Legal aspects of primary scientific results

This contribution focuses on the legal aspects of raw grey literature that is understood as yet to be published, interim or incomplete scientific results like raw primary data or drafts of scientific articles. Specifically the contribution deals with two problematic areas: 1) liability for damages resulting from inadequate (or even forbidden) use of the results and possibilities of limitation thereof; 2) ownership of such grey literature and contractual possibility to dispose therewith after it has been offered to official publication (i.e. the copyright issues of pre-prints, post-prints and publisher’s edition).

The use of Creative Commons licenses as an efficient way to share information

Licence Creative Commons (CC) umožňují jednoduchý způsob udělení povolení k užívání autorských děl, jako jsou texty, prezentace, obrázky, videa nebo hudba. Autor se sám rozhoduje, v jakém rozsahu nebo za jakých podmínek mohou ostatní lidé jeho dílo využívat bezplatně. Uživatelé takto licencovaných děl poté mohou v souladu s příslušným typem CC licence díla dále užívat, šířit nebo přetvářet. Cílem této příručky je seznámit čtenáře s možnostmi, které jim CC licence nabízejí. Chceme ale také nabídnout kuchařku, jak konkrétně CC licence využívat, kde hledat licencovaná díla, jak uvádět původ díla, na co si dát pozor a kdy se využívání těchto licencí spíše vyhnout. Nezbytným úvodem je potom mini exkurz do autorského práva a důležitých pojmů, s nimiž budeme operovat.

Copyright on the Internet

The aim of the thesis is to analyze the current state of copyright protection on the Internet, evaluate the position of operators of servers used for sharing data and identification of bottlenecks. On the basis of this analysis most problematic factors of copyright protection on the Internet should be revealed the alternative methods of distributing copyrighted works should be proposed as well. Along with the emergence of the Internet was enabled an easy and inexpensive distribution of copyrighted works. Considering the current state of protection occurs due to the Internet to frequent copyright violations. Analysis of the responsibilities of servers dedicated to sharing data allow to discover the fundamental problems in the existing legislation. The target of the theoretical part will be the historical development of copyright law and current legislation of copyright protection in the Czech Republic and the EU, focusing on the responsibility of servers used for sharing data. Furthermore, there will be generally solved the problematic aspects of copyright protection, which appeared along with the emergence of the Internet. In the practical part will be solid the technological problems of distribution of copyright works on the Internet and filtering of the content from the side of the server operators. Analysis of bottlenecks existing control system of the inserted content will be made by examining selected providers, mainly platforms YouTube and Uloz.to. The method of examining will be the analysis of arrangements for the provision of services and access to copyright protection.
Distribution of Czech music artists after the birth of the Internet

This thesis deals with the actual topic in the world of music, distribution of music of Czech musicians after the birth of the Internet. The work is written mainly from a practical point of view, but in the first chapters the reader is also familiar with theoretical concepts such as digitization, distribution, Long -tail Theory or Digital Rights Management. After the introduction to the topic analysis of sales of albums and songs on Czech music market follows, based on the statistics of the International Federation of the Phonographic Industry IFPI. Following chapter focuses on the business models of music sales, paid music services available for the Czech market and the issue of intellectual property. There are also explored current trends in music. The final chapters deals with an exploration from the database Market & Media & Lifestyle, and author's research (questionnaire survey). Key words:

This diploma thesis deals with protection of copyright within online media, with a focus on personal blogs. The author presents definition of basic terms of copyright, especially definition of usage of the work and description of way of use, and deals with the issue of liability for copyright infringement and identification of persons who carry the responsibility. This thesis is also dedicated to copyrights itself and its instruments of enforcement. Increased focus is put on available jurisdiction, especially jusrisdiction of The Court of Justice of the European Union. Finally, the author conducted a survey among the authors who publish their works online to determine their experience with the violation of their rights.
Current legal issues of copyright infringement of musical works

This diploma thesis identifies the most important changes in legislation and submitted proposals in the area of copyright between years 2012 and 2013 and in the beginning of 2014 in the Czech Republic, the EU and the USA. These changes are evaluated from a legislative point of view and also from the point of view of a music consumer. For thorough understanding, the thesis contains also an overview of the current Czech legislation of copyright. Furthermore, it evaluates the current situation in a broader context of law, history, technology, culture and consumer behaviour and defines it as opposed to previous periods. It describes the history of music piracy and its current situation and features some of the most important cases of copyright enforcement of the period 2012 to 2014. The thesis contains also a research performed in the Czech Republic and Sweden, which describes past and present habits of music listeners. Following the identification of previous development and current trends, the thesis discovers future development and suggests future solutions to the problem of copyright in music.
Copyright for audiovisual work and analysis of websites offering audiovisual works

This Bachelor's thesis deals with the matter of audiovisual piracy. It discusses the question of audiovisual piracy being caused not by the wrong interpretation of law but by the lack of competitiveness among websites with legal audiovisual content. This thesis questions the quality of legal interpretation in the matter of audiovisual piracy and focuses on its sufficiency. It analyses the responsibility of website providers, providers of the illegal content, the responsibility of illegal content link providers and legal responsibility of anyone who downloads the illegal content itself. In the end of this thesis the research results are analysed. The practical part of this thesis is devoted to the SWOT analysis of websites providing legal and illegal audiovisual content. The SWOT analysis results support the main idea of this thesis and also give us an outline of possible evolution of the audiovisual piracy. This prediction is mainly focused on the Netflix website. The SWOT analysis and website comparison are based on survey.
Legal issues of protection of sound recordings of musical compositions

In my diploma thesis i deal with legal aspects of the protection of sound recordings of musical compositions in the Czech Republic and the Russian Federation. In connection with the development of modern technoligies that facilitate access to copyright works, for example the internet, protection of copyright and rights related to copyright is becoming a very important and should be corresponding. The first chapter deals with the definition of the basic concepts of copyright. The second chapter focuses on the issue of copyright infringement and infringement of related rights in the Czech Republic and Russia. In the following section copyright's international treaties (TRIPS, ACTA and others) are analyzed and liabilities, which arise from them. The fourth chapter deals with the issue of enforcement of copyright. In the last chapter, I compare effectiveness of Czech and Russian legal norms for the protection of copyright, based on anonymous sociological research among university students relatively to the origin of audio recordings of musical compositions.
Analysis of the present approaches to DRM for electronic books and design of an alternative approach

This thesis deals with problems associated with the distribution of the electronic books. Those problems are mainly caused by the use of the digital rights management technologies and techniques. In the thesis those technologies and techniques are further explored as there are several stakeholder groups identified who are affected by them. It also explores ethical aspects of using those technologies and techniques and those aspects are then used as one of the starting points of the design of an alternative approach to the digital rights management. This approach is the primary objective of this thesis.
Communication to the public of broadcast works by radio or television receivers as an economic right in copyright and the exception thereto in favour of health establishments

The intellectual property concept of 'communication to the public of the broadcast works by radio or television receivers' in Article 23 of the Czech copyright act is a current issue especially in a relation to the exception to this right in favour of health establishments that has been called in a question in front of both Czech courts and CJEU. The most important criteria of communication to the public -- laid down by CJEU -- suggest that the concept should be interpreted broadly, covering all transmissions, regardless of the means used and the nature of the place for the communication. A public refers to an indeterminate but fairly high number of people who constitute so called new public. In order to fall within the scope of a lawful exception the criteria of the so called 'three-step test' must be met as well as the formal criteria stated in the abovementioned Article. The most recent cases discussed in this work dealt with the transmission of the protected works by means of television sets located in the bedrooms of the guests of spa establishments. Although it was held by CJEU that this exception does not comply with EU law, it is still part of the Czech law and Czech courts must cope with it.
