Comparative study of legislation and impact of social economic factors in prostitution problems of The Czech Republic and Austria.

Abstract The theoretical framework of this thesis aims to analyze in a deeper way the matter of prostitution, pointing out to the present situation of this social matter in the Czech Republic as well as the connected or closely related criminality. Within the context of prostitution, general terms are specified along with the forms of prostitution, including the new so called ``laufhäuser{\crqq} (through house), present legal regulations and the impact of prostitution on the Czech economy. Furthermore, the health aspects of prostitution are also marginally dealt with. The subject of the thesis is ``Comparative Study of the Legislation and Impact of the Social and Economic Factors in the Matter of Prostitution in the Czech Republic and Austria{\crqq}. The main objective of the thesis research was to answer the research question - whether the present legislation concerning the legal regulations of prostitution is more favourable in Austria. Directed interviews were chosen as the research method, carried out with the members of the Czech Republic{\crq}s Police, who deal with the issue of prostitution on a daily basis within their job responsibilities and are aware of the problems connected with prostitution in the Czech Republic as well as the neighbouring states, Austria - Upper Austria in particular. The selected sample of police employees unambiguously confirmed that adopting a prostitution act similar to the present one in Austria would be of a benefit not only for the police, but for society itself. Should we relate to the present state of prostitution in the Czech Republic and problems connected, it can only be stated that the only effective and system solution for the future is to adopt an individual prostitution act. Prostitution cannot be wiped out in society, as long as the demand for and supply of these services exist; however it can be successfully rectified. Prostitution has never been and is not an accidental and sporadic phenomenon; it is and will be exercised in any political system, often even in spite of severe repression.
The Reasons for prostitution in South Bohemia Region

The Bachelor{\crq}s thesis deals with prostitution issues in the South Bohemian region and its development through the secondary and content analysis of data gained from the Czech Republic police, from the Management of South Bohemia. The prostitution accompanies the humankind the all time of its being. It is possible to define it in this way: Everybody who has sex or carries out an activity for purpose of sexual satisfaction for a consideration or in order to gain certain advantage or interest, without emotional attitude and without regard to the choice of a partner, commits the prostitution. Before the year 1990 there was the prostitution in a latent form in the Czech Republic, as a part of shadow economy. The repression was the only form of its regulation, which went out from the Penal Law No. 140/1961 Coll. Article 203 on Sponging; on its basis the prostitutes who had no employment were inflicted. In 1990 the Offense Act No. 150/1991 Coll. was repealed due to the amendment of the Act No. 140/1961 Coll., the Act No. 175/1990 Coll., and the Article 203 of the Penal Law on Sponging. These legal acts are in addition to the opened borders, foreign tourism boom and stratification of Czech citizens in connection with the enormous extension of publicly and hidden practiced prostitution in the Czech Republic. The aim of the thesis is to inform the reader about general facts concerning the prostitution. Further it should point out the social-pathological aspect of the problem. During my writing I got from the available literature, other sources were dossiers from the Czech Republic police, the Management of South Bohemia and the invaluable experience of its executives. According to the gained and processed information the numbers of prostitutes are being reduced {--} the prostitution in the South Bohemian region is decreasing. The hypothesis was confirmed.
PROSTITUTION IN REGION ĆESKÝ KRUMLOV

Prostitution in Český Krumlov District The prostitution (from the Latin Prostituere) is providing sexual services for the payment or for or any counter-value, it makes no difference if it is a material remuneration or financial payment. The typical side effect of the prostitution is a frequent change of partners. We understand usually under the prostitution the women{\crq}s prostitution, however, also the men{\crq}s as well as children{\crq}s prostitution exists. The prostitution as mass social phenomenon is a social pathological phenomenon in all the present highly developed cultures. It is called also the oldest trade of the world, as it has exist already since the Antique. The theoretical part is focused first of all on finding out the prostitution at present, its forms, who provides the sexual services and what problems are associated with it in the society. Its aim is to present the whole issue of prostitution. The data necessary for testing the formulated hypotheses were acquired by means of the quantitative research, enabling the work with the big complex of respondents. To collect more easily the highest possible number of answers, the method of the written questioning, i.e. of questionnaires was selected. The investigated complex of respondents was in the age range from 15 years to 71 years. The research was performed in the towns as well as smaller municipalities concerned by the issue of prostitution. The information was provided for what purposes the questionnaires will be utilized and that the evaluation will be anonymous. One of the goals was monitoring the prostitution (erotic clubs), directly in the Český Krumlov District, acquiring information in what way the prostitution is regulated by individual municipalities and finding out, how the prostitution in the municipality is perceived by the citizens. The first hypothesis was to find out if the municipalities issue the directives of public order regulating prostitution. And if these Directives are cancelled by the Constitutional Court. This hypothesis was refuted during the investigation. And the second hypothesis was that the inhabitants consider the regulating measures for the prostitution as insufficient. This hypothesis was confirmed. The thesis may be utilised as incentive for the changes in legislation and attitude of municipalities to this issue, or extension of measures of individual municipalities.
Prostitution as a Social Problem

The theoretical part consider the concept of prostitution and its reason, historical evolution, forms of prostitution, social-pathological problems related with prostitution. Last capter of this part pay attention to the criminal, health and legal consequences of the prostitution. Research part is focused on women that prostitute in night clubs in border region of south Czech.
Health and social problems of venereal diseases

The aim of the diploma work was the effort to map the problems and occurrence of sexually transmissible diseases, particularly gonorrhea and syphilis, in Southern Bohemia in the time period 2000 {--} 2005. Standardized questionaries ``Report of veneral disease{\crqq} of the Ministry of Health of the Czech Republic were used. The basic set is formed by patients that contracted during the period 2000 {--} 2005 one of the four sexually transmissible diseases subject to obligatory report to the National registry of veneral diseases of the Czech Republic. Four hypotheses were proposed for the subject. The work is divided into two parts: a theoretical and a practical part. The current state of the issue is outlined in the theoretical part. Here are further described the most frequent sexually transmissible diseases, their prevention and also the social impact of prostitution and the effort to provide a legislative treatment to this problem. The practical part covers the results of analyses of data from the given question-forms and their presentation in overview tables and graphs. Case studies of patients with syphilis from the Dermatovenerogical department of the Hospital Ceske Budejovice are presented including an interesting photo documentation showing the clinical and epidemiological importance of this problem.

This work deals with the definition of licenced trades in the Czech Republic. It defines what activities are licenced trades and what they are not. The publication describes the conditions that must be fulfilled in order to become a sole trader. It describes the rights and obligations of the inspection stuff and controlled persons, shows the process of licenced trade control. In conclusion, the work focuses on the issue of prostitution as an activity requiring legislative modification, explains the pros and cons of regulating prostitution and raises examples of how is the problem of prostitution solved by other countries.

The bachelor essay deals with the influence of economic, legal, social and moral aspects on subjects that represent market supply of prostitution. At the beginning there are briefly described the reasons and substance of the shadow economy, there are also defined notion of prostitution and possible ways of this activity. The next part of the essay focuses on the market, subjects that represent market supply and market demand, legalization and taxation of prostitution. The theoretical part of bachelor essay also study the prostitution in Czech Republic and it's legal regulations, public notice, draft laws in 2005 and 2008. In practical part there are described research technique, target group and presumed intent of this essay. The information source for market research of prostitution in nightclubs is oral interview with prostitutes and with manager of disorderly house. The target of bachelor essay is to find out what has an influence on behaviour of prostitutes and their managers and to determine whether the market supply of prostitution will be changed.
Economic Analysis of Prostitution Market

The bachelor essay concentrates on the economic aspect of prostitution. At the beginning the essay briefly deals with history of one of the oldest professions in the world and its position in society. The essay thinks of the notion of prostitution from the point of view of economics as a possible free choice of behaviour, free decision making of an individual and using his own body as he thinks that it is acceptable. Then the essay tries to study how the market for prostitution, where the adults make a business with sex, operates and which factors can influence particular subjects on this market -- supply and demand for free sex for money. Marginally the essay is interested in description of several segments of prostitution market (private, streetwalking, night clubs, escort) and the role of the third part of business -- mediators. The main point of view concentrates on alternative policy of the government (prohibition, legalization) and analyzing not only the economic and social impact of these policies on the prostitution market but also the other effects which are jointed with prostitution - trade with human beings, violation, spreading of sexually transmitted diseases.
