Comparison of Czech and Slovak regulation of legal consequences of the dissolution of marriage The topic of the diploma thesis is the legal consequences of the dissolution of marriage. The consequences of the dissolution of marriage are examined in two legal regulations, Czech and Slovak, and at the same time compared. The individual ways of marriage dissolution are discussed on an ongoing basis. The work consists of an introduction, five chapters, which are further divided into subchapters, and a conclusion. The first chapter deals with the concept of marriage, its purpose, functions and obligations, and the rights arising from it. The second chapter deals with the historical development of the legal regulation of the dissolution of marriage. Both in the territory of today's Czech Republic and the territory of today's Slovak Republic, from the 18th century to the current legal status. It is not without interest that while for a long time the two legal regulations were separated from each other, ie they were completely different, a relatively long period of joint legal development followed, so that after the division of the Czechoslovakia the two legal regulations diverged again. Conceptually, it is divided into a historical part, a comparative part and a practical part, which includes a proposal for the legal regulation of consensual divorce in the Czech Republic, which is the focus of the thesis, with regard to the existing legal regulation in Act No. 89/2012 Coll., the Civil Code, as amended. In the historical part, the thesis deals with the development of matrimonial law with a focus on the legal regulation of divorce, both in ancient Rome and then in selected European states in the various stages of development from the early Middle Ages to the modern era. This period is characterised by a rigid legal system based on canon law. In these periods, the supervision of marriage and the family is in the hands of the Church. The property issues resultant from divorce in the Roman Empire Abstract This work deals with the topic of property relationships between married couples in relation to their divorce in the Roman world of the emperors. The main property issues at hand are dowry, property connections between the individual families and presents between the husband and wife. To understand the institutes involved properly, the work first presents the topic of marriage so that the reader may better understand the types of marriage, which naturally influence the divorce proceedings and their actual impact on the couple in question. The prerequisites of marriage are considered as well as the differences between marriage cum in manum conventione and marriage sine in manum conventione. Next, details of property relationships between married couples in times before divorce are discussed, especially as relates to the possible types of marriage. The topic of dowry, bridegift and gifts between spouses are contemplated. Family in Individual Stages of Divorce

The thesis deals with the current topic of families with children in the context of divorce. The objective of the thesis is to determine the social situation immediately after divorce. The thesis is divided into theoretical and practical parts. In the theoretical part I deal with the concept of family, its basic functions and typology of families. In the second chapter I focus on divorce, its phases and its predictors. In the third chapter, I describe social work with families in different phases of divorce and the services that can be utilized in this situation. Last but not least, we also discuss how children can be affected by divorce. The practical part includes research focused on the individual social situations of families in relation to divorce and the utilization of professional assistance. The research was realized using qualitative research methods and open coding of the conducted interview was used for the analysis. The semi-structured interview method was chosen for this research. The interview was built based on the professional knowledge presented in the theoretical part. The research sample consisted of parents who were in the situation immediately after divorce. Based on the conducted research, the research questions were answered, and the objective of the thesis was fulfilled. From the analysis and interpretation of the data, it was found out that situation of every individual is highly distinctive, but the social situation of each individual was influenced by the divorce, and everyone sought professional assistance in relation to the divorce.
Social Work with Children and Support for Children in the Event of Parental Divorce

Abstract This bachelor thesis deals with the methods used by social workers to work with children during their parents' divorce, as well as the provision of support for these children. Divorce is an incredibly stressful situation for children. During divorce proceedings, children can develop a range of psychological, social, and behavioural problems. Therefore, it is important to provide appropriate social support to these children during the divorce process. The aim of this bachelor thesis is to describe whether and how social workers from the Department of Social and Legal Protection of Children and social workers from non-profit organizations work with children whose parents are divorcing, as well as to identify the support that social workers can offer these children. A qualitative research approach was used, specifically the method of interviewing with semi-structured interviews. The interviews were conducted with social workers from the Department of Social and Legal Protection of Children at municipal offices with extended powers and with social workers from non-profit organizations working with children and families in the selected region. The collected data was analysed using the method of creating clusters.
Family therapy as a tool of help and intervention for parents of minor children in divorce proceedings

The debate on the repeal of the divorce law in 1974: a symptom of secularization in Italy?

In the context of secularization and the shaping of church-state relations in Italy, this diploma thesis deals with the legalization of divorce and referendum on its abolition in 1974. The aim of the thesis is to observe whether, in the debate on divorce, symptoms of secularization in Italy can be traced. Methodologically, this work is grounded in qualitative content analysis. The sources of this thesis are the journals of the three most prominent political parties of the period under study: the Communists (journal L'Unità), the Socialists (journal Avanti!) and the Christian Democrats (journal Il Popolo). The aim is to identify the thematic units, so-called topoi, within the selected articles, by applying the above-mentioned method. Selected topoi are subsequently subjected to analysis. In particular, the results of the analysis showed different conceptions of reality of the political parties. Thus, leading to the formation of two opposite camps during the referendum. On one hand, Christian Democrats, who based their conception mainly on the traditional Christian doctrine. And on the other hand, the Communists together with the Socialists, who defended the secular, pluralistic concept of state. Cochem practice from the point of view of social work with the family

The bachelor thesis is devoted to the Cochem practice within the framework of social work with families and its use in the South Bohemia Region. Cochem practice is a model that is used in the divorce process. It is designed to return parents to their parental competence by maintaining power over decision making. Most often, the Cochem practice is used by workers at the OSPOD, in non-profit organizations or by judges in court. The aim of this paper is to map the frequency of the use of cochem practice in the South Bohemia region. Furthermore, experiences with cochem practice were identified, along with opinions or barriers encountered in the process. The research was designed using a qualitative approach, which will consist of a survey method, a semi-structured interview technique. The sample was selected through purposive sampling from the staff at the OSPOD in the municipalities with extended jurisdiction. Subsequently, I used snowball sampling technique to obtain communication partners in the non-profit organizations. Results were processed using open coding and then grouped into categories. The results showed that several OSPODs had cochem practices in place with less adaptation to their context and resources. Judges and non-profit organizations work with these OSPODs to complement the model process. A few other OSPODs have elements in place that correspond to cochem practice and try to work with parents in this sense.
