Methods of Investigation of Robbery

1 Summary The presented thesis deals with methods of investigation of robberies. It comprises all essential parts of such methodology and therefore aims to provide a complex view on the subject. Moreover, the work offers a deeper insight into some particular methods of investigation and emphasizes psychological aspects of investigation as well as of crime prevention. Comparison with foreign author's view on the subject is also included. The work consists of ten chapters dedicated to separate components of investigation. Chapter one presents the subject of investigation - robbery, its place in Czech law and legal definition set out by the Criminal Code. Chapter two provides criminalistic description of a robbery from different points of view and includes a relatively large part concentrating on foreign literature and robbery categories presented therein. Chapter three lists typical evidence which can be found on the crime scene and points out psychological aspects of formation of witness's memories of the crime. Chapter four lists standard situations in which the investigator finds himself based on the amount and nature of information obtained. The crime of robbery under s. 173 of the Criminal Code

The topic of this diploma thesis is a crime of robbery which is an offence under title two of chapter one of the special part of the Criminal Code as a crime against liberty (section 173 of Act No. 40/2009 Coll). Despite being one of the oldest delicts on our territory, its high severity and frequency in application render this topic particularly relevant. Not only does this thesis focus on the crime of robbery itself, as defined in section 173 of the Criminal Code, but it also addresses other legal provisions of the Criminal Code which are related to this topic. All compulsory elements of the facts of the criminal offence of robbery are scrutinized in detail - its object, objective side, perpetrator and subjective side. This thesis does not only analyze the basic form of robbery defined in subsection 1 of section 173 of the Criminal Code, but also the circumstances in which more severe penalties might be applied, as defined in other subsections of this section. Furthermore, the development stages of robbery and the participation in this crime are described and a comparison between the crime of robbery and a selection of other crimes is made. The diploma thesis deals with methodology for investigating the crime of robbery, which has been one of the most serious crimes. With regard to that this topic is very extensive, thesis includes only selected areas and facts that are related to the topic. Investigation of the crime of robbery has against other crimes its specifics. Describe precisely this specificity is the aim of this work. The work is divided into eight interpenetrating chapters. The introductory chapter deals with criminal characteristics of robbery, while out of definition of legal legislation the crime of robbery, is also briefly described the development, which the legislation of this crime in our country has gone through. The second chapter is devoted to criminological characteristics of robbery. The first sub-chapter briefly describes the occurrence of the crime of robbery in our area, especially with the help of graphs. Following part of this chapter is devoted to description of the crime situation as a situation in which robberies are regularly committed. Selected Criminal Thinking Conceptions in Offenders

Criminal thinking or attitudes constitute a concept that has received considerable research attention in foreign countries especially because of its proven relationship to antisocial behavior and potential for changing it through elimination of these attitudes (e.g. Blud et al., 2003; Henning & Frueh, 1996; Walters, 2005c). Nevertheless criminal thinking still remains almost undescribed in the Czech Republic. The present work is investigating criminal thinking on a sample of 202 offenders currently imprisoned for robbery or burglary. The primary method used was the Czech version of American self-report inventory titled "Psychological Inventory of Criminal Thinking Styles". The Czech version was developed in the Institute of Criminology and Social Prevention (Blatníková, Faridová, & Zeman, manuscript in preparation). This thesis was implemented under auspices of the Institute. The data suggest specifically highlighted sentimental style of thinking in our research sample. Positive correlation between intensity of criminal thinking and serious criminal history was demonstrated as well as the decline of intensity with increasing age and educational attainment. Property crime with the focus on theft

According to the name, my bachelor's thesis analyses property crime focusing especially on theft. First, I describe property crimes (part V of the criminal code), their general characteristics, possible division and then there are mentioned another parts of the criminal code or another laws that have connection with property crimes. However, the most important aim of my thesis is to deal with theft (§ 205 of the criminal code). I am focusing on the concept of theft, its general characteristics and development stages. Afterwards, I am comparing the crime theft with theft as a minor offence. The last chapter of my bachelor's thesis describes all the crucial distinctions between crimes theft and robbery. The whole thesis is based on case law.
The Youth Opinions towards Violent Crime

The bachelor?s thesis aims to map the opinion of young students in secondary schools on the issue of violent crime, its repression and prevention, and to identify their fear of such crimes. The theory part explains the historical development of repression for specific violent crimes and defines the concept of violent crime and describes concepts associated with this group of crimes. The next chapters deal with criminal aggression, forensic theory of violent crime, its phenomenology, etiology and prevention, sense of security and fear of such criminal offenses. The last chapter describes violent crimes such as murder, robbery, assault and manslaughter as stipulated in the new Criminal Code effective from January 1, 2010. Four hypotheses were stated prior to the research. The first hypothesis suggesting that more than 60% of all respondents consider the number of violent crimes decreasing was invalidated. The second hypothesis affirms that more than 70% of all respondents consider brutality of culprit of violent crimes to be rising. The third hypothesis affirms that more students of an apprentice school would inflict the death penalty for plain murder and deliberate murder after prior consideration than students of a grammar school. The fourth hypothesis suggesting that more than 80% of victims of violent crime within the respondents do not feel safe in their domicile was invalidated. A quantitative research was chosen to collect data. The method used was inquiry and the data collection method was anonymous questionnaire. The respondents were students of an apprentice school and of a grammar school. The sample was determined by quota sampling where the quota consisted in age, sex and type of attended school. The sets were mutually compared. The conclusions of the research indicate that respondents are not enough informed on the issue of violent crime. A certain distortion of data transfer to the public, and the lack of crime prevention, and the dangers of excessive watching of shows and playing video games with violent topics for children were pointed out. Based on these findings, possible solutions of the issue were suggested. The results of this thesis can be used by the police dealing with crime prevention, but also provide advice for parents. They could also be published in some of the forensic or police journals.
