Legal regime of mining related land

This diploma thesis deals with legal regulation of lands affected by mining activities. These activities, predominantly the extraction of minerals are by their nature very closely related to soil and land. The thesis offers a comprehensive view of the legal relations in the process of mining - from prospecting and exploration of mineral deposits to mine closure - while it discusses the key issues from the perspective of the land owner as well as the mining companies. Legal relations arising from mining activities are significantly influenced by the character of mining. Mining interferes with rights and interests related to land and ownership of land which gives rise to certain conflicts. Mining companies' interests come very often into conflict with interests of the owner of the land where the mineral deposit is located. The legal relations are further complicated by the position of the state who acts as an owner of mineral wealth and an authority defending public interests. The introductory chapter of the thesis defines the terms that are essential for the selected topic. The content of the next chapters corresponds with phases of mining activities as they are carried out in reality. Protection of the environment during mining activities

This Master thesis deals with the issue of enviromental protection in mining. Mining has negative on impacts on the environment and the goal of law on this field should be the minimalisation of these negative impacts. This master thesis offers a complex overview of issues brought about in mining from the initial stage of exploration and prospecting to its final stage of reclamation. First and second chapter of this thesis give a brief overview of mining issues and state aims of this thesis. Third chapter deals with the environmental protection in the stage of exploration and prospecting, fourth and fifth chapter allow an insight into delianation and mine opening procedures. Sixth chapter deals with mining itself and environmental protection during this process. Seventh chapter adresses reclamations and mine closures. Last chapter is conclusion.

Thema of Bachelor thesis is called „"Evaluation of the state of old ecological burdens originating from mining activities in Kutná Hora and its surroundings" is focused on existing contamination of soils with heavy metals, especially arsenic in Kutná Hora. The greatest burden is being explored in the city district of Kaňk. Contamination comes from the time of the greatest development of silver mining in Kutná Hora and its sur-roundings. The origins date back to the 13th century, and over the years the material deposited in the dumps from the mines due to the influence of the environment and human activity causes an environmental burden that may have a potential impact on hu-man health. Numerous studies and analyses have been carried out at the site to confirm the contamination of the environment with heavy metals and to propose a set of measures. There has been a great deal of geological work, but the literature on the health risk of contamination is not so abundant.
