The application of alternative dispute resolution methods in the exercise of conusumer rights and resolution of consumer disputes

Judicial protection is considered as the basic civilian right guaranteed by many of international conventions and constitutions of particular states, which is necessary in cases of endangering or breach of law. Although it is the basic safeguard, some of the infringed relationships need another technique of their solving (especially family, labour or neighbourlyrelationships). Among these ranks the consumer relationship - relations between consumers and traders. This relationship has a specific character - it is imbalanced. The consumer is economically weaker and less experienced in legal matters than the other party to the contract - the trader. Many consumers refrain from taking action in case of infringement of their right because of certain problems associated with court procedures in consumer disputes, such as high fees, long delays and cumbersome procedures; outgoings exceed the value of claim. In order to enhance the effectiveness of the enforcement of consumer rights and increase access to justice, there were set up special out-of-court procedures. These use various alternative dispute methods which are denoted as structured methods of resolving disputes other than formal court based adjudication, such as mediation, arbitration and conciliation which facilitate consumer access to justice....

Alternatives to unconditional term of imprisonment

The name of my thesis is Alternatives of unconditional sentence of imprisonment. For this is a very wide topic, I concentrated on community service sentence, monetary fines, activity prohibition punishment and conditional postponement of the performance of a sentence of imprisonment. Further, I dealt with some new sentences of home confinement and ban on activities such as attending sport, social or cultural events, as well as diversion from standard criminal proceeding. The thesis is divided into ten chapters, some of which are divided into subchapters for better lucidity. First chapter concerns with a present situation in prison service in the Czech Republic as well as in the world. The sentence of imprisonment has besides undeniable positive also some negative sites, which can be minimized by various alternatives of this sentence. Hereafter I already deal with individual punishments. The most extensive chapter discusses community service sentence, which is a second most frequently imposed alternative punishment. Substantive law and procedural law presumptions of its imposition are analyzed, as well as postponement, suspense and refraining from this punishment and its regulation in a new Criminal Code. SCXML state machine interpretter

Currently there is a need for programmers to access various tasks with alternative procedures. One such practice is using the state machine entry. As the solution shows a newly emerging standard by W3 Consorcium, called SCXML. By now, there are several di fferent implementation, but because of their robustness may not be suitable for individuals or small to medium businesses. These companies need tools that can easily adapt to their own projects. The aim of this work is to create a state machine interpreter described SCXML language that will satisfy the conditions described. The e ort is to implement the maximal part of SCXML specification. Work will be created in Perl and will support the operating systems Windows and Linux.

88 THE .EU TOP-LEVEl DOMAIN NAME AND THIRD PARTIES RIGHTS PROTECTION English summary My graduation thesis deals with the top-level domain .eu, its origins, methods by which it is embodied into legal enactments and mainly about rights relating to the .eu TLD and the extent of protection the holders of such rights could expect. The prologue is focused on the general analysis of the problematic regarding domain name itself, both the technical and legal aspects. Thus in this part you could find information about the function of the domain name, its relation to the IP address and about the categorization made on the basis of the top-level and second-level distinction. There is also description made in this part of the three main TLD groups: a) generic TLDs - .biz, .com, .edu, .gov, .info, .int, .mil, .name, .net, .org, .pro, .aero, .asia, .cat, .coop, .jobs, .mobi, .museum, .tel, .travel, .arpa, b) country code TLDs and c) .eu domain, which probably creates the third group. After common technical description of the domain name there is analogous treatise on the legal aspects of the domain names themselves as well as the description of the position of the entities involved in the legal relations relating to domains. The protection of property rights in the Czech Republic: public judicial system versus private alternatives

This diploma thesis focuses on relation between state and private system of debt collection. The first part of this paper briefly describes traditional role of the government in general and deals with question if it is possible to establish competition into the justice. The second part describes and analyzes four different systems of debt collection in the Czech Republic -- execution procedure by public judicial system, by judicial officer (for-profit alternative), by arbitration court and by collection agency. In this part there are also described mechanisms of how four different systems work. The analysis of efficiency of four systems arises from comparison different motivation and mechanism used by representatives of systems. The aim of this paper is to monitor present condition in the market of debt collection in the Czech Republic and to demonstrate if the protection of property rights changed by the entrance of non-state alternatives.

Legal protection of domains in relation to the right of indication The aim of this master thesis is to provide information about the relation between domain names and law, with particular attention paid to rights of indication. The reader will become acquainted with the classification of domain names within the Czech legal system, their possible conflicts with different rights, and procedures which can be used for their protection. The thesis reflects changes caused by the new conception of private law and recent judicial decisions, mainly regarding alternative dispute resolutions. In order to understand this issue, it is also necessary to be familiar with the technical aspects of domain names and the Internet, and therefore this subtopic is included in the thesis as well. The thesis consists of four topical parts. The first one, which is made up of the second and the third chapter, deals with the functioning of the Internet and IP addresses, the registration process of domain names, and their composition, management and main functions. The future of central banking in the economic system of developed countries on a basis of evalution of the experience from the last decade

Thesis is dealing with the development of the central banking on the basis of experience from the last decade. Hypothesis is the statement, whether the central banks of the developed economies are increasingly less capable of the effective reactions on the accelerating development of the global economy and their position in the money emission and regulation of the banking sector is and will be more and more weakened by the alternative banking and monetary systems. This hypothesis is successfully disproved because of the behavior of the four chosen central banks which are CNB, FED, ECB and BoJ. The main reason was an increase in their activities and interventions causing among others multiplication of their balance sheets. On the other hand the alternative in the free banking is further from the reality than before. Virtual currencies also did not show threatening growth of the national currencies substitution in the reference period. Thesis also provides insight into new and potentially new instruments of the central banks.

Toll system in the Federal Republic of Germany

The Master's Thesis deals with the toll system in the Federal Republic of Germany. The theoretical part of the thesis describes technologies that are used in electronic fee collection systems, satellite navigation systems and provides a snapshot of German road infrastructure. The main part of the work deals with German toll system that is provided by Toll Collect GmbH. Various aspects of toll payment via fuel cards are discussed in the practical part that also includes an alternative payment option. The study case assesses whether hauliers should or should not try to avoid using toll roads.

Inventory management in selected company

Presented diploma thesis deals with issue of inventory management and with analyses of inventory management in selected company NOVEM Car Interior Desing k.s. In opening theoretical part, there are defined basic terms dealing with inventory, its management, structure, cost related to purchacing of inventory, reason of inventory management and its inspection. Further there are described information systems used for inventory management. Practical part includes presentation of company NOVEM Car Interior Design k.s. seated in Město Touškov and also detailed analyses of inventory management in named company; this part also incorporates inventory valuation. There is also described use of SAP information system on selected real cases. In the end of practical part there is evaluated effectiveness of inventory managenent of investigated company and as well there are proposed improving actions.
