Criminal Proceedings in the news coverage of ČTK
Kuchař, Roman ; Trunečková, Ludmila (advisor) ; Šmíd, Milan (referee)
The Czech News Agency (ČTK) is a media institution that collects, processes and provides its customers with information on domestic and foreign events. It represents an important source of information (not only) for other media. However, trying to provide prompt information on interesting events may lead to inaccuracies and excessive simplification, especially in areas where there is a specialised element. One of them is criminal proceedings, which take place within the limits set by law. Therefore, this diploma thesis aims to map the form of criminal proceedings taking place before the Czech courts, as depicted in the ČTK news, and possibly to draw attention to their shortcomings in terms of legal standards and ČTK's ethical rules. The diploma thesis is divided into five basic parts. The introductory part briefly describes the concept of criminal proceedings, its course, selected basic principles and terminology. The following part outlines the importance of news for criminal proceedings (public control over the lawfulness of the criminal proceedings) and the boundaries between protecting freedom of speech on the media's part and the personal rights of prosecuted people and the victims. ČTK, its legal status and structure, ethical rules (ČTK Code) and a text report as a basic research unit of...
Entering into a public contract
Kuchař, Roman ; Horáček, Tomáš (advisor) ; Elek, Štefan (referee)
Awarding a public contract pursuant to Act No 134/2016 Coll., on public procurement, is aimed at creating a specific obligatory relationship between a contracting authority and a selected contractor, essentially on the basis of a previous tender procedure, unless the law specifies otherwise in the given case. The tender procedure is a special arrangement for the pre-contracting and contracting process, which takes place in a binding, legally defined procedure differing from an ordinary private-law contract, even though it is also a private-law procedure according to the predominant doctrinal and case law opinion. The topic of this diploma thesis is an analysis of the specifics of the contract process leading to the conclusion of a public contract, in order to draw attention to its similarities and also to the differences when compared to general private-law contracting. The thesis is divided into three parts, the first of which, primarily deals with the Act No 134/2016 Coll., on public procurement, its classification in systemic law, its relation to the EU public procurement regulation, the nature of tender procedure (specifically open procedure) and the public contract. The key charter is then dedicated to the award of a public contract, followed by the last section on changes to already concluded...
Masaryk's concept of democracy
Kuchař, Roman ; Šimsa, Martin (advisor) ; Franěk, Jakub (referee)
This bachelor's thesis is focused on normative concept of democracy which we encounter in the thoughts of Tomas Garrigue Masaryk, significant figure of the Czech history in the areas of social (political) life and science. The objective of the thesis is to capture as accurately as possible Masaryk's idea of democracy as a certain synthesis of moral and political opinion (conviction) of the author. This concept is further illustrated through his critical interpretation by personalities following up the tradition of Czech philosophical humanism and by insertion in the context of chosen theories of democracy. The implementation of the said objective will lead to clarifying values, offering answer to ever existing question concerning crisis of modern people. Although Masaryk's solution is highly normative and outdated in many aspects presently, it is one of the few really elaborated proposals presented in the question concerning crisis of modern people. This thesis puts forth the opinion that Masaryk's concept of democracy is still inspirational, although it requires updating based on historical experience of the last century.
