Selected issues of inheritance law according to Act No. 141/1950 Coll., Civil Code, in comparasion with recent legislation Abstract The thesis deals with selected issues of inheritance law according to Act No. 141/1950 Coll., Civil Code (hereinafter referred to as "CC 1950"), and compares them with the current legislation. The Civil Code 1950, which came into force on 1 January 1951, significantly reformed the form of the existing (then) inheritance law, excluding a number of legal institutes from the legal system in order to simplify the legal regulation. For example, the legal institutes of the contract of inheritance, fideicommissary substitution, donation mortis causa, codicil, etc. were abandoned. The current legal regulation, i.e. Act No. 89/2012 Coll., the Civil Code (hereinafter referred to as the "CC 2012"), which is partly inspired by the General Civil Code promulgated by Imperial Patent No. 946/1811 Coll., restores some of the previously abandoned legal institutes. It must be admitted, however, that in some essential matters of inheritance law the recent legislation also follows the tradition established by the CC 1950, in particular as regards the issue of the moment of transfer of rights and obligations from the testator to the heirs. The Historical Form of the Right to War from the Perspective of Selected Medieval and Early Modern Philosophers Abstract The thesis discusses the concept of just war with a focus on the right to initiate war (ius ad bellum) in medieval and early modern Europe and compares the concept depicted in philosophical works with legal documents of the time and with sources of legal knowledge. The concept of just war is an important legal and philosophical institution that underlies the emergence of the contemporary concept of the law of war and has made a significant contribution to the development of public international law. This thesis provides a detailed analysis and interpretation of relevant passages in the works of Thomas Aquinas and Hugo Grotius that relate to the institution of the right to war. Here the distinctive elements of each conception are also highlighted, in particular by means of identifying the criteria for judging the justness of the commencement of war. Emphasis is also placed on individual conceptions of sovereign power and the integration of passages into the broader context of the works of both authors. 81 Political trials of the 1950s - a concrete case study (The Babice Case) Abstract The subject of the thesis "Political Trials of the 1950s - a Specific Case Study", subtitled The Babice Case, was a description of the application of the general tools of political persecution used in the Czechoslovak Republic in the 1950s to the specific case of the shooting at the Babice school and the subsequent political trials. Also significant is the aim of placing the political trials in Czechoslovakia in the context of the times and the international political situation, which played an important role in the Babice case. The first chapter of the thesis formulates the aims of the thesis and the background on which it is based. The second chapter of the thesis describes the significance of the political processes and the general background of their organisation. An important part of Chapter 2 of the thesis is a description of the legal framework for the conduct of political trials, focusing both on substantive aspects, such as the newly defined offences, and on procedural issues, especially the limitations on the rights of the accused. An attempt to newly codify civil law in Czechoslovakia before the Second World War This master's thesis explores the attempt to create a new codification of civil law in the Czechoslovak Republic before World War II. First and foremost, the thesis provides an overview of the historical context, serving as the foundation for the reformation of civil law. It does so by examining the existing regulations of civil law in Cisleithania and Transleithania, including their progressive amendments. From the outset, the thesis attempts to outline the willingness, or rather openness, of the legal community to potential changes, primarily within the ABGB. Emphasis is placed on the need to unify regulations in the newly formed republic, which faced various civil law regulations, known as legal dualism or trialism. It was equally essential to adapt civil law to modern societal and economic needs. Furthermore, the thesis explores various possible forms of codification and legal unification, ranging from a mild revision of the ABGB to the creation of an entirely new legal code. The Third Czechoslovak Republic Period in the Context of International Contracts and International Politics This thesis titled "The Third Czechoslovak Republic Period in the Context of International Contracts and International Politics" is divided into a total of five chapters. In the first chapter, or rather in its theoretical part, the author first defines the observed period of 1938-1948 and then defines the legal institutes with which he works in the thesis. In the second chapter of the thesis, the author describes the period of the so-called Second Republic and its political development. In the third chapter of the diploma thesis, the author describes the activities of the Czechoslovak authorities in foreign exile. In this chapter, he discusses the steps of the foreign resistance directing the Czechoslovak government in exile and the process leading to the denunciation of the Munich Agreement. In the last part of this chapter, the author discusses the influence of communist members of parliament on foreign resistance, the improvement of relations with the Soviet Union, President Beneš's visit in Moscow and the negotiation of an alliance agreement between Czechoslovakia and the USSR. Selected issues of legal forms of persecution in the 60s to 80s of the 20th century in Czechoslovakia Abstract After the year 1948, when the communist regime was established in Czechoslovakia, a number of persecutory instruments were enacted in order to suppress any disagreement with the established regime and to eliminate opponents of the socialist establishment. The thesis focuses on the period of the 1960s and 1980s, when the persecutions did not reach the level and cruelty they had in the 1950s, but they were still a very significant part of the repressive component of the government regime. The main focus of the work is on the persecution in the period before the so called Prague Spring, it follows the period of social relaxation in 1968 and the re-introduction of persecution mechanisms in the period after August 1968. In the first chapters, the work describes and analyzes legal developments after the Second World War with an emphasis on the 1960s and 1980s and subsequently concentrates on specific forms of enforcement, whether it is criminal prosecution, persecution in the field of citizenship, persecution in the field of property law or labor law. Development of Czech water law and legal relations related to water Abstract This dissertation thesis deals with the development of the legal regulation of water law and legal relations related to water in the Czech Republic. It provides an interpretation of the issue from the beginnings of the Czech state to the present. The thesis is divided into sixteen chronological chapters focusing on individual periods of development of this issue. The individual chapters are divided into sub-chapters dealing with sub-fields of water law and legal relations related to water. The first four chapters provide a theoretical introduction and a common basis for the other chapters. The first chapter contains an analysis of the concept of water law and the systematics of water law. The second chapter provides an outline of the development of water law in antiquity as an illumination of the earliest roots of water law. The third chapter discusses the foundations and structure of Roman water law as the methodological basis of the field of water law. The fourth chapter deals with the basic features of the development of water law in the territory of states neighbouring the Czech Republic. The Fourteenth Amendment to the United States Constitution and the evolution of its influence as a result of judicial interpretation Abstract The thesis analyzes the Fourteenth Amendment to the United States Constitution and the changes in its understanding resulting from its interpretation by the Supreme Court of the United States throughout the years since the ratification of the Amendment. The thesis discusses every section of the Fourteenth Amendment, but the highest attention is dedicated to its most significant first section and the clauses contained in it; the citizenship clause, the privileges or immunities clause, the due process clause and the equal protection clause. The debates of the 39th Congress are discussed as well, as they offer an insight to the original understanding of the terms used in the text of the Amendment and allow to understand the context of its origin. The evolution of the Amendment's influence is then analyzed through a number of historical eras that reflect the ever-changing composition of the Court and the decisions stemming from it. Selected issues of registration of immovables in the Czech lands between years 1918 and 1989 Abstract This diploma thesis "Selected issues of registration of immovables in the Czech lands between 1918 and 1989" follows the development of the legal regulation of registries of immovables in which information about these immovables - land and buildings - and legal relations to these properties were registered. These registries are analysed from a legal historical perspective. The purpose of each registry was different, records were kept for tax, economic and other purposes. This thesis is divided into 5 chapters according to the respective periods of development of Czechoslovakia. The first chapter deals with registries of immovables that were used before the establishment of the Czechoslovakia. The second chapter deals with registries of immovables used during the period of the First Czechoslovak Republic. These registries were Land Tax Cadastre, later replaced by a Cadastre of Lands; and Land Registry Books.
