Independent regulator as a public authority

This dissertation thesis presents the elaboration of the issue of Czech independent authorities on the basis of empirical data. For the purposes of the dissertation, an extensive dataset was created, which covers 16 central administrative authorities, the Czech National Bank and the Supreme Audit Office monitored in the period 1993-2021. The dataset also contains data on the heads of these institutions, their professional backgrounds, links to political parties and chances of completing their mandate. A sub-objective of the dissertation is to conduct a quantitative assessment of the formal (de iure) independence of the institutions based on the internationally used Gilardi index. The results of the assessment are useful for categorizing independent administrative authorities and for comparing them internationally. The assessment of formal independence primarily represents a first and necessary step for follow-up research, and the results are included as input data for subsequent analysis. For the purposes of this thesis, a Gilardi index was constructed for 18 Czech institutions (a total of 394 individual independence index values) since 1993. Other central administrative authorities Abstract The Diploma thesis focuses on some administrative authorities of the Czech Republic which do not have a superior administrative body, and which are not led by a member of the government as in the case of ministries. These authorities are defined by the Act on the competence of central authorities as "other central administrative authorities". In the introduction to the thesis, these bodies are defined in more detail and the establishment of some of them is linked to the requirement for the independent exercise of their functions. This is followed by a chapter focusing on their history from the proclamation of an independent Czechoslovakia, covering the period after the communist takeover in 1948 to the present day. The thesis than focuses on the sources of the aforementioned requirement for independent functioning and, in this context, also on the international overview of the existence of these bodies and, above all, on the consistency of their status with the constitutional framework of the Czech Republic and with the principle of democracy in general. Position of activities of the Council for Radio and Television Broadcasting

This thesis deals with the issue of The Council for Radio and Television Broadcasting (the Council). The Council is an administrative office, which the public has little information about, and this lack of facts often results in various misunderstandings. The main objective of this thesis is to provide information about the Council and its activities and thus help to eliminate these mistakes and lack of knowledge. The thesis combines the administrative law and the media law. The thesis is composed of two major parts. The Council in general is dealt with in the first part. The history is summarized, the Council as an independent administrative regulatory authority is described and further examples of such administrative offices are provided in this part. The areas in which the Council operates are presented in the second part of this thesis, which is divided into three chapters according the main laws concerning the broadcasting. The first one deals with the law on broadcasting. Key broadcasting licenses and basic obligations of broadcasters are discussed in this chapter. The second chapter is about the law on the regulation of advertising. The last of these relevant laws is the law on audiovisual media services on demand, which regulates the newest electronic medium - the internet. Electronic mass...
