Rigorózní práce "Ochranné známky s dobrým jménem ve světle rozhodovací praxe EU" podává ucelený výklad o dané problematice, přičemž je zaměřena zejména na analýzu judikatury Soudního dvora Evropské unie, která má zásadní vliv na rozhodovací praxi v České republice. V úvodní části práce pojednává o postavení ochranné známky Společenství v rámci českého a mezinárodního systému známkoprávní ochrany, obsahuje pojednání o soukromoprávních aspektech ochranné známky jako takové a zabývá se procesní stránkou věci. Dále se věnuje výkladu problematických pojmů včetně jiných interpretačních nejasností a tzv. příbuzným tématům, kdy se jedná se o porovnání s institutem známky "obecně známé" a o pojednání o "zvýšené rozlišovací způsobilosti" a "známkové řadě". Stěžejním pilířem předmětné práce je rozbor čl. 8 odst. 5 Nařízení (protějšek ustanovení § 7 odst. 1 písm. b) a e) zákona o ochranných známkách) a jeho kumulativních podmínek pro úspěšné uplatnění ochranné známky s dobrým jménem. Zejména je zde obsažena analýza jednotlivých forem zásahů do práv z předmětné ochranné známky v podobě těžení z rozlišovací způsobilosti nebo dobrého jména a újmy na nich, a to ve světle rozhodovací praxe Soudního dvora Evropské unie a Úřadu pro harmonizaci ve vnitřním trhu, vše rovněž v procesněprávních souvislostech. The rigorous thesis "Trade marks with reputation in light of case-law of the EU" submits a complex overview of the issues concerning trade marks with reputation in relation to the case-law of the EU. The initial part looks into the role of the Community trade mark in the framework of the Czech and International trade mark system, contains topic concerning the private law aspects of trade marks and submits general overview of procedural issues. The thesis also includes interpretation of the unclear terminology and presents "related topics" (comparison with well-known marks, enhanced distinctiveness, family of marks). The main pillar of the thesis is analysis of article 8(5) CTMR (counterpart of § 7 (1)(b) and (e) of the Act No. 441/2003 Coll., on Trade Marks) and of its cumulative conditions that need to be met to successfully claim the article concerned. It mainly contains analysis of the forms of encroachment (unfair advantage of the distinctiveness or the repute of the earlier mark, detriment to distinctiveness, detriment to repute) in light of case-law of the EU, all also from procedural law point of view.
