Impact of European Legislation in Migration Flows across EU borders

This work outlines issues related to migratory policy in the European Union. The aim o f the work is to determine whether or not the European Union has been successful in reducing the push factors that lead to migratory flows. This work outline the historical situation o f migration in Europe from early post war migrations o f guest workers to the imposition o f restrictive policies intended to reduce migratory flows. General theories related to migration are discussed as are some o f the problems associated with migration policy formation. The complexity o f policy formation is exhibited by the variety o f restrictive policies implemented in differing member states due to voter opinion and economic factors. Restrictive policies imposed on third country nationals are shown to be ineffectual in reducing migratory flows. The paper ends with suggestions on how the European Union can become more effective in reducing the push factors leading to migration. Key words: Migration, Migration Policy. Disertační práce "Did It Really Happen? Testimonies before The International Criminal Tribunals and in Refugee Status Determination" si klade za cíl napomoci vytvořit nová doporučení týkající se spravedlivého a konzistentního hodnocení důkazů v řízení o postavení uprchlíka. Správná interpretace a účinné použití těchto principů může posílit místní důvěru, stejně jako celosvětovou, v režim jejich mezinárodní ochrany. Zdá se, že zásadně relevantním pro uprchlické případy je rámec, ve kterém jsou hodnoceny svědecké výpovědi před dvěma ad hoc mezinárodními trestními tribunály - Mezinárodním trestním tribunálem pro bývalou Jugoslávii a Mezinárodním trestním tribunálem pro Rwandu. Rozsudky jejich soudních komor často obsahují vnitřně soudržný a zřetelný popis způsobu, jak nakládat s důkazními pravidly a jak je interpretovat, jejich metoda je dále obecně schvalována odvolací komorou. Kromě poskytnutí základního vhledu do problematiky zmíněných tribunálů a stručného přehledu jejich důkazní praxe, popisuje tato práce hlavní aspekty řízení o postavení uprchlíka a upozorňuje na vybrané výzvy, kterým v souvislosti s důkazní praxí čelí ti, jež rozhodují o jejich postavení, a naznačuje, jaké společné rysy má řízení o postavení uprchlíka a řízení před mezinárodními trestními tribunály. The practice of trafficking has many different facets; drug trafficking, arms trafficking and human trafficking complete the top three illegal trafficking practices today. Human trafficking may be the third highest illegal trafficking practice, however there is inadequate mainstream information on the affects of the trade and horrifying issues that incorporate trafficking in human beings. This paper will discuss how the globalized world has been enabling trafficking in human beings with a concentration on South Eastern Europe. In the future this hopefully will not be a pressing issue that needs to researched and discussed but until then raising awareness and education is the best solution in combating human trafficking. In today's time trafficking of women for sexual exploitation is rapidly growing in South Eastern Europe and is known to be in the fourth wave.160 Trafficking affects almost every country in the world and is significantly higher during different periods of history. Constructive Engagement or Illegal Investment?

This thesis examines the role of transnational corporations in preventing human rights abuse and conflict, along with the limits to proactive strategies and engagement with host governments. It concludes by applying these principles in a case study: the oil and gas industry in Burma. The issue is approached both practically and theoretically from economic, legal and political approaches. In some cases it is possible for companies to avoid or mitigate risks by adopting proactive strategies that might included training and community development programs. A firm that recognizes these issues and adopts a socially responsible strategy may justify their presence in a given country based on the overall effect it has, despite some negative consequences, such as financing a corrupt regime. Furthermore, it can be assumed in many cases that a firm that withdraws will quickly be replaced by another firm, which may be less sensitive to these concerns. Based on these grounds, a company might argue that their presence in a country where the government does not respect human rights represents constructive engagement with the host country's regime. This paper outlines the emergence and development of the 'external dimension' of EU policy on immigration and asylum. The external dimension is expected to become of more importance in future years and was recently given a new impetus within the 2004 Hague Programme. Three areas of policy are focused upon in this paper: exporting border controls and readmission agreements, return (and circular) migration and repatriation, and 'protection in the region' (Regional Protection Programmes). The ultimate aim is to ask how policies to reduce unwanted migration into the EU are changing, and whether they can, and are likely, to be reconciled with policies that will benefit developing countries and migrants themselves.
