International Comparative Analysis of Information Systems of trademarks and industrial designs

The thesis analyzes and compares the selected information systems on industrial property focused on trademarks and industrial designs. These are the selected systems of the Industrial Property Office of the Czech Republic, the Office for Harmonization in the Internal Market, the World Intellectual Property Organization, the US Patent and Trademark Office and the Swedish Patent and Registration Office. The work is divided into seven parts. The first part describes the terminology and the environment of trademarks and industrial designs. The second part lists the types of international classification, which is followed by the third part, which describes the international treaties and agreements. The fourth part presents selected institutions and their analyzed systems. The fifth part deals with the analysis and the sixth section summarizes trends in the disclosure of trade marks and industrial designs. The last seventh part of the work shows an impact of the protection of trademarks and industrial designs in the business. The analysis showed that the national databases of the Industrial Property Office of the Czech Republic were top rated. The worst evaluation acquired databases of the US Patent and Trademark Office. Trade marks with reputation in light of case-law of the EU

The rigorous thesis "Trade marks with reputation in light of case-law of the EU" submits a complex overview of the issues concerning trade marks with reputation in relation to the case-law of the EU. The initial part looks into the role of the Community trade mark in the framework of the Czech and International trade mark system, contains topic concerning the private law aspects of trade marks and submits general overview of procedural issues. The thesis also includes interpretation of the unclear terminology and presents "related topics" (comparison with well-known marks, enhanced distinctiveness, family of marks). The main pillar of the thesis is analysis of article 8(5) CTMR (counterpart of § 7 (1)(b) and (e) of the Act No. 441/2003 Coll., on Trade Marks) and of its cumulative conditions that need to be met to successfully claim the article concerned. It mainly contains analysis of the forms of encroachment (unfair advantage of the distinctiveness or the repute of the earlier mark, detriment to distinctiveness, detriment to repute) in light of case-law of the EU, all also from procedural law point of view. Linguistic regime of the EU in practise: comparison of accessibility of the documents in Czech, Spanish and English on the websites of the EU Agencies settled in Spain.

This Bachelor thesis focuses on the actual practice of the EU linguistic regime - a comparison of the accessibility of the documents in Czech, Spanish and English on the websites of the EU Agencies settled in Spain. First, it is described the institutional framework of the EU to which agencies of EU are included. Then, the following agencies will be presented throroughly: The European Fisheries Control Agency, The European Union Satellite Centre, The Office for Harmonization in the Internal Market and The European Agency for Safety and Health at Work. The next chapter is devoted to the language regime of the EU, followed by an analysis of the availability of documents on the websites of the aforementioned agencies. In here, a description of the website structure will be offered first and then an analysis of the availability of the documents. For a better comprehension of the results, they will be presented as well in tables and graphs. Finally, a valorisation of the results will close this work .
