The Employment of People with Disabilities Abstract This thesis deals with the legal regulations governing the employment of people with disabilities in the Czech Republic. The topic is discussed primarily from the employer's point of view. One of the objectives of this work is to demonstrate the benefits of employing people with disabilities to (potential) employers and to offer an overview of the instruments the Czech legislation offers to compensate the employers for the potential extra costs incurred by employing persons with disabilities and to motivate the employers to employ such people. The thesis starts with the definition of a person with disability, including the meaning of this term in important international documents, as well as in strategic documents of the European Union and some of its institutions. It shows that the concept of disability is evolving and there is a demonstrable shift from a medical to a social concept of disability in European case law. The thesis also provides an overview of active employment policy measures and instruments designed to improve job opportunities available to people with disabilities. Employment of foreigners in the Czech Republic

1 Employment of foreigners in the Czech Republic Abstract This thesis deals with the issue of employment of foreigners in the Czech Republic. This thesis consists of three parts: (i) the introduction, (ii) ten chapters which are further divided into parts and (iii) the conclusion. Summaries are provided in the end of the most of the chapters and sometimes they also contain de lege ferenda suggestions. Fundamental terms connected with the employment of foreigners (e.g. EU citizens, family members of EU citizens, third-country nationals or employment) are explained in the first chapter. Terminology of this thesis is stated in this chapter. The second chapter characterizes types of residence permits for EU citizens, family members of EU citizens and third-country nationals. Temporary, long-term and permanent residence are described in this chapter. The third chapter deals with employment of EU citizens, their family members and third-country nationals in general. Employment of refugees, illegal workers and unreliable employers are also discussed. Resocialization of individuals in prison by education and employment

Resocialization of individuals based on the execution of a sentence is a very demanding process, which is not always successful. It is influenced by number of factors, such as personality, physical and mental condition, or family background. We, as social workers, must make a huge effort to strive for successful resocialization. We cannot influence the above-mentioned factors, but we should make great efforts to motivate the client, and employment with education can help us to do so. Firstly, prison was mentioned in the history, then individual terms were introduced, the Prison Service of the Czech Republic was described, the consequences of staying in prison was mentioned, the issue of resocialization of offenders from excluded localities was summarised and drug-free zones in prisons and treatment programs were described. The chapter on employment summarized this issue, current figures, specific examples and future plans of the Prison Service. The chapter on education introduced formal and non-formal education, educational opportunities for convicts, educational activities of non-governmental non-profit organizations and the educational function of clergy. Employment of children from Asian communities in the Czech Republic

The bachelor's thesis "Employment of children from Asian communities in the Czech Republic" deals with the situation of particular children of Vietnamese and Chinese origin in the Czech Republic, who started to work here after completing their compulsory education: without any working contract, 10-11 hours a day, 6 days a week. The thesis tries to specify the appropriate legal frame for their situation, as well as to contextualize it with regards to social and cultural background of the children. It focuses mainly on questions related to the right of children to particular protection and care, to education and vocational guidance, to protection from labour exploitation, etc. It also deals with the relation between rights and obligations in a legal and social state. The thesis reflects upon the responsibility for the situation of the children, and tries to find a direction that could help to avoid similar cases in future.

69 Abstract The main goal of the diploma thesis "Employment of foreigners" is to summarize and critically evaluate the current legislation regarding the employment of foreigners in the Czech Republic, both for foreigners from countries which are not Member States of the European Union and also employment of citizens of the European Union since a separate regime applies to each of these groups under the Czech law. The thesis itself is divided into the introduction, four main chapters and a conclusion. The first chapter defines the most important legal terms which are crucial for the elaboration of the thesis, i.e. in particular a foreigner - as a general term as well as the legal definition stipulated in the Act on Residence of Foreign Nationals in the Czech Republic, a family member of an EU citizen or a Czech citizen respectively, an employee, an employer and employment. Title of thesis: Employment of persons with disabilities Abstrakt v anglickém jazyce Persons with disabilities are a vulnerable group of citizens, and not only in terms of employment. Finding their spot in the labor market is made difficult by their handicap and often by low or incomplete education. That is why legislation is in place to help them compensate for their initial disadvantage by raising them to the same level as the rest of job seekers. The goals of this thesis are to analyze and evaluate the current regulation of the employment of people with disabilities, and to research the practical side of this issue in the current labor market. The thesis tries to find out the forms of assistance offered to persons with disabilities and the actual employment options open to these persons. The thesis consists of four chapters. The subject of this Master's Thesis is to present some legal aspects of employment of persons with disabilities. This thesis deals with the subject particularly with respect to national policy of employment and individual labour-law relations. The largest part of text is devoted to the efforts of the state to reach higher employment rate of persons with disabilities and to compensate their inherent handicaps. This thesis is divided into seven thematic parts. The introduction is followed by part that defines basic terms of employment of people with disabilities which are not legally defined. The issue concerns the terms which are regularly mistaken in common conversation such as disability and handicap. 1 This thesis on the topic of Employment of persons with disabilities complexly disserts on Czech legal regulation of employment of disabled people, also in the context of international legislation and European Union legislation. Disabled people belong amongst groups of people, which have difficulties with assertion on the job market due to their specific attributes, and therefore their employment on the open as well as on the protected job market is supported and protected by various legal instruments, which are described in detail in this thesis. Resumé The topic of my thesis is the employment of people with disabilities. In the thesis I deal with legal status of persons with disabilities and the instruments for protection and support in the area of employment. The thesis is divided into the introduction, nine chapters divided further into sub-chapters and sections, the conclusion and the annexes. The first chapter defines the term person with disability under international law, specifically in documents of International Labour Organisation, World Health Organisation, United Nations Organisation, Council of Europe, and under Czech legal system. In the second chapter I deal with the provisions of working conditions of persons with disabilities under the above international organisations. Employment of disabled persons in the Czech Republic and European Union

The objective of this thesis is to suggest possible improvements and ways to increase the efficiency of employment support and subsidies for disabled people in the Czech Republic. The thesis is divided into a theoritical and a practical part. The theoretical part focuses on the employment of disadvanatged groups of people in the labour market, legislation adjusting this issue, tools and financial subsidies from the Czech government, as well as the current state and problems of the Czech labour market itself. The practical part contains an employment analysis of disabled persons in the European Union with a closer focus on certain countries. Two surveys were carried out, targeting both employers and disabled employees. Based on the results of the questionnaires, proffessional literature, previous analyses and a comaprison between selected European countries, potential improvements and ideas are suggested to improve the current system of employment and financial subsidies for disabled people in the Czech Republic.
