Domestic violence The present thesis deals with the phenomenon of domestic violence, from the substantive, procedural and criminological aspects. The first part defines the specifics of domestic violence, its signs and forms. It shows a typology of victims and perpetrators. It analyzes in detail the basic facts of the crimes that are the most commonly perpetrated forms of domestic violence. It also describes the sanctions and some of the treatment programs that are available for perpetrators of domestic violence. It maps the treatment of domestic violence in criminal procedural law and describes the reporting institution. The paper analyzes the status of the victim and also deals with the planned law to protect victims of crime. The conclusion summarizes the treatment of domestic violence abroad and briefly mentions the organizations providing assistance to victims of domestic violence and protection.
Stalking - criminal and criminological aspects

This dissertation deals with today still actual phenomenon called stalking, not only with it's more serious form known as a dangerous stalking but even its less serious forms. The work is systematically divided into three key parts - the first one focuses on a term definition followed by the part dealing with criminal points of view and the last one concentrates on criminological aspects. The introductory chapter contains some of the most famous definitions trying to define a difference between a stalking and a dangerous stalking. The readers are as well informed about the history of stalking and its possible forms to make it easy to understand the problem on a common level. The second part is dedicated to a criminal level of stalking. It detailly focuses on a quite interesting process of incorporation of a dangerous stalking offence into a law system of the Czech Republic. It also provides a list of possible sanctions of a stalker before an antistalking legislation introduction (it means before the year 2009). The second part of my work deals with a complex analysis of facts of the case according to the enactment §354 of the Criminal Law that is compared with some foreign norms in which it has found an inspiration. Crime of Stalking under section 354 of the Czech Criminal Code

This thesis is focusing on the topic of the crime of stalking under section 354 of the Czech Criminal Code (Act. no. 40/2009). The offence of stalking captures in its merit the harmful psychological and social phenomenon known under the name stalking. Aim of this thesis is to provide comprehension of the offence of stalking particularly in the context of the phenomenon on its broad forensic psychological level. The conclusions about the crime itself are then derived from the observations made while examining stalking in its whole complexity. Aim of this thesis is also providing suggestions through comparison of the Czech legislation and legislations of selected foreign countries. The topic of this thesis in opened with proper definition of the term stalking followed by and insight of its understanding and concept in the course of centuries. Moving towards modern era, evidences contradicting common myths associated with stalking phenomenon are given, following the historical background. Following chapters deal with the perpetrators of stalking and introduce the problematics of stalking in the light of forensic psychology. Stalking - Dangerous Pursuing Abstract This thesis deals with the issue of stalking, which is viewed comprehensively with the aim of summarizing and evaluating its criminological and criminal law aspects and assessing whether Czech legislation allows for an effective response to cases of stalking, timely assistance to its victims and appropriate punishment of the stalker. The thesis points to findings based on foreign research and studies dealing with the person of the stalker, his manifestations, and the person of the victim of stalking and the related effects on him. Surveys show an alarming number of cases of stalking in society with an overall lifetime prevalence ranging from 4.5% to 23.4%, and even from 6.1% to 32.4% for women, depending on the strictness of the definition used. The stalker does not choose his victim at random and the victim usually knows his stalker. The most typical case of stalking being a man stalking his current or former intimate partner, the danger in these cases being precisely the stalker's knowledge of his victim, the sophistication of his actions and his propensity for physical violence. Resumé v anglickém jazyce This thesis is focused on the crime of stalking under s. 354 of the Criminal Code no. 40/2009 Coll. This crime affects a phenomenon referred to as stalking in terms of criminal law. The aim of the thesis is to provide a comprehensive view on the issue of stalking in a broader context than just the one of criminal justice, and to compare the crime of stalking under the Czech criminal law with selected foreign laws. The thesis is divided into two major parts. The first part consisting of the first four chapters characterises the above-mentioned phenomenon mainly from the view of criminology and forensic psychology. The second part attempts to analyse the crime of stalking itself. The first chapter deals with the definition of stalking while evaluating and refuting the myths associated to this phenomenon. Then a brief history of the term is mentioned, followed by the descriptions of different types of stalking conduct highlighting mainly the ex-partner stalking, cyberstalking and stalking of celebrities. This thesis deals with the crime of dangerous stalking under s. 354 of the Criminal Code and also with the phenomenon called stalking, which is directly linked with the merits. In introduction of the thesis is described a relationships between the concepts - crime of dangerous stalking and stalking. The thesis is composed of three large chapters - first chapter is focused on stalking from psychological viewpoint, another chapter deals with a legislation of the crime of dangerous stalking in the Czech republic and in the last part are outlined the problematic aspects related to this crime and reasoning de lege ferenda. First chapter starts with a short description of history of stalking and includes mentioning of the first cases for introduction the antistalking legislation. Crime of Stalking and Protection of its Victims This diploma thesis focuses on the issue of stalking, or more precisely on its individual aspects and its legislation in the Czech Republic. As for the structure of this thesis, it is divided into five main sections. The first section deals with stalking in general. The individual chapters are devoted to the definition of this term, the historical development of this phenomenon and common forms of stalking, including two specific types of stalking, which are cyberstalking and stalking in the workplace. The second section deals with the characteristics of stalkers and their motives. The third section concerns the victims of stalking. The individual chapters successively analyse the typologies of victims, the impact of stalking on victims, including post-traumatic stress disorder, as well as the main strategies oriented towards helping the victims of stalking and, finally, the issue of false victims. The third section and the fourth one are the most comprehensive of all and together they constitute the core of the thesis. Stalking - criminological aspects Abstract The issue of this thesis is the criminological aspects of the crime of stalking in Czech Republic according to section 354 of the Act no. 40/2009 Coll., Criminal Code. The thesis consists of three parts. The first part is focused on the characteristics of the concept of stalking, its criminalization and analysis of the crime of stalking from the point of view of substantive and procedural criminal law. The second part contains knowledge about the personality of stalking perpetrators, several selected typologies of perpetrators and practical advice and recommendations in connection with helping victims of stalking. The last part deals with the threat assessment which stalking perpetrators pose to their victims. Furthermore, it is the focus of the thesis, which is the analysis of the concept of "reasonable concern" in the context of the crime of stalking. The last chapter of this part is devoted to the analysis of 4 cases of stalking from a criminological point of view. The issue of stalking in modern times

"The issue of stalking in modern times" Stalking is not a new phenomenon, but modern times, and especially the very dynamic development of modern technologies that have gradually become part of our lives, are taking this type of crime to a completely different dimension. This rigorous thesis deals mainly with the criminal offense of dangerous stalking according to § 354 of the Criminal Code and the related issue of misuse of modern technologies for the persecution of the victim, it also focuses on the motivation of the perpetrator and the behavior of the victim. The theoretical part of the thesis summarizes the legislative basis of dangerous stalking, describes the ways of possible use of available technologies for stalking. It also deals with the typology of perpetrators of dangerous stalking and their criminal motivation. The practical part of the work consists of seven case studies of this negative phenomenon from the Czech environment. The first case study focuses on a lawsuit resolved by the Municipal Court in Prague in early 2008.
