Risk Analyse of the Expertising in the Czech Republic

This diploma thesis deals with risk mapping and investigation in the expert activity. To obtain further information, the questionnaire survey will be addressed to the experts from the Czech Republic as a supportive material of the diploma thesis. The part of the thesis will be focused on analysis and comparison of expert activity in neighbouring countries of the Czech Republic. The identified risks will evaluated based on the analysis of expert activity current state. The outcome of the thesis will be assessment of the situation in the Czech Republic and suggestions of measures leading to elimination of the risks as well as to reduction the occurrence probability or mitigating the impact of risks realization.
Processing of selected terminology at road accident analysis

The thesis deals with the terminology used in forensic engineering practice at the analysis of road accidents. It means defining the concepts describing specific expert research in the area of car accident analysis such as the option of evasive action and the possibility of preventing collision. Further on, the thesis focuses on the terminology used in areas closely related to analysis of road accidents namely dealing with cases of criminal activities in the field of motor vehicle insurance from an expert point of view. In this area, terms such as extent of the damage, character of the damage, correspondence of the damage and the technical acceptability of accident, are solved. These terms constitute a formal process that can serve as a tool for experts when dealing with such cases. In addition, selected terms from the technical-legal area, which the experts often encounter, are processed here. At the same time, there is no uniform approach to their evaluation from a technical perspective. Here, there is a possibility of setting the limits of a sudden change of speed and a sudden change of direction.
Comparative analysis of the use of methodologies for properties evaluation in Germany for expert practice in the Czech Republic

The subject of the dissertation is the analysis of conditions for the work of real estate appraisers in the Federal Republic of Germany in comparison with the conditions in the Czech Republic with the aim of finding suitable practices that could be used for the work of experts in the Czech Republic. The thesis also includes proposals for suitable measures that can contribute to the development of expert activities in the Czech Republic, focusing on solving problems related to the determination of the exchange value of immovable property. This analysis includes the analysis of real estate types that are subject to assessment in the given area, approaches to solving valuation problems, methods that are used in valuing immovable assets, entities that are authorized to submit expert opinions, as well as content requirements of expert opinions.
VALUATION METHODOLOGY PARTS AND ACCESSORIES OF ESTATES WITH EMPHASIS ON A DIFFERENCE BETWEEN EXTERNAL WORKS AND ENGINEERING STRUCTURE

The dissertation deals with problems in the valuation of parts and accessories of land with an emphasis on the difference between landscaping and engineering structure. Despite the existence of defined components and accessories immovable in the Civil Code in practice often appear doubts about whether in a particular case is still part of the real property, or whether it is already a matter of self. The work addresses this issue in detail only for roads, drainages and retaining walls. There were studied various laws and the earlier Court decisions. The Court judicature often solves problems of ownership determination. Can be seen as an example: Determining ownership of the rock, that is formed by hardening the land surface rocks and planting permanent crops. Whether the owner of the land owner or the person who built it. Likewise, there are disputes to determine ownership of utility connections, ownership structures, which are kept below the surface of the land. Based on the new Civil Code no. 89/2012 Coll. there has been extensive changes in the field of things and their allocation. There is a new concept existing, instead of the current concept of property. There is existing a new concept called Real property. A very important change is that the engineering structures are parts of the land, but based on the § 509 utilities, especially water, sewer or power lines or other, are not parts of the land. It is believed that parts of the utilities are also buildings and technical equipment that is connected to them operationally. Also important is the § 3055 para. (1): Engineering structure which is connected to the ground with a solid foundation, which is under the existing legislation part of the land on which it is established, and the effective date of this Act, owned by a person different from the owner of the land, and the bottom the entry into force of this Act does not become part of the land and immovable property. The same applies to the building, which is co-owned, if one of the joint owners and the owner of the land or if they are just some of venturers building co-owners of the land. The author presents the general specifics valuation external works and civil engineering in selected cases and the valuation of construction law. Work includes a chronological overview of valuation rules.
Project of Uniform Education System for Expert Activities

Particular parts of the project 'Uniform Education System for Expert Activities' are listed and described in this dissertation. Legal approaches to the issue of expert activities in selected European countries were mapped on the basis of researches. The fact that the current legal regulation of expert activities in the Czech Republic does not include the obligation of the lifelong learning of experts, does not specify the ways and forms of verifying of qualification requirements before appointing to the office, and also does not provide for the further educating after the registering on the list of experts, is seen as a problematic situation. The suggested system is divided in two basic parts: before registering the expert on the list of experts, focusing on the qualification requirements and the way of their verification by administrative authorities, and after appointing to the office and registering to the central list of experts, focusing on lifelong learning during the whole time of practising of the profession, as well as on the form and content. Some basic methods of sociological survey (especially introductory seminars and questionnaire surveys) were used as the information source. These dates were evaluated and applicable conclusions were compiled and integrated into in more detail described components parts of the suggested education system, in which also the already existing training courses and workshops were taken in consideration. For the purpose of regular verifying of expert's professional qualification, a credit system was developed, as well as the periodicity of verifying of the expert's professional qualification and the form of record keeping in the Index of Expert's Professionalism.

This diploma thesis deals with basic questions of expert activities and a more detailed focus on issues coming up in relation to practical expert activities working out expert opinions, especially obtaining materials from executive bodies, authorities, partaking parties or the ordering party. This thesis consists of a questionnaire construction containing expert opinion by professional witnesses, of an analysis of the current legislation and consequent suggested options how to deal with the given issues.
Aspects affecting the price of the pond

This thesis deals with the measurement of ponds and influencing aspects that may play a role in the valuation of ponds. In the first part of the thesis, the author discusses the basic concepts and issues that are necessary for the valuation of the pond. In the second part of the thesis is stated as a specific example of a pond situated on three pozemcíchy using the cost method of valuation in accordance with Decree successive steps and for comparing valuation program ABN14.
Analysis of the Requirements of International Valuation Standards IVS and Their Application in a Property Assessment Report

The motivation to this master`s thesis is an increasing demand on evaluation of expertise report in conformity with requirements of internationally accepted standards as well as with national legal regulations. This master`s thesis is focused on defining of requirements of International Valuation Standards – IVS. The objective of the introductory study of this thesis is an effort to provide overview of the structure, the history and development of International Valuation Standards – IVS. The introductory study points out that the IVS standard is not stationary one, but shows the importance to keep the continuous track and analyze other possible information sources in connection to it. The main objective is to analyze the principal requirements of International Valuation Standards for expert as a person, expertise activity and required features of expertise report. The gained information is processed on the base of an expertise system approach, where the expertise is interpreted as a structured object with principal features: expertise object, expertise problem, expertise activity, expertise report and expert. Established findings are then analyzed regarding to such interpreted system approach of expertise and applied in the determination of type of approach which an expert should follow in the procedure of making out an expertise report of property valuation. Finally, an example expertise report for valuation of real estate is compiled. Such expertise report could be considered in conformity with national legal regulation as well as with requirements of International Valuation Standards – IVS. The expertise report is a practical example of findings of this master`s thesis.
The Modelling of The Development of The Middle-Size Building Enterprise Value in The Real Competition of The Czech Republic

The dissertation thesis is elaborated to the theme “The Modelling of The Development of The Middle-Size Building Enterprise Value in The Real Competition of The Czech Republic“. In the introduction of the dissertation thesis, a relation of the chosen theme to the branch of Forensic Engineering is defined and a survey about a contemporary state of the solved problems is elaborated. Further on, the objectives of the dissertation thesis are stated there namely including a formulation of a problem. The dissertation thesis contains the basic data about the examined middle-size building enterprise of a regional significance and its competitive building enterprises. At all enterprises, a property evaluation by an assessment of a substantial value and a returns’ evaluation by a method DCF Entity are carried out. The component of the dissertation thesis is a proposal of a simple expert standard containing methodical recommendations at an assessment of a value of a building enterprise of a regional significance. This is the essential contribution of the dissertation thesis for the branch Forensic Engineering whose starting ascertainments are practical pieces of knowledge and experience with the behaviours of the middle-size building enterprises in a period of a financial crisis.
Valuation of real estate for bank purposes

The thesis is focused on analyzing the general practice appraiser or expert in the valuation of property for purposes of bank. Domestic banks for their own purposes require an estimate of a normal price. According to established procedures were estimated normal price of administrative building, located in the statutory city Havirov. To determine a normal price has been used three methods - cost method or material value, the comparison method and the yield method.
