Private international law from a comparative perspective(comparison of a particular segment in Czech law and the law of a selected country) This thesis works with a comparison of conflict rules in the field of international family law in the Czech Republic and in the Federal Republic of Germany. It is focused concretely on questions of marriage, register partnership and adoption, in which is included an international element. The topic has been taken into account in addition to the national rules of international private law also rules at international and European level. Includes is also future progress in this field. Thesis is divided into eight chapters. The introduction is followed by first chapter, which deals with general classification of international family law as a part of international private law and their definition. Following chapter is focused on conflict rules, determingfactores which may be used to determine the applicable law. Included are terms as public policy, remise or transmise. Chapter three is about general definition of court's jurisdiction to hear the dispute with an international element. Private international law from a comparative perspective (comparison of a particular segment in Czech law and the law of a selected country) The aim of this thesis is to compare the provisions of the Czech and Italian private international law respective to the issue of applicable law and recognition of trusts. The thesis is composed of six main chapters, introduction and conclusion. Second chapter refers to the historical concept of trusts with particular focus on the historical development in Czech legal system. Third chapter is focused on the notion of trust within the terms of the Act no. 89/2012 Coll., Civil Code and the Hague Convention on the Law Applicable to Trusts and on their Recognition as well as its unique implementation allowing creation of specific Italian trusts, so-called trusts interni. Fourth and fifth chapter are dedicated to the complex analysis of provisions of the Act no. 91/2012 Sb., on Private International Law and the Hague Convention, in particularly extent of the application, the choice of law, applicable law, change of law, depeçage, and recognition of trusts. European legislation overview and possible grounds for further development are described in the sixth chapter. Seventh chapter describes practical aspects of the applicable law and recognition of trusts.
Selected issues of conflict of laws in international family law

This thesis is aimed at specific questions of conflict rules of the international family law. Specifically, it focuses on the conflict law rules of matrimonial law with an international element. It takes into account the domestic, as well as the international regulation and regulation of the European Union. The thesis is divided into eight chapters. It starts with an introduction, which is followed by the second chapter which deals with the concept of international family law and its sources. The third chapter devoted to a general explanation of the conflict rules including the most significant related terms, such as determining factor or public order. The fourth chapter is aimed at the legal regulation of concluding a marriage with respect of the conflict rules determining the law applicable in case of capacity to conclude a marriage, its validity and form. This chapter also deals with consular marriages and marriages concluded abroad in case of threat to life. The fifth chapter contains he conflict rules of personal and property situation of spouses. This chapter at the same time reflects a recent progress in this field as far as European Union law on property situation in marriage is concerned. Future of the European Private International Law

The European international private law has undergone a dynamic development during the last twenty years. It can be assumed that this development will continue con-sidering the increasing need for dealing with the legal relations involving a cross-border element, which arise thanks to the exercise of the freedom of movement of goods, capital, services, and people in the frame of the European Union. The experts in international private law discuss the directions of its future development. Should it continue the same or similar direction as until now, i.e. the unification of individual in-struments and conclusion of international agreements (limited with the EU competen-ces), or should it take the direction of a comprehensive codification of the European conflict of laws? The last considered direction is the adoption of a comprehensive common code on private law, i.e. a code of the private substantive law rules. Neverthe-less, this possibility deals with the diversity of the law cultures and the law orders among the EU member states.
Právní úprava smluvních a mimosmluvních závazkových právních vztahů v právu Evropských společenství

Diplomová práce z oboru mezinárodního práva soukromého pojednává o současné kolizněprávní úpravě smluvních a mimosmluvních závazkových právních vztahů v právu Evropských společenství, a konkrétně o Římské úmluvě o právu rozhodném pro smluvní závazkové vztahy, o návrhu na její modernizaci a transformaci na komunitární nařízení (?Řím I?) a o návrhu nařízení o právu použitelném na mimosmluvní závazky (?Řím II?). Práce je rozdělena do tří kapitol. První kapitola se věnuje obecným otázkám mezinárodního práva soukromého a jeho postavení v právu ES a v právu ČR a jejich vzájemnému poměru. Druhá kapitola rozebírá jednotlivé instituty v Římské úmluvě a porovnává je s připravovanými změnami a s tuzemskou úpravou. Třetí kapitola se zabývá připravovanou úpravou mimosmluvních závazkových vztahů v právu ES. Celá práce dochází k závěrům o dopadu jednotlivých ustanovení na českou právní úpravu.
