The UN Security Council Measures in the Fight against Terrorism from the Perspective of the European Human Rights Protection

In the present doctoral (rigorosum) thesis, the author deals with the assessment of counter-terrorism measures adopted by the UN Security Council from the perspective human rights guarantees provided by European Union law. The aim of the analyzed measures is the freezing of financial and economical assets belonging to natural persons and corporate entities which are connected to the commission of terrorist acts or are suspected thereof. This type of measures represents one of the global instruments in the fight against international terrorism. In order to place the issue in its broader context, the author first deals with the definition of terrorism. Afterwards he analyzes the position of the UN Security Council with accents on the binding nature of its resolutions under Chapter VII of the UN Charter and the possibility of (judicial) review of these legal instruments. The author then introduces the functioning of sanctions regimes adopted pursuant to UN Security Council resolutions 1267 (1999) and 1373 (2001) both in the relevant UN bodies and in the European Union as well, while special attention is paid to the legal basis of regulations introducing the sanctions system to the realm of EU law. Unstoppable development in every area of life which brings an innovative methods, implements and forms has been an inherent part of the evolution of society for a long time now. Accordingly, the field of international judicial cooperation in criminal matters with phased pressure on the integrating procedures within the framework of the European Union, with the development of international relations between the Member States, and with increased rate of criminal activity exceeding the implementation of free movement of persons within the European Union has been made to reflect introduction of new mechanisms. The main task of such mechanisms is repressing organised crime and cross-border criminal activities, and also protection of fundamental rights of individuals who are suspected of commiting an offence. One of these mechanisms is the European arrest warrant, relatively new legal instrument to which is my diploma work devoted to. Evaluation of the results of the campaign Counter Terror with Justice - Obama and his broken promise

On the particular example of the US new motto of the foreign policy after 9/11 --War on Terror I am trying to refer to the work of the non-profit organization Amnesty International in the field of the international relations. I am pointing out its importance in the decision-making process of the political elites. My intention is to find the correlation between the persuasion of the American population in relation to its leadership or leaders based on the expressed promises in the election campaign. As the object of my work I have chosen the current US President - Barack Obama whose one of his five main promises declared in the campaign was to defeat the terrorism, detain and adequately punish the masterminds of attacks from the September 2001 for the committed crimes. This point comprises the significant change from the approach of his predecessor and so the closure of the Guantanamo military base as a symbol of modern torture and denial of human rights which serves as a detention camp for the suspects of terrorism for more than 14 years now. This was a daring commitment but he gained millions of supporters thanks to it. This option comprised the expectations of sophisticated solutions for tens of substantial issues, including meeting the objective of punishment of the terrorists and establishment of deterrent precedent for any other similar attempts. Obama failed to accomplish it.
Conflict minerals and the Democratic Republic of Congo

As already the title of the diploma thesis is saying " Conflict minerals and the Democratic republic of Congo" aims at discussing issues around conflict minerals produced in DRC, including illicit trade, exports, smuggling minerals from DRC and committing crimes such as human rights abuses including rapes, sexual violence, executions, forced recruitment, abduction, child work etc. The militarisation mostly in eastern parts of the country leads to escalated conflict, in which rebel groups are warring in order to obtain power and control over rich natural resources in country. Long lasting conflicts, insecurity in the country, failed governance, wide-spread corruption, illegal exploitation of natural resources and of miners as well have reach the level of poverty, economic weakness, as well as political inability to lead the country and control its own natural wealth and prevent from any kind of foreign touch, mostly by armed or rebel groups. This thesis presents measures, which have to be taken in order to mitigate rebel groups power in the country, enhance transparency, remove corruption and exercise due diligence for responsible supply chain and thus strengthen economic and political development as well as human right
Non-governmental organization Amnesty International and its influence on the international relations - the case study Counter Terror with Justice

The case study deals with one of the most famous and successful non-governmental organizations - Amnesty International. The case study consists of three parts - the first chapter, which is focused on the theoretical approaches to the issue of NGOs and human rights and on the by organization used strategies in the effort to reach its goals. In the second chapter I describe the organization, the period of its establishment, progressive development, extending of the agenda and also of the member base, strengthening of the legitimacy in the society. In the third chapter I use up the theoretical knowledge from the first two chapters applicated into practice. The purpose of my work is to sum up the usage and the effectiveness of the studied strategies demonstrated on the campaign Counter Terror with Justice.
