Analysis of dispute settlement mechanism in Trade and Cooperation Agreement between the EU and the UK

The thesis deals with the analysis of the dispute settlement mechanism in the Trade and Cooperation Agreement between the European Union and the United Kingdom of Great Britain and Northern Ireland. The present legal arrangements governing the relationship between the United Kingdom, as the first former member state, and the European Union entail a number of ambiguities in political and legal discourse. In order to obtain a comprehensive picture and achieve the research objective, the thesis also includes the Withdrawal Agreement and a selected new generation trade agreement, the EU-Korea Agreement, as part of its analysis. To achieve this objective, the thesis sets out to answer two research questions, that is (1) how the institutional provisions of the agreements involved in the system of dispute settlement differ from each other and, where applicable, from the provisions of standard trade agreements concluded by the EU, and (2) how the dispute settlement mechanism foreseen by the individual agreements differ from each other and, where applicable, from other dispute settlement mechanisms in EU trade agreements. WTO as a Negotiation Forum between the USA and Brazil

This master's thesis is concerned with the settlement of particular WTO disputes between Brazil and the United States. The aim of the thesis is to explain the importance of the Dispute Settlement Mechanism (DSM) for Brazilian trade strategy. To demonstrate the use of the mechanism the focus is placed on two specific disputes involving the United States and Brazil. These disputes, regarding patent protection and cotton subsidies, are analyzed using case-study methodology. Moreover, quantitative research based on WTO disputes data is included in the introductory chapter. The study of the disputes shows that Brazil has been one of the most active users of the DSM and that it has initiated cases predominantly against developed countries, the United States being the most frequent target. This strategy enables Brazil to pursue cases that are likely to have systemic implications and thus could have an impact on the international trade order. The two case studies are examples of disputes of potential systemic importance. They further reveal the complexity of disputes in terms such as the increasing role of NGOs, the concept of retaliatory suits, and the significance of timing and political pressure. Využití mechanismu WTO při řešení obchodních sporů

Práce popisuje mechanismus řešení sporů ve WTO a rozebírá jeho význam na konkrétním sporu. Stručně rekapituluje historický vývoj obchodně politického mezinárodního systému a vývoj mechanismu řešení sporů. Popisuje jednotlivé fáze průběhu sporů a naznačuje možný vývoj mechanismu s pohledem na probíhající negociace ve WTO. Na příkladu sporu Norska versus EU v otázce antidumpingových opatření vůči dovozům chovaného lososa z Norska ilustruje složitost průběhu sporu i jeho celkovou náročnost a dochází k závěru o přínosu mechanismu při nutnosti uvážení významu chráněného ekonomického zájmu.
