89 Abstract The topic of the thesis concerns Czech nuclear law. Nuclear law can be defined as a set of special legal norms adjusting the terms of the nuclear energy and ionizing radiation usage, protection of population and environment against ionizing radiation, radiation accidents solving and treatment of radioactive waste. As such, nuclear law fully adjust the behaviour of all the natural and legal persons who are concerned with activities connected to the nuclear materials, ionizing radiation and natural resources of ionizing radiation. The field of nuclear law is closely connected to the branches of science dealing with the nuclear energy and ionizing radiation usage; therefore, the factual issues of which at least the fundamental knowledge is necessary for the understanding of nuclear law are given space at the beginning of the thesis. In its provisions, Czech nuclear law adjustment also reflect a number of international treaties and European Union regulations. On account of this, the next part of the thesis deals briefly with the international and European nuclear law adjustment. Important international organizations of the field are mentioned as well. The topic of this diploma thesis is Czech Nuclear Law. The nuclear law is a set of legal norms concerned with the ways and conditions of usage of nuclear energy and ionising radiation, the systems used to protect people and the environment against the damaging effects of ionising radiation, protocols to be followed in the case of accidents, radioactive waste disposal as well as the role of the state administration in supervising usage of nuclear energy and ionising radiation. A short historical review of the usage of nuclear energy and ionising radiation is followed by 2 chapters dedicated to international and EU nuclear law. The aims and content of international and EU collaboration concerning non-military usage of nuclear energy and ionising radiation are defined in these chapters. The other chapters of this thesis are concerned with Czech Nuclear Law. The constitutional foundation of this Law is described as well as nuclear law as a legal subject and the rules forming the base of Czech Nuclear Law. Role of civil associations in environmental protection ABSTARCT (Zusammenfassung) Das Ziel dieser Arbeit ist die Rolle eingetragenen Vereinen im Umweltschutz zu definieren. Eingetragene Vereine sind sog. Non-Profit-Organisationen, die das öffentliche Interesse am Schutz der Umwelt durchsetzen. Um diese Schlüsselfunktion zu erfüllen, müssen die Vereine als gleichberechtigter Partner der Staatsverwaltung betrachten werden. Ihre Hauptaufgaben umfassen vor allem praktische Naturschutz, Bildung und Aufklärung der Öffentlichkeit, Teilnahme an der Gesetzgebung des Umweltrechts als auch die Beteiligung an Entscheidungsverfahren in Umweltangelegenheiten. Alle oben genannten Aufgaben eingetragenen Vereinen im Umweltschutz gehören zum wichtigen Teil der Entwicklung offenen, und demokratischen Gesellschaft. Selected issues of legal regulation of the environmental impact assessment

The subject of this dissertation are selected issues of legal regulation of the environmental impact assessment. The dissertation aims to assess the legislation from the viewpoint of efficiency of an environmental protection against the negative impacts of projects on the environment and public health. The dissertation is divided into four chapters further divided into subchapters. The first two chapters are focused on a development of an EIA institute since its start, as well as international, European subsequently Czech incorporation into legislation. The third chapter examines the term of subsequent procedure as a fundamental condition for defining the set of rights and obligations in the proceedings in which projects should be allowed. The last chapter is a comprehensive overview of the various forms of public participation and opportunities for the public to enforce their interests in the assessment of the effects of projects on the environment.
Land ownership restrictions and environmental protection

The topic of this diploma thesis has got an interdisciplinary character, which results from a conflict of property right and ecological rights. The crucial point is the internal and external ownership restriction differentiation. This gives the answer to the question whether a compensation for restriction is provided or not. The thesis deals with legal reasons of the restrictions that arise from the specific character of land and also with the typology of restrictions according to its establishment. Selected restrictions regulated by particular environmental laws and the Building Code are analysed in the main part of the thesis. The conclusion points out the imperfections of legislation and provides possible solutions as well.
Legal aspects of gold mining and its influence on the environment

The aim of the diploma thesis is the description and analysis of legal aspects of gold mining. The thesis is divided into 7 chapters including the introduction and the conclusion. The second chapter provides the elementary overview of the characteristics of gold, its extraction and gold ore processing methods. The third chapter deals with the sources of legal regulation of mining and reminds the historical development of this legal branch. The fourth chapter is in detail concerned with individual phases of the reserved minerals mining. The fifth chapter introduces the main impacts of gold mining and mineral raw material extraction respectively on the environment and people. The sixth chapter analyzes basic legal instruments of environmental protection exercised in mining, focuses on their application and deals with their suitability. The conclusion of this thesis is focused on evaluation of topics discussed in previous chapters, primarily summarizes particular aspects of gold mining and problematics of legal regulation of mining and environmental protection used in this field. The thesis deals with the protection of land ownership rights against unlawful interference. The aim of the thesis is to present and analyze interference with land ownership and outline means of protection against unlawful interference. This thesis pays attention to new Civil Code and comparison with current regulation. Thesis also includes relevant decisions issued by the Supreme Court, the Supreme Administrative Court and the Constitutional Court of the Czech Republic with regard to protection of land ownership. The thesis is composed of three main parts. The first part is introductory and defines basic terminology used in the thesis. This part describes land ownership and its specific features. The following part describes and anylyzes what is meant by interference with land ownership. This part ilustrates interference allowed or recognized by law and unlawful interference. The interference with land ownership can be caused by public authority or by other people. This part also explores interference with land ownership within neighbour relations. The protection of landscape in the law This thesis deals with the legal protection of landscape, focusing on its general protection, i.e., the protection of the landscape outside built-up areas excluding its special protected parts. The main aim of the submitted thesis is to present the basic overview on legal institutes that are provided by the substantial law in force for general landscape protection and, moreover, to describe the most significant ones in detail. The thesis is divided into three chapters, each of them devoted to the study of various aspects of the issue under investigation. In the introductory chapter, general grounds of the landscape protection are described. It is subdivided into three parts. The first part attempts to give a precise meaning to the term "landscape". Further, the historical development of legal landscape protection is outlined in the second part. Finally, the third part deals with the significance of landscape, factors affected its current state, and reasons for its protection. Protection of the environment during mining activities

This Master thesis deals with the issue of enviromental protection in mining. Mining has negative on impacts on the environment and the goal of law on this field should be the minimalisation of these negative impacts. This master thesis offers a complex overview of issues brought about in mining from the initial stage of exploration and prospecting to its final stage of reclamation. First and second chapter of this thesis give a brief overview of mining issues and state aims of this thesis. Third chapter deals with the environmental protection in the stage of exploration and prospecting, fourth and fifth chapter allow an insight into delianation and mine opening procedures. Sixth chapter deals with mining itself and environmental protection during this process. Seventh chapter adresses reclamations and mine closures. Last chapter is conclusion.

Thesis title: Legal regulation of the use of alternative energy resources The goal of the paper is to analyze the legal regulation of the use of alternative energy sources and to provide a summary and logical overview of this matter that is closely related to environment and climate protection. The greenhouse effect is frequent topic of current debates regarding the climate changes that lead the international communities to decision on limitation of greenhouse gases emissions by using among others renewable energy sources. The reason for my research is a long-term interest in renewable energy sources. The thesis is composed of seven chapters, each of them dealing with different aspects of promotion of the use of alternative energy sources. Chapter One is introductory and provides the overview of the research topic. Chapter Two explains the term alternative energy sources and its relation to renewable energy sources.
