism within the framework of the World Trade Organization (WTO). The aim of the thesis is to examine specific features and evolution of this mechanism and to look at its functioning through case analysis. As an object of the case analysis I chose to investigate cases which have been filed by or against People's Republic of China (China) since its accession in 2001. The accession of China to the WTO was entailed with some controversy and China is well known as a state which is rather not in favor of international adjudication. Therefore, I would like to discuss why this system is more appealing to China and which consequences it might have. The thesis is divided into four main parts which are further divided into chapters. The first part of the thesis explores evolution of the dispute settlement mechanism of the WTO from its predecessor GATT 1947 and outlines main features of the dispute settlement proceedings. The second and the third parts of the thesis shift focus on China and provide a basis for the case analysis in the fourth part. The second part deals with specific circumstances of the accession of China to the WTO, while the third part looks at historical and cultural...
