Selected aspects of the offense law

The Master`s thesis ,,Selected aspects of criminal law,, deals with the legal regulation of offense procedure and provides a comprehensive view on the issue of the procedure. The introductory part is focused on basic sources of criminal law that are further divided into domestic and international. The mutual relation between Act no. 200/1990 Coll. about offenses, as amended, and Act no. 500/2004 Coll., Administrative Code, as amended that are involved in the infringement proceedings, is analyzed in particular. The second part of the thesis focuses on the general substantive alteration of offenses and the definition of their basic concepts. The third part focuses on the proceedings, the termination of proceedings in the first instance and summary proceedings, including the legal remedies and judicial review. The practical section provides examples of specific solved cases of selected offenses, including an evaluation of the statistical evidence provided by the Infringement commission Municipal Bureau of Zatec. The conclusion of the thesis contains considerations de lege ferenda.
The offence proceedings of administrative authorities

This thesis with topic proceeding administrations. Theoretical part is focused charakteristic the offence proceedings as a whole, according to the Act of Offences adn Administrative Code, which explains the basic principles and concepts with I would like to explain. The practical part is focused on the Commission´s proceedings dealing with ofeenses city Pečky. Expecially with my work will relate to offenses that were committed in this territorial for the perriod 2001-2015, focusing description of illegality and about what kind of offenses are.
Administrative torts and misdemeanors according to the construction law

This degree thesis deals with administrative torts and misdemeanours according to the construction law in the Czech Republic. First, the paper describes in general the development of imposition of administrative sanctions together with legislation currently in force, focusing on individual facts of administrative torts and misdemeanours according to the construction law. In compliance with its objective the degree thesis is focused namely on the legislation in force, basic principles and rules of administrative proceeding, application of relevant legal regulations and procedures within administrative proceedings differentiated according to the nature of the person being sentenced. The procedures and possible decisions in administrative proceedings are presented in the thesis both from the view of the first-instance authority and the appellate authority, including other methods of defence against decisions issued. Based on the data obtained from employees of building authorities the degree thesis also describes the development of behaviour of persons in the Region of Pilsen while respecting the construction law and summarizes the problems occurring in administrative proceedings. It also follows up the relations of administrative proceedings and factors causing infringement of the construction law and offers possible solutions for better general awareness of the existence of legal regulations and possible sanctions imposed for the breach thereof.
Proceedings in Misdemeanour in Terms of the Town of Tabor

The present diploma thesis gives a comprehensive view of misdemeanor proceedings exercised by the administrative authorities responsible for dealing with offenses. The thesis is divided into two main parts, theoretical and practical. At the beginning of the theoretical part there is a definition of basic terms including an overview of current legislation of misdemeanor proceedings. The most essential section of the theoretical part is a comprehensive description of misdemeanor proceedings before the commencement, during the proceedings and at the end of the first stage. The practical part of the thesis focuses on the activities of the Misdemeanor Department of the Municipal Office of Tabor, namely for the period 2011 - 2015. With regard to the examined period there is an analysis of changes in legislation which have had a major impact on the Misdemeanor Department of Tabor for the past five years. The practical part also presents a statistical evaluation of misdemeanor proceedings in Tabor. In addition, there is an interview with a senior executive of the Misdemeanor Department of Tabor. In the conclusion there are some proposals leading to an improvement of the operation of the Misdemeanor Department of the Municipal Office of Tabor.
Offence Proceedings in Theory and Practice of Law

The theoretical part of this dissertation deals with problems of offence proceedings. It defines basic concepts and describes institutions which are collocated with the offence proceedings. The thesis is structured from legal enactments, corporeal legal formation of offences and principles of the offence proceedings across actions before the start of the proceedings and the proceeding itself to due and special legal remedies and types of offences per a law of offences. The practical part includes data about offences from Commission of an Offense in the town of Náchod registered between years 2011 and 2015, overview of them in separate years, charting and evaluation of the of most frequent offences across these years. According to the detected data there is an evaluation of generally perceived hypothesis of worse condition of interpersonal relationships in the society in collocation with the results of the survey.
Development of traffic offenses

Driving offences are an actual topic, because there are more and more vehicles on the roads of all the time higher power and all the time more "perfect", while personality of the driver remains the same and the consequences of these driving offences are all the time more fatal. However it is strange that adhering to the traffic rules from the side of drivers is very limited and the whole society subconsciously sees resolution of these offences so that the driver obtains a fine on the spot or the offence is reported to the respective administrative body for further hearing. The reality though is much more complicated, as resolving of traffic offences is dealt with in the Act on offences, Traffic act as well as in the Administrative procedure code. Further facts have to be for instance deducted from the Criminal code. The legislators make every effort to adapt traffic regulations not only to the currently growing occurrence of road rage, but also to set more accented rules, which would be not only respected, but also adhered to, by drivers. Probably the greatest progress in the area of driving offences brought the introduction of so called point system, which has not only repressive but also informative and preventive effect. The essence of this system lies in the fact that the most serious offences and criminal offences are rated by points and when committing these the points add up in the register of the driver up to an exactly defined level, beyond which the driving licence is taken away from the driver. Further breakthrough represents the amendment of the Act No. 361/2000Sb., which, among others, incorporates into its content a part of administrative transgressions such as § 125c - offences, which means that the Misdemeanours act should contain only the general part on offences and a procedure provision regarding offence proceedings.
Offence Proceedings in Public Nuisance Cases

This thesis is focused on the offences discussed in the field of public policy in the period from 2011 to 2015 at the Municipal Office of Nový Bydžov. The work identifies the most common offences types, discussion results, discussion complicating facts and proposing measures for their elimination. The theoretical part describes the concepts relevant to infringement proceedings. The practical part contains the introspective investigation results with innovations proposal. The following is an offences legislation analysis in selected European countries with proposals for inclusion of selected foreign legal institutes into Czech law.
Offence proceedings in matters of property

The bachelors thesis is concerned with the problems of offence proceedings in matters of property. The theoretical part comprises an analysis of the current applicable legislation including definitions of the most important terms of the Misdemeanour Act. The first part of the thesis includes comparison of elements of property criminal acts and property offences while taking into account the amendment to the Misdemeanour Act which entered into partial effect during the drawing up of this thesis. The practical part of the thesis describes the most common forms of offence proceedings used in practice and subsequently analyses the property offences committed in 2012 until 2014 within the competence of the Municipal Authority of Cheb. Based on her practical experience, the author describes practical problems that can be encountered when dealing with property offences. In conclusion, the thesis evaluates the results of data analysis and comparison based on the obtained statistical data and proposes changes in the legislation as a result of which property offences would be addressed in a more effective and economical manner.
Administrative proceedings in legislation and practice of the Czech Republic

Bachelor thesis is focused on the theoretical part of the administrative procedure in misdemeanor proceedings in the field of transport agendas. This is particularly the acquisition of orientation in the field of administrative proceedings with the theoretical and application orientation in the field of traffic offenses. Familiarization with the structure and regulation of offense proceedings. Practical part assesses the whole stage during offense proceedings of selected tasks in the context of the application of the Administrative Code. The work is supplemented by an analysis of traffic violations and analysis of traffic accidents. The effort will not only identify, but also to evaluate the causes of road traffic offenses. The findings will be evaluated by the application of theoretical knowledge of legal regulation of administrative proceedings in the course of the offense proceedings.
Men as victims of domestic violence

This dissertation focuses on issues of domestic violence (also known as domestic abuse) against men. It looks into the issue why male victims are not taken seriously by the Czech police forces. Domestic violence against men is less common than domestic violence against women. However those males affected by domestic abuse often struggle to find support in society and in the Czech law. They are often left to deal with the problems on their own. In many cases male victims are not treated seriously by society and police forces. It is very important to highlight this issue in society and find support by the Czech government. Abuse against men should be taken as seriously as violence on female victims. The focus should be on early intervention and prevention.
