OLAF vs. GRECO - Fight against corruption in Europe

The thesis deals with the problematic around the fight against corruption in Europe. Specifically it focuses on two organizations: OLAF and GRECO. The aim of this thesis is to determine how intensively these two organizations have contributed in the fight against corruption in Europe. Historical description, analysis of institutional settings and comparative analysis were used as methods for the solution. The sub-questions, which focused on the organizational structure, the opportunity to influence the investigation, the possibility of setting up anti-corruption policies in Europe and the opportunity to influence the legislation in its Member States, helped to answer the main question. Carrying out this comparison, it was found that although OLAF can conduct its own investigation of financial fraud, it has not got the ability to set up anti-corruption policies in Europe, neither has it got the possibility to influence the legislation in its Member States. In contrast, GRECO does not investigate financial fraud, but it may, to some degree, have influence on setting up the anti-corruption policies in Europe. GRECO also has the power to influence the legislation of its Member States. The conclusion of this work delivers a report on the status and capability to fight against corruption in Europe (from an EU and European Council perspective). It also provides material about the work of OLAF and GRECO in the Czech language.

From the foregoing sources we may summarize that most of the analyzed countries allow wiretapping of MPs under the same conditions as other citizens (how the police intercepts so the intelligence ones). Only in limited number of countries the parliamentary immunity covers wiretapping. In that case there is necessary to obtain approval for wiretapping of an MP of some authority of Parliament. In a few countries, the interception of MPs has special regime. The permission must be approved by the specific body (court) other than the parliamentary chamber, however, different from the authority that permits the wiretapping of other citizens. Regarding the supervisory authority of wiretapping, most states have no such parliamentary body. Mostly post-socialist states have some parliamentary supervisory body dealing with wiretapping of secret services (committee).

Solution of the conflict between the representatives of executive power in a semi-presidential system: the case of Finland

The thesis deals with the transfer of powers within the executive of the Finnish president to the Prime Minister. Its aim is to analyze the gradual change in distribution of powers which at the same time entails the transition from the semi-presidential system to parliamentarism. It also aims to find out what were the causes of these changes. The thesis should confirm that Finland can already be considered a pure parliamentary system. It focuses on the practical performance of foreign policy which is often a subject of disputes between the representatives of the executive. The aim is to find out whether the Finnish policy implemented within the European Union is at the level of domestic or foreign policy. The first part is devoted to the very concept of the semi-presidential system, its origin and different theoretical views of political scientists who have dealt with this issue. The following part deals with the characteristics of semi-presidential system in Finland and describes the process of changing the role of the president. The last chapter analyzes the constitutional amendments and the new constitution. It compares the powers assigned to the head of the state and to the Prime Minister according to the old constitution and the new one.
