Development (building) procedure and environmental protection

- 1 - Abstract The theme of the thesis is "Development (building) procedure and environmental protection". Between the aims of this theses belongs analysis of the construction proceeding according to Building act, further especially evaluation of contemporary legal adjustment environmental protection with connection to construction proceeding and disquisition about main instruments in environmental protection. The thesis deals with environmental impact assessment procedure, objections of the participants in construction proceeding, public participation in contruction proceeding and binding standpoints. The thesis is systematically composed of three chapters. The first chapter focuses on legal adjustment and main principles of environmental protection. Chapter two describes object, subjects and particular phases of construction proceeding foccused on building authority activities. The third chapter deals with particular instruments of environmental protection in construction proceeding. Finally, the thesis comprises a summary of contained conclusions.
Notifying and permitting development projects - a comparison of substantive and procedural regulation

This thesis deals with notifying and permitting structures. The aim of the thesis is to analyze the current legal regulation of regimes for the realization of structures, including outlining changes in connection with the amendment to the Act No. 183/2006 Coll., on Town and Country Planning and Building Code (Building Act), as amended, and to compare notification and permission regimes from both substantive and procedural law. The thesis is divided into an introductory chapter, eight chapters and a conclusion. The introductory chapter covers an introduction to the realization of structures and its position within building law. The first chapter provides a historical excursion into the legal development of building law and describes applicable legal regulation of building law in the Czech Republic. The second chapter deals with the selected fundamental concepts essential to the realization of structures. The third chapter concentrates on the organization of public administration in the area of notifying and permitting structures. The purpose of the fourth chapter is to provide an overview of the regimes for the realization of structures and their brief summary. Participants in administrative proceedings with emphasis on participation in proceedings conducted according to the Building Act The Master thesis deals with a topic of participants of administrative proceedings, in which participation in proceedings conducted according to the Building Act is strongly emphasized. The author chose this topic because the participants in proceedings are irreplaceable procedural parties of every administrative proceedings without their existence no administrative proceedings could be conducted, and therefore they form an integral part of administrative proceedings next to administrative authority. The meaning of statutory legal regulation is to guarantee participants in proceedings mutually equal position and rights to prove a claim sufficient in administrative proceedings. The thesis introduces contemporary interpretative and application conclusions altogether with their gradual development and it evaluates in which way these conclusions brought about solutions and in which way conversely there were disputable questions in consequence of these conclusions. The practical part focuses on specific example of building a house. The discussion is a summary of the positives and negatives of changes in current building law.
Real Estate Division - a Farmstead

The present diploma thesis ‘Practical Division of a Real Estate – Agricultural Farmstead‘ is concerned with actual division of an agricultural homestead in XXX, the district of Olomouc. Based on the local examination which has been performed and after analyzing documents acquired from the owners, conclusions were drawn as to the possibility of dividing the estate while adhering to the applicable regulations of the civil procedure, construction law, construction technology, operational technology and economy. Valid price guidelines were used to determine the price of the estate and a comparative price of the estate was also estimated. Both price levels were also determined for the individual parts established by the practical division of the estate. The thesis consists of two basic sections. The first section focuses on theory, explaining the problem of practical division of an estate and providing a description of work of a certified expert drawing up this type of expert opinion. The second section comprises a practical part, which contains the expert opinion on the actual division of the agricultural homestead in the town of XXX in the Olomouc district.

Implementation of buildings in the protected landscape area

The aim of this bachelor work is the characteristic of building controllegislation and issuance of building permit under the rules in the Building Act No. 183/2006 Coll., Effective from 1 1st 2007, supplemented by an amendment to the Building Act No. 350/2012 Coll., Valid from 1 1st 2013 and the characteristic of building controllegislation in an implementation of buildings in a protected landscape area and landscape character assessment under the Act on Nature and Landscape Protection No. 114/1992 Coll. This work presents a summary of the whole process of building permits. Much of the work is devoted to the selected protected landscape area and the specific requirements for the construction of the area, description of the protected landscape area administration and characterizing of the construction management in a particular case in the chosen area. Blanský les is the territory selected for this thesis.

The aim of thesis is the characteristic of bulding controllegislation under the old Bulding Act No. 50/1976 Coll., by later regulations, which expired on 31 12th 2006 and the new Bulding Act No. 183/2006 Coll., by later regulations, effective from 1 1st 2007th. In the main section ( section six) is the specific tesearch andanalysis. The autor have focused on a factual office bulding, including a practical example, the family house. Offences againstthe bulding code are included in the next section of the thesis. Comparison with the other EU Memeber States (Slovak Republic) was compared to the Bulding Act of the Czech Republic and Slovakai. The problem of bulding management passed in recent years, many significant changes. The leasing of this is the Construction Act ? Act No. 183/2006 Coll. Planning Building Code, which came into effect on 1 1st 2007th. The aim of this newregulation should be primarily simplify the construction procedure However, more detailed look at the many changes in the law at lest controversial, or even been to complicate the current process.
