The Permissibility of concurrent Existence of a Foreign Nationality and the Czech Nationality According to the Czech Legal Rules

The paper includes a commented summary of development of the Czech legal regulation of state nationality from 1811 to 2010. Special emphasis is placed on permissibility of legal existence of foreign nationality beside the Czech nationality according to legal regulation applicable in the territory of the Czech countries in the respective historic eras (during the Austro-Hungarian monarchy, during the First Republic, under the communist regime and after the year 1990). The paper also includes an overview of general issues of state and dual nationality. The main output is listing the situations in which the existence of dual nationality according to the current legal regulation is permissible and legal.

1 Abstract Spread of International Law into Decision-Making Practice of Domestic Authorities In principle international law does not impose its subjects how to achieve compliance with its international legal obligations within their jurisdiction. However, for the effectiveness of international law in each country it is the approach of legislative, executive and judiciary authorities to international obligations that is vital. The thesis focuses mainly on the judiciary, while the issues of international law application by the domestic courts have not yet been at full length described. Part One is an introduction which describes the subject of the work methodology and terminology used in its processing. The first main aim of the thesis was to examine in detail legal rules for the application of international law as they result from both constitutional and ordinary law. These rules constitute a framework within which institutions applying international law deal with it. The third part of the thesis is mainly dedicated to fulfilment of the first main aim, it is entitled The Current Application of International Law by National Authorities of the Independent Czech Republic and the Development of this Legislation. The term "investor" in international investment agreements The aim of this thesis is to explain, compare and evaluate the meaning of investor as one of the key terms used in the area of international investment protection. From a systematic point of view, international investment activities are governed by international economic law, which is a sub-discipline of public international law. Foreign investment as a transfer of assets from one country to another in order to generate wealth is a kind of activity known and done since the era of colonialism or even before. The subjects carrying out these operations are called investors. However the framework of international investment protection as we know it today started out when the so called bilateral investment treaties (BITs) became commonly used to protect and promote international investing. These treaties entered into by states as sovereign members of the international community stipulated conditions to protect each other's investors in order to stimulate the flow of free capital over the borders. International dispute resolution in sports Key words: international sports law, dispute resolution, CAS Abstract The purpose of this thesis is to analyze the mechanisms of dispute resolution in sports. After the introductory first chapter which deals with definitions of basic concepts such as sport in general or sports law, the thesis focuses on international aspects of sports law. The second chapter is concerned with essential issues of international sports law, particularly with the legitimacy of nongovernmental sports federations in the realm of the international legal order, nature of sports regulations, subjects of international sports law and the most important international legal documents. The third chapter describes the structure of international sports federations on the example of the International Olympic Committee (IOC). Special attention is dedicated to the discussion of international legal personality of the IOC and also to the character of the Olympic Charter, which is a crucial international document in the area of sports. Závěr Na závěr bych shrnul obsah a výsledky mé práce. Do první části této práce jsem zařadil kapitolu, která pojednává o situaci, která panovala po mnichovském diktátu, o jeho následcích a která následně vyvrcholila obsazením českých zemí a zřízení Protektorátu Čechy a Morava. V této části jsem se pokusil shrnout nejen historické okolnosti, které předcházely okupaci, ale zvláště vyložit a rozebrat základní právní normu, na základě které byl Protektorát zřízen, kterou byl Výnos Vůdce a říšského kancléře ze dne 16. března 1939 o Protektorátu Čechy a Morava, a její dopad na český právní řád. V následující kapitole jsem pojednal obecně o perzekuci, o jejích druzích, formách a na uvedených příkladech ukázal, jakým způsobem se tyto druhy a formy často prolínají. Ve zbývajících kapitolách jsem se zaměřil na určité odvětví perzekuce, mezi které jsem zařadil trestní perzekuci obyvatel Protektorátu, hospodářskou perzekuci na území českých zemí a perzekuci Židovského obyvatelstva ve vztahu ke konfiskaci jejich majetku nacisty na území Protektorátu. Snažil jsem se zkompletovat a popsat nejvýznamnější nejenom právní formy a prostředky perzekuce obyvatel Protektorátu, ale zejména jejich důsledky a dopady, které měly na obyvatelstvo českých zemí. Student: Marek Čermák Thesis on the topic of diplomatic protection deals with the granting of exercise of diplomatic protection by the states and is divided into seven chapters which follow each other. The first chapter describes the diplomatic protection and its historical foundations. The second chapter focuses on the possibility of exercise of diplomatic protection in respect of natural persons and the conditions that need to be fulfilled for the posibility of exercise of such protection. The third chapter focuses on the exercise of diplomatic protection in respect of legal persons and the conditions that must be fulfilled for the posibility of exercise of such protection. The fourth chapter describes the internationally accepted rule of exhaustion of local remedies, as well as exceptions to this rule. The fifth chapter describes the procedures of states where is no exercise of diplomatic protection, but enforcement of protection granted on other grounds. The sixth chapter deals with the procedures of states which are different from the rules of international law. And the seventh chapter describes the procedure of states in situation of granting diplomatic protection.

The climate protection under international law Key words: international climatic law, United Nations Framework Convention on Climate Change, Kyoto Protocol Abstract The purpose of the thesis is to analyze the system of climate protection in international law. In the thesis, there is described the history of the part of international law concerning climate changes, the contemporary international climatic law itself, and some of the most serious problems concerning the topic. The reason for my research is to introduce the basic system of international climatic law, as well as to show how modern international law is created. The thesis is divided into five chapters. The first chapter describes the international climatic law as a part of the international environmental law, shows the forms of treaties used in the international environmental law and presents the reasons why the form of framework convention was used in the case of international climatic law. The second chapter analyzes the history and evolution of international climatic law. From the first political declaration to the most recent international conventions, the most important milestones of the development of the international climatic law are shown.
