Economics of Squatting

This bachelor thesis is focused on squatting phenomenon from an economic point of view. The main attention is given primarily to the institutional structure of squats and how they are defined. Theoretical part of the study investigates formation and structure of squatting in Western Europe and Czech Republic (cultural and political demarcation, causes and motivations to stand behind). The next phase summarizes and brings closer the economic approach on which - three main hypotheses are defined. Questions are, if it is possible to say, if squats are somehow similar in terms of organizational structure to the institutional theory of the firm, how institutions and property rights are defined. Empirical part is mainly based on repeated personal observation in one of the Prague squats and on structured interviews with ex-squatters. Conclusions are limited by the nature of the data set, since it cannot be statistically tested. Nevertheless the conclusion is unambiguous. Squat communities are established through implicit contractual relationships. Internal institutions and rules are generally formed via habits. Squatters also clearly distinguish between community and private property, despite the fact that such attitude is something they criticize. Squatters in Czech Republic perceive it as a capitalistic exploitation.
Real estate investments - Buying and renting apartments

The bachelor thesis is focused on the purchase and rent of apartments in Prague. The first part is dedicated to the legal and tax aspects of a purchase. The practical part is based on the consultations with experts in the field, and on author's research in the real estate business. Its main chapter is based on an analysis of buyers' preferences and describes the factors affecting the value of a property. The remaining chapters of the practical part explain the process of buying a property. The final chapter deals with an issue of renting apartments and ends up with showing examples how to calculate return on investment based on reality. The goal of this thesis is to provide a comprehensive view of the particularities of investing into apartments. The thesis may also serve as a guide to the basic knowledge helpful for purchasing an apartment.

Vlastnické právo k věci (movité i nemovité) vzniká převodem práva (kupní smlouvou či jinak) jen tehdy, pokud převodci (zciziteli) vlastnické právo k téže věci v době převodu svědčilo. Uplatňuje se tak zásada „nemo plus juris ad alium transfere potest quam ipse habet“ („nikdo nemůže převést na druhého více práv než má sám“). Dobrou vírou se obvykle rozumí to, že nabyvatel nevěděl a nemohl vědět (resp. nevěděl i když dodržel péči řádného hospodáře, nebo nevěděl, aniž by se dopustil hrubé nedbalosti – podle modelů, které jsou popsány dále), že věc není ve vlastnictví zcizitele (prodávajícího). Dále jsou rozpracovány i otázky dobré víry v souvislosti s registrem nemovitostí.

Solution of arrangement of land with limited property rights in selected land consolidation.

The aim of this thesis is to analyze the claims of owners of land in the comprehensive land consolidation in terms of restrictions on property rights in the cadastral Kaplice and Zdar at Kaplice. Analysis of the new land organization in terms of restrictions on land ownership and to evaluate the impact of these limitations on the course of land consolidation. These are mainly focus on the state before land consolidation in a given area and conditions after the land consolidation. The result of this work is graphic and textual comparison of inputs and outputs of the land consolidation. Influence on its course and overall comparison of these two territories.
Purchase contract

The topic of thesis is the purchase contract. The goal was to give its complete description, as it´s the most common type of contract, and to address everything that is related to this topic. The partial goal was to compare the civil and commercial legislation concerning the purchase agreement as well as taking into account the new Civil Code. The thesis is divided into two parts, theoretical and practical. However, by definition it is clear that these two parts are interconnected and the whole work represents a complex text. The focus of the analysis is placed on a sample purchase contract. Individual provisions of the sample purchase contract are supplemented by commentary, which includes suggestions and recommendations as well as personal opinions de lege ferenda.
Efficiency and effectiveness of regulation of private forest owners

This thesis deals with the analysis of private forest ownership and tries to evaluate the effectiveness of the regulation of forest ownership in the Czech Republic. Its aim is to compare the impact of regulation on private forest owners and those owners who own forests in protected areas. The study confirmed the hypothesis that the regulation of forest ownership has a negative impact on individual private owners, while limiting the power of property rights. Forest owners in protected areas face higher costs in forest management and greater supervision in the performance of their activities when compared to other private owners. However, multiplication of the impact of regulation layout rights for forest owners in protected areas does not change the motivation of these owners.
Analysis of legal instrument s of self-governments used in air protection

Air pollution from point sources is a serious problem that is mainly solved centrally and with use of public tools. The goal of this thesis is to find out whether in respect of the local and regional context of air pollution this problem can be solved by local self-governments and whether they may adopt the doctrine of free market environmentalism to protect the air with the use of private law as a subject of ownership. For this purpose, relevant instruments are analyzed, such as a nuisance action, an obligation of prevention and a liability for damages. The city of Ostrava even brought an action against the state, however, possibilities of its success are small. It was found that local self-governments could use these instruments to protect the air, but practical problems demotivate them.
Analysis of selected factors on the use of public transport

This thesis is aiming on the use of public transport in Europe. Objective of this work is by using correlation analysis determine whether the amount of subsidies to public transport and the ownership structure as the decisive criterion for the number of passengers, as an additional variable to assess the impact of fleet composition. Secondary data obtained from study of the University of Dublin has served to analyze. Calculation of the dependence didn't confirm or disclaim it. This gives space for further exploration. After analyzing the more comprehensive data set should be followed by analyzing the nature of subsidies, the choice of carriers, contractual conditions and other factors affecting the use of public transport.
The ownership rights to properties in the Czech republic

The topic of this thesis is "The Ownership Rights to Properties in The Czech Republic". The first part of this thesis describes historical development of the register from the very beginning up to now. In the next section is focused on detailed description of all the ways of acquiring the right of ownership to properties (such as acquisition agreement, inheritance or usucaption) and on its protection and extinction of the right. The next chapter deals with the problematic of divided co-ownership and the common assets of married couples. The last two chapters are devoted to restriction of ownership rights to property and expropriation of property. In the first of the two previously mentioned chapters I focus on the right of user (from their origin to their extinction). Second chapter listed is about particular phases of expropriation of the property including the expropriation procedure. In the practical part of this thesis I did an analysis of recording the ownership right into the Real Estate Cadastre of the Czech Republic.
